Sud EU najnovijom presudom po poljskom predmetu C-19/20 potvrdio je svoja dosadašnja stajališta o tome kako konverzija nije prepreka za obeštećenje potrošača. O tome je izvijestila Udruga Franak na svojoj Facebook stranici, ujedno objavljujući i poveznicu na presudu objavljenu u četvrtak 29. travnja 2021.

- Sud EU presudom C-19/20 potvrdio je stajališta iz presuda C-118/17 i C-452/18. Očekujem da se to isto dogodi i u našem predmetu C-567/20, u kojemu Sud EU odlučuje o pravu hrvatskih potrošača na obeštećenje nakon konverzije – kazao nam je Goran Aleksić, koordinator Ekonomsko-pravnog tima Udruge Franak.

- Ukratko, potrošač koji je konvertirao ugovornu odredbu gubi pravo na restituciju samo ako se toga prava odrekne na temelju informacije da ukoliko izvrši konverziju više sudski ništa nema pravo zatražiti. U Hrvatskoj je to odricanje dapače bilo zakonom zabranjeno. Konverzijom nismo obeštećeni, i uskoro dolazi vrijeme konačnih financijskih obračuna s bankama - istaknuo je Aleksić.

Iz Udruge Franak u objavi na Facebook stranici istakli su kako su očekivali da će presuda Suda EU po poljskom predmetu biti slična svim dosadašnjim sličnim presudama.

Naveli su također kako će javnost detaljnije informirati nakon stručne analize, a prije toga ukratko su naglasili sljedeće:

1. Sud EU još jednom je potvrdio da nakon konverzije ugovorne odredbe, potrošač i dalje ima pravo utvrđivati ništetnost prijašnjih ugovornih odredaba, pri čemu se sud poziva na utvrđenja iz presuda C-118/17 i C-452/18, a te dvije presude su upravo temelj za pitanja po našem predmetu na Sudu EU, C-567/20.

2. Sud EU još jednom je potvrdio da se potrošaču mogu ukinuti njegova prava na temelju Direktive 93/13, ali samo u slučaju ako se on tih prava odrekao na temelju informiranog pristanka. Dakle, niti u našoj, niti u poljskoj konverziji toga pristanka nije bilo.

3. Sud EU utvrdio je isto tako da u slučaju ako ništetnost ugovorne odredbe uzrokuje ništetnost ugovora, nacionalni sud mora informirati potrošača koje su posljedice za njega u tome slučaju.

Sud EU najnovijom presudom po poljskom predmetu C-19/20 potvrdio je svoja dosadašnja stajališta o tome kako konverzija nije prepreka za obeštećenje potrošača. O tome je izvijestila Udruga Franak na svojoj Facebook stranici, ujedno objavljujući i poveznicu na presudu objavljenu u četvrtak 29. travnja 2021.

- Sud EU presudom C-19/20 potvrdio je stajališta iz presuda C-118/17 i C-452/18. Očekujem da se to isto dogodi i u našem predmetu C-567/20, u kojemu Sud EU odlučuje o pravu hrvatskih potrošača na obeštećenje nakon konverzije – kazao nam je Goran Aleksić, koordinator Ekonomsko-pravnog tima Udruge Franak.

- Ukratko, potrošač koji je konvertirao ugovornu odredbu gubi pravo na restituciju samo ako se toga prava odrekne na temelju informacije da ukoliko izvrši konverziju više sudski ništa nema pravo zatražiti. U Hrvatskoj je to odricanje dapače bilo zakonom zabranjeno. Konverzijom nismo obeštećeni, i uskoro dolazi vrijeme konačnih financijskih obračuna s bankama - istaknuo je Aleksić.

Iz Udruge Franak u objavi na Facebook stranici istakli su kako su očekivali da će presuda Suda EU po poljskom predmetu biti slična svim dosadašnjim sličnim presudama.

Naveli su također kako će javnost detaljnije informirati nakon stručne analize, a prije toga ukratko su naglasili sljedeće:

1. Sud EU još jednom je potvrdio da nakon konverzije ugovorne odredbe, potrošač i dalje ima pravo utvrđivati ništetnost prijašnjih ugovornih odredaba, pri čemu se sud poziva na utvrđenja iz presuda C-118/17 i C-452/18, a te dvije presude su upravo temelj za pitanja po našem predmetu na Sudu EU, C-567/20.

2. Sud EU još jednom je potvrdio da se potrošaču mogu ukinuti njegova prava na temelju Direktive 93/13, ali samo u slučaju ako se on tih prava odrekao na temelju informiranog pristanka. Dakle, niti u našoj, niti u poljskoj konverziji toga pristanka nije bilo.

3. Sud EU utvrdio je isto tako da u slučaju ako ništetnost ugovorne odredbe uzrokuje ništetnost ugovora, nacionalni sud mora informirati potrošača koje su posljedice za njega u tome slučaju.

Udruga Franak: Sud EU presudom u poljskom predmetu potvrdio da konverzija nije prepreka za obeštećenje. Očekujemo da se isto dogodi i u našem predmetu

Sud EU najnovijom presudom po poljskom predmetu C-19/20 potvrdio je svoja dosadašnja stajališta o tome kako konverzija nije prepreka za obeštećenje potrošača. O tome je izvijestila Udruga Franak na svojoj Facebook stranici, ujedno objavljujući i poveznicu na presudu objavljenu u četvrtak 29. travnja 2021.

- Sud EU presudom C-19/20 potvrdio je stajališta iz presuda C-118/17 i C-452/18. Očekujem da se to isto dogodi i u našem predmetu C-567/20, u kojemu Sud EU odlučuje o pravu hrvatskih potrošača na obeštećenje nakon konverzije – kazao nam je Goran Aleksić, koordinator Ekonomsko-pravnog tima Udruge Franak.

- Ukratko, potrošač koji je konvertirao ugovornu odredbu gubi pravo na restituciju samo ako se toga prava odrekne na temelju informacije da ukoliko izvrši...
