Osvrćući se na nalaze Hrvatske agencije za nadzor financijskih usluga (HANFA) o poslovanju leasing društava, te ukazujući na poslovanje banaka, Udruga Franak obratila se javnosti priopćenjem koje donosimo u cijelosti.

“Ovih dana na kućne adrese korisnika leasinga stižu obavijesti iz HANFA-e kojima se korisnike leasinga obavještava kako je UniCredit Leasing Croatia d.o.o. kršila svoje ugovorne obveze te je zaračunavala tijekom otplate leasinga marže koje su veće od ugovorenih. I ne radi se tu samo o UniCreditu, HANFA je utvrdila nadzorom da je osam od devet leasing kuća varalo i tako pljačkalo korisnike leasinga. Radi se o sljedećim društvima, koja su svojim jednostranim nezakonitim odlukama mijenjala ugovorene marže: BKS – leasing Croatia, Erste&Steiermaerkische S-Leasing, Impuls Leasing, Mercedes Benz Leasing Hrvatska, HETA Asset Resolution Hrvatska, OTP Leasing, PBZ-LEASING, i UniCredit Leasing Croatia.

Nepravilnostima je obuhvaćeno više od 50.000 ugovora o leasingu, piše u nalazu HANFA-e!

Udruga Franak pozvala je 27. travnja 2021. otvorenim pismom Vladu, HNB, sve klubove zastupnika u Hrvatskome saboru i DORH da učine sve što je u njihovoj nadležnosti kako bi se uklonile pronađene nepravilnosti te kako bi se opljačkani novac vratio korisnicima leasinga, ali i korisnicima kredita kojih ima nekoliko stotina tisuća kojima su banke nezakonito uzele više milijardi kuna. Nitko od njih nije prstom mrdnuo po tome pitanju!

Kako god su leasing kuće kamatarile nezakonitim kamatama svoje korisnike, tako su jednako banke kamatarile nezakonitim kamatama korisnike kredita u svim kreditima ugovorenim prije 10.1.2013., i to kako fizičke osobe, tako jednako i pravne osobe.

Ponavljamo još jednom na koji su način Hrvatske banke, u svim kreditima ugovorenim prije 2013., kako s potrošačima, tako i s pravnim osobama, nezakonito poslovale:

1. U potrošačkim kreditima u pravilu su ugovarale, i to bez obzira na vrstu i valutu kredita, kamatne stope koje se mijenjaju odlukom banke. Takve kamatne stope neodredive su i zbog toga nevažeće prema odredbama članaka 269. do 272. Zakona o obveznim odnosima. Takve kamatne stope ugovorene su u više stotina tisuća kredita. U pravilu su tijekom otplate početnu kamatnu stopu banke povećavale na štetu korisnika kredita, a nisu imale za to ugovorene temelje.

2. U ugovorima o kreditu s pravnim osobama banke bi ugovorile parametre i time stvarale privid zakonitog poslovanja, ali budući da su tijekom otplate padale vrijednosti promjenjivih parametara Libora i Euribora, da bi zadržale visoke kamatne stope banke su samovoljno i jednostrano svojim internim odlukama mijenjale ugovorene fiksne marže naviše. Da bi to mogle činiti, banke su u ugovorima osim parametara ugovarale i dodatnu mogućnost da će kamatnu stopu mijenjati svojim internim odlukama. Takvo ugovaranje kamatne stope ništetno je prema odredbama članaka 269. do 272. Zakona o obveznim odnosima, na jednak način kako su ugovorene ništetne kamatne stope u potrošačkim kreditima.

Pozivamo sve korisnike leasinga bez obzira na valutnu klauzulu, kao i sve korisnike kredita banaka koji su ugovarali kredite prije 2013. da se jave Udruzi Franak radi savjetovanja o potencijalnim tužbama. Leasing kuće i banke opelješile su ljude za najmanje 5 milijardi kuna na nezakonito naplaćenim kamatama. Ako to nije pljačka, mi ne znamo što bi se onda trebalo nazvati pljačkom.

Napominjemo dodatno da korisnici leasinga s valutnom klauzulom CHF svakako mogu tužiti leasing društvo zbog nepoštene valutne klauzule CHF, jer nema nikakve razlike između valutne klauzule CHF ugovorene s bankom ili s leasing društvom. Ipak, u takvome slučaju još ne postoji sudska praksa, pa je potreban dodatni odvjetnički napor za utvrđenje tužbenog zahtjeva”, navedeno je u priopćenju Udruge Franak.

Osvrćući se na nalaze Hrvatske agencije za nadzor financijskih usluga (HANFA) o poslovanju leasing društava, te ukazujući na poslovanje banaka, Udruga Franak obratila se javnosti priopćenjem koje donosimo u cijelosti.

“Ovih dana na kućne adrese korisnika leasinga stižu obavijesti iz HANFA-e kojima se korisnike leasinga obavještava kako je UniCredit Leasing Croatia d.o.o. kršila svoje ugovorne obveze te je zaračunavala tijekom otplate leasinga marže koje su veće od ugovorenih. I ne radi se tu samo o UniCreditu, HANFA je utvrdila nadzorom da je osam od devet leasing kuća varalo i tako pljačkalo korisnike leasinga. Radi se o sljedećim društvima, koja su svojim jednostranim nezakonitim odlukama mijenjala ugovorene marže: BKS – leasing Croatia, Erste&Steiermaerkische S-Leasing, Impuls Leasing, Mercedes Benz Leasing Hrvatska, HETA Asset Resolution Hrvatska, OTP Leasing, PBZ-LEASING, i UniCredit Leasing Croatia.

Nepravilnostima je obuhvaćeno više od 50.000 ugovora o leasingu, piše u nalazu HANFA-e!

Udruga Franak pozvala je 27. travnja 2021. otvorenim pismom Vladu, HNB, sve klubove zastupnika u Hrvatskome saboru i DORH da učine sve što je u njihovoj nadležnosti kako bi se uklonile pronađene nepravilnosti te kako bi se opljačkani novac vratio korisnicima leasinga, ali i korisnicima kredita kojih ima nekoliko stotina tisuća kojima su banke nezakonito uzele više milijardi kuna. Nitko od njih nije prstom mrdnuo po tome pitanju!

Kako god su leasing kuće kamatarile nezakonitim kamatama svoje korisnike, tako su jednako banke kamatarile nezakonitim kamatama korisnike kredita u svim kreditima ugovorenim prije 10.1.2013., i to kako fizičke osobe, tako jednako i pravne osobe.

Ponavljamo još jednom na koji su način Hrvatske banke, u svim kreditima ugovorenim prije 2013., kako s potrošačima, tako i s pravnim osobama, nezakonito poslovale:

1. U potrošačkim kreditima u pravilu su ugovarale, i to bez obzira na vrstu i valutu kredita, kamatne stope koje se mijenjaju odlukom banke. Takve kamatne stope neodredive su i zbog toga nevažeće prema odredbama članaka 269. do 272. Zakona o obveznim odnosima. Takve kamatne stope ugovorene su u više stotina tisuća kredita. U pravilu su tijekom otplate početnu kamatnu stopu banke povećavale na štetu korisnika kredita, a nisu imale za to ugovorene temelje.

2. U ugovorima o kreditu s pravnim osobama banke bi ugovorile parametre i time stvarale privid zakonitog poslovanja, ali budući da su tijekom otplate padale vrijednosti promjenjivih parametara Libora i Euribora, da bi zadržale visoke kamatne stope banke su samovoljno i jednostrano svojim internim odlukama mijenjale ugovorene fiksne marže naviše. Da bi to mogle činiti, banke su u ugovorima osim parametara ugovarale i dodatnu mogućnost da će kamatnu stopu mijenjati svojim internim odlukama. Takvo ugovaranje kamatne stope ništetno je prema odredbama članaka 269. do 272. Zakona o obveznim odnosima, na jednak način kako su ugovorene ništetne kamatne stope u potrošačkim kreditima.

Pozivamo sve korisnike leasinga bez obzira na valutnu klauzulu, kao i sve korisnike kredita banaka koji su ugovarali kredite prije 2013. da se jave Udruzi Franak radi savjetovanja o potencijalnim tužbama. Leasing kuće i banke opelješile su ljude za najmanje 5 milijardi kuna na nezakonito naplaćenim kamatama. Ako to nije pljačka, mi ne znamo što bi se onda trebalo nazvati pljačkom.

Napominjemo dodatno da korisnici leasinga s valutnom klauzulom CHF svakako mogu tužiti leasing društvo zbog nepoštene valutne klauzule CHF, jer nema nikakve razlike između valutne klauzule CHF ugovorene s bankom ili s leasing društvom. Ipak, u takvome slučaju još ne postoji sudska praksa, pa je potreban dodatni odvjetnički napor za utvrđenje tužbenog zahtjeva”, navedeno je u priopćenju Udruge Franak.

Osvrćući se na nalaze Hrvatske agencije za nadzor financijskih usluga (HANFA) o poslovanju leasing društava, te ukazujući na poslovanje banaka, Udruga Franak obratila se javnosti priopćenjem koje donosimo u cijelosti.

“Ovih dana na kućne adrese korisnika leasinga stižu obavijesti iz HANFA-e kojima se korisnike leasinga obavještava kako je UniCredit Leasing Croatia d.o.o. kršila svoje ugovorne obveze te je zaračunavala tijekom otplate leasinga marže koje su veće od ugovorenih. I ne radi se tu samo o UniCreditu, HANFA je utvrdila nadzorom da je osam od devet leasing kuća varalo i tako pljačkalo korisnike leasinga. Radi se o sljedećim društvima, koja su svojim jednostranim nezakonitim odlukama mijenjala ugovorene marže: BKS – leasing Croatia, Erste&Steiermaerkische...
