Europski sud za ljudska prava (ECHR) odbio je u srijedu žalbu roditelja britanskog dvanaestogodišnjaka u stanju moždane smrti na prekid njege kojom ga se održava na životu, priopćio je sud.

Predsjednik suda koji je istog dana primio žalbu po hitnom postupku, odlučio je da "neće izreći traženu privremenu mjeru" i da "neće prihvatiti žalbu podnositelja", dodaje ECHR sa sjedištem u Strasbourgu.

Archieja Battersbeeja za kojeg liječnici smatraju da je u stanju moždane smrti, od travnja se održava u komi u londonskoj bolnici. Britanski sud je sredinom srpnja odobrio bolnici da prekine njegu kojom ga se održava na životu.

No njegovi roditelji, Hollie Dance i Paul Battersbee, uz potporu kršćanske udruge, i dalje su odlučni da održavaju sina na životu te su podnijeli nekoliko prigovora u hitnom postupku.

U srijedu ujutro obratili su se ECHR-u jer je isključenje aparata na kojima je dječak bilo planirano za srijedu u podne, po novoj odluci britanskog Vrhovnog suda.

Žalba je podnesena na temelju članka 39 njegova poslovnika po kojemu sud može narediti "privremenu mjeru" kada su podnositelji izloženi "stvarnoj opasnosti nanošenje nepopravljive štete" njihovu životu.

Roditelji su se među ostalim pozvali na to da Velika Britanija ne poštuje odluku UN-ova Odbora za prava invalidnih osoba koji je u petak zatražio od britanske vlade da se "suzdrži od toga da Archieju uskrati svaki medicinski postupak kojim ga se održava na životu" dok on ne prouči predmet.

Roditelji su se u žalbi pozvali i na odredbe Europske konvencije o ljudskim pravima o pravu na život, na pošteno suđenje, poštovanje privatnosti i obiteljskog života te na vjersku slobodu.

No ECHR je ocijenio da se u ovom slučaju ne treba "miješati" u odluke britanskog pravosuđa koje se izjasnilo za prekid medicinske skrbi.

Europski sudci su već odlučivali u sličnom predmetu koji je snažno odjeknuo u Francuskoj, u slučaju Vincenta Lamberta koji je na kraju umro u bolnici u Reimsu u srpnju 2019.

Europski sud za ljudska prava (ECHR) odbio je u srijedu žalbu roditelja britanskog dvanaestogodišnjaka u stanju moždane smrti na prekid njege kojom ga se održava na životu, priopćio je sud.

Predsjednik suda koji je istog dana primio žalbu po hitnom postupku, odlučio je da "neće izreći traženu privremenu mjeru" i da "neće prihvatiti žalbu podnositelja", dodaje ECHR sa sjedištem u Strasbourgu.

Archieja Battersbeeja za kojeg liječnici smatraju da je u stanju moždane smrti, od travnja se održava u komi u londonskoj bolnici. Britanski sud je sredinom srpnja odobrio bolnici da prekine njegu kojom ga se održava na životu.

No njegovi roditelji, Hollie Dance i Paul Battersbee, uz potporu kršćanske udruge, i dalje su odlučni da održavaju sina na životu te su podnijeli nekoliko prigovora u hitnom postupku.

U srijedu ujutro obratili su se ECHR-u jer je isključenje aparata na kojima je dječak bilo planirano za srijedu u podne, po novoj odluci britanskog Vrhovnog suda.

Žalba je podnesena na temelju članka 39 njegova poslovnika po kojemu sud može narediti "privremenu mjeru" kada su podnositelji izloženi "stvarnoj opasnosti nanošenje nepopravljive štete" njihovu životu.

Roditelji su se među ostalim pozvali na to da Velika Britanija ne poštuje odluku UN-ova Odbora za prava invalidnih osoba koji je u petak zatražio od britanske vlade da se "suzdrži od toga da Archieju uskrati svaki medicinski postupak kojim ga se održava na životu" dok on ne prouči predmet.

Roditelji su se u žalbi pozvali i na odredbe Europske konvencije o ljudskim pravima o pravu na život, na pošteno suđenje, poštovanje privatnosti i obiteljskog života te na vjersku slobodu.

No ECHR je ocijenio da se u ovom slučaju ne treba "miješati" u odluke britanskog pravosuđa koje se izjasnilo za prekid medicinske skrbi.

Europski sudci su već odlučivali u sličnom predmetu koji je snažno odjeknuo u Francuskoj, u slučaju Vincenta Lamberta koji je na kraju umro u bolnici u Reimsu u srpnju 2019.

Europski sud za ljudska prava (ECHR) odbio je u srijedu žalbu roditelja britanskog dvanaestogodišnjaka u stanju moždane smrti na prekid njege kojom ga se održava na životu, priopćio je sud.

Predsjednik suda koji je istog dana primio žalbu po hitnom postupku, odlučio je da "neće izreći traženu privremenu mjeru" i da "neće prihvatiti žalbu podnositelja", dodaje ECHR sa sjedištem u Strasbourgu.

Archieja Battersbeeja za kojeg liječnici smatraju da je u stanju moždane smrti, od travnja se održava u komi u londonskoj bolnici. Britanski sud je sredinom srpnja odobrio bolnici da prekine njegu kojom ga se održava na životu.
