Visoki trgovački sud potvrdio je prvostupanjsku presudu suca zagrebačkog Trgovačkog suda Radovana Dobronića o ništetnosti valutne klauzule za kredite u švicarcima, objavljeno je danas na web-stranicama tog suda, prenosi dnevnik.hr.

Podsjetimo, dosad su presuđene ništetne kamatne stope, a sad i ništetnost valutne klauzule u švicarcima. To znači da građani privatnim tužbama mogu tražiti kompletnu ništetnost ugovora o kreditima u švicarskim francima.

"Ako Visoki trgovački sud odluči da je valutna klauzula u 'švicarcima' bila nepošteno ugovorena, to znači da će svih 120.000 dužnika imati širom otvorena vrata da dobiju kompletnu razliku tečaja i preplaćenih kamata u svoje ruke, zajedno sa zateznim kamatama jer nema zastare tih potraživanja", rekao je saborski zastupnik stranke Snaga Goran Aleksić prije mjesec dana, prilikom objave presude Vrhovnog suda da nema zastare potraživanja preplaćenih kamata iz kredita s valutnom klauzulom u švicarskim francima na temelju pravomoćne kolektivne sudske presude u slučaju Franak.

Visoki trgovački sud potvrdio je prvostupanjsku presudu suca zagrebačkog Trgovačkog suda Radovana Dobronića o ništetnosti valutne klauzule za kredite u švicarcima, objavljeno je danas na web-stranicama tog suda, prenosi dnevnik.hr.

Podsjetimo, dosad su presuđene ništetne kamatne stope, a sad i ništetnost valutne klauzule u švicarcima. To znači da građani privatnim tužbama mogu tražiti kompletnu ništetnost ugovora o kreditima u švicarskim francima.

"Ako Visoki trgovački sud odluči da je valutna klauzula u 'švicarcima' bila nepošteno ugovorena, to znači da će svih 120.000 dužnika imati širom otvorena vrata da dobiju kompletnu razliku tečaja i preplaćenih kamata u svoje ruke, zajedno sa zateznim kamatama jer nema zastare tih potraživanja", rekao je saborski zastupnik stranke Snaga Goran Aleksić prije mjesec dana, prilikom objave presude Vrhovnog suda da nema zastare potraživanja preplaćenih kamata iz kredita s valutnom klauzulom u švicarskim francima na temelju pravomoćne kolektivne sudske presude u slučaju Franak.
