Sud EU donio je 22. listopada 2020. izuzetno značajnu presudu C-774/19 u slovenskom predmetu u kojemu se odlučivalo o svojstvu potrošača za tužitelja koji je tužio priređivača igre pokera zbog toga jer mu nije isplatio prilično velike dobitke iz igre tvrdeći da ima stručna znanja o materiji te da stoga nije potrošač.

Izvijestili su to iz udruge Franak informirajući kako je Vrhovni sud Republike Slovenije zatražio prije konačne odluke odgovor na pitanje radi li se o potrošaču od Suda EU, i Sud EU je nakon razmatranja konkretnog slučaja zaključio da se radi o potrošaču, unatoč njegovim specifičnim znanjima i stručnosti.

- Ta presuda itekako je važna za potrošače koji su ugovarali kredite s bankama u Hrvatskoj, jer se banke redovno brane tvrdnjama da fizičke osobe koje podižu tužbe nisu potrošači iz različitih razloga, jednom zbog toga što je netko broker, drugi put zbog toga što je netko pravnik ili sudac, treći put zbog toga što je netko profesor ekonomije, i slično.

No, banke su potpuno u krivu, jer svojstvo potrošača proizlazi iz svrhe ugovora, a ne iz zvanja i specifičnih i stručnih znanja kojima raspolaže tužitelj fizička osoba - ističu u udruzi Franak.

Ukratko je Sud EU presudom C-774/19 utvrdio sljedeće, po pojedinim paragrafima:

paragraf 29. - Pojam potrošača tumači se u skladu s položajem fizičke osobe u ugovoru, u skladu s prirodom i svrhom ugovora, a ne u vezi sa subjektivnim položajem te osobe, pa onda svojstvo potrošača prije svega proizlazi iz vrste ugovorne transakcije.

paragraf 38. - Pojam potrošač definira se kao suprotnost pojmu gospodarski subjekt, objektivne je prirode i ne ovisi o stvarnom znanju i osobnoj informiranosti fizičke osobe.

paragrafi 39. i 40. - Prema sudskoj praksi Suda EU svojstvo potrošača ispituje se isključivo s obzirom na položaj u ugovoru, pa stoga znanje iz područja kojem pripada sklopljeni ugovor pojedinca ne lišava svojstva potrošača.

- Ta presuda potvrda je svega onoga čemu svjedočimo i u odlukama hrvatskih sudova, uz neke vrlo rijetke izuzetke, kada poneki sudac ne razumije pravo EU u punome smislu.

Prisjetimo se da je i sudac Damir Kontrec, predsjednik Građanskog odjela Vrhovnog suda RH na seminaru u Opatiji 2018. izjavio za govornicom povodom pogrešne presude Općinskoga suda u Puli kojom je jednom brokeru taj sud oduzeo svojstvo potrošača, jer je po zvanju broker, sljedeće: "Kolektivna presuda vrijedi za sve potrošače, pa makar oni bili profesori ekonomije ili suci Vrhovnog suda RH!“ - kažu u udruzi Franak.

Dodaju kako je slovenska presuda samo je jedan mali dodatak svemu što već i otprije znamo.

- Svojstvo potrošača, dakle, ima svaka fizička osoba u svakome ugovoru koji je s trgovcem sklopljen izvan njezine profesionalne djelatnosti ili poslovne aktivnosti! - zaključuju u objavi za javnost.

Sud EU donio je 22. listopada 2020. izuzetno značajnu presudu C-774/19 u slovenskom predmetu u kojemu se odlučivalo o svojstvu potrošača za tužitelja koji je tužio priređivača igre pokera zbog toga jer mu nije isplatio prilično velike dobitke iz igre tvrdeći da ima stručna znanja o materiji te da stoga nije potrošač.

Izvijestili su to iz udruge Franak informirajući kako je Vrhovni sud Republike Slovenije zatražio prije konačne odluke odgovor na pitanje radi li se o potrošaču od Suda EU, i Sud EU je nakon razmatranja konkretnog slučaja zaključio da se radi o potrošaču, unatoč njegovim specifičnim znanjima i stručnosti.

- Ta presuda itekako je važna za potrošače koji su ugovarali kredite s bankama u Hrvatskoj, jer se banke redovno brane tvrdnjama da fizičke osobe koje podižu tužbe nisu potrošači iz različitih razloga, jednom zbog toga što je netko broker, drugi put zbog toga što je netko pravnik ili sudac, treći put zbog toga što je netko profesor ekonomije, i slično.

No, banke su potpuno u krivu, jer svojstvo potrošača proizlazi iz svrhe ugovora, a ne iz zvanja i specifičnih i stručnih znanja kojima raspolaže tužitelj fizička osoba - ističu u udruzi Franak.

Ukratko je Sud EU presudom C-774/19 utvrdio sljedeće, po pojedinim paragrafima:

paragraf 29. - Pojam potrošača tumači se u skladu s položajem fizičke osobe u ugovoru, u skladu s prirodom i svrhom ugovora, a ne u vezi sa subjektivnim položajem te osobe, pa onda svojstvo potrošača prije svega proizlazi iz vrste ugovorne transakcije.

paragraf 38. - Pojam potrošač definira se kao suprotnost pojmu gospodarski subjekt, objektivne je prirode i ne ovisi o stvarnom znanju i osobnoj informiranosti fizičke osobe.

paragrafi 39. i 40. - Prema sudskoj praksi Suda EU svojstvo potrošača ispituje se isključivo s obzirom na položaj u ugovoru, pa stoga znanje iz područja kojem pripada sklopljeni ugovor pojedinca ne lišava svojstva potrošača.

- Ta presuda potvrda je svega onoga čemu svjedočimo i u odlukama hrvatskih sudova, uz neke vrlo rijetke izuzetke, kada poneki sudac ne razumije pravo EU u punome smislu.

Prisjetimo se da je i sudac Damir Kontrec, predsjednik Građanskog odjela Vrhovnog suda RH na seminaru u Opatiji 2018. izjavio za govornicom povodom pogrešne presude Općinskoga suda u Puli kojom je jednom brokeru taj sud oduzeo svojstvo potrošača, jer je po zvanju broker, sljedeće: "Kolektivna presuda vrijedi za sve potrošače, pa makar oni bili profesori ekonomije ili suci Vrhovnog suda RH!“ - kažu u udruzi Franak.

Dodaju kako je slovenska presuda samo je jedan mali dodatak svemu što već i otprije znamo.

- Svojstvo potrošača, dakle, ima svaka fizička osoba u svakome ugovoru koji je s trgovcem sklopljen izvan njezine profesionalne djelatnosti ili poslovne aktivnosti! - zaključuju u objavi za javnost.

Presuda Suda Europske unije o jednom slučaju iz Slovenije važna je i za sve koji će ubuduće sklapati ugovore s bankama u Hrvatskoj

Sud EU donio je 22. listopada 2020. izuzetno značajnu presudu C-774/19 u slovenskom predmetu u kojemu se odlučivalo o svojstvu potrošača za tužitelja koji je tužio priređivača igre pokera zbog toga jer mu nije isplatio prilično velike dobitke iz igre tvrdeći da ima stručna znanja o materiji te da stoga nije potrošač.

Izvijestili su to iz udruge Franak informirajući kako je Vrhovni sud Republike Slovenije zatražio prije konačne odluke odgovor na pitanje radi li se o potrošaču od Suda EU, i Sud EU je nakon razmatranja konkretnog slučaja zaključio da se radi o potrošaču, unatoč njegovim specifičnim znanjima i stručnosti.
