Vlada još uvijek traži model za sprečavanje tsunamija ovrha koji prijeti nakon 18. listopada, kada istječe moratorij na ovrhe, uveden zbog posebnih okolnosti nastalih zbog pandemije koronavirusa. Prvi put je tromjesečni moratorij uveden 17. travnja, a nakon njegova isteka u srpnju, Vlada ga je odlučila produljiti za još tri mjeseca.
Zastoj ovrha u prvom je tromjesečju bio uveden za ukupno 1,089.620 osnova za plaćanje, a odnosile su se na 234.587 građana i 10.269 fizičkih osoba koje obavljaju registriranu djelatnost - obrtnika.
Prema nekim neslužbenim procjenama, nakon 18. listopada, kada istekne i drugi moratorij, odjednom bismo mogli imati oko 400.000 građana pod ovrhom. Kako bi ublažila udar, Vlada je najprije razmišljala o tome da se omogući obročna otplata duga, no nakon nekoliko sastanaka s javnim bilježnicima i ovrhovoditeljima, od toga se odustalo. S jedne strane, taj model nije prihvatljiv ovrhovoditeljima, a mogao bi izazvati i praktične probleme. Suci su, naime, komentirali kako bi to moglo izazvati seriju prigovora, što bi predmete preselilo na sud i zakompliciralo njihovo rješavanje.
Prema neslužbenim informacijama, trenutačno je na stolu prijedlog prema kojemu bi se ovrhe provodile u dva vala. U prvome bi se rješavale one koje su zaprimljene do 18. srpnja, odnosno u prva tri mjeseca moratorija. Te bi se ovrhe na temelju vjerodostojne isprave počele provoditi od 19. listopada.
U drugome valu rješavale bi se ovrhe koje su stigle u drugom tromjesečju, između srpnja i listopada, a one bi se počele provoditi od 1. siječnja 2021. godine. Ovrhe koje bi stigle od 25. listopada nadalje odmah bi se stavile u proceduru i provodile bi se bez ikakvih odgoda.
Prema našim informacijama, Vlada pravno ta pitanja želi riješiti donošenjem uredbe sa zakonskom snagom, a onda bi trebala stupiti na snagu od 25. listopada ove godine. U Ministarstvu pravosuđa na tu temu treba se ovaj tjedan održati još jedan sastanak s javnim bilježnicima, na kojemu bi se trebalo razmotriti taj model te vidjeti koliko je provediv.
Neki javni bilježnici s kojima smo razgovarali kažu kako bismo tim mjerama dobili i treći mini moratorij, a problem vide i u tome što bi ovrhovoditelji koji su naplatu svoga duga zatražili u svibnju ove godine, čekali na red do listopada, dok bi oni koji će krajem listopada tek pokretati ovršne postupke, odmah biti u proceduri.
Koliko će točno ovrha biti krajem godine i koliko blokiranih građana, zasad se ne može precizno znati. Tijekom moratorija na ovrhe, koji ukupno traje šest mjeseci, podneseno je 175.000 novih zahtjeva za pokretanjem postupaka. U Vladinom planu zakonodavnih aktivnosti su izmjene Ovršnog zakona.
Potpuno se odustalo od ranijeg koncepta vraćanja ovrha na sudove, uz zadržavanje javnih bilježnika, i pisat će se potpuno novi zakon. No, u provom koraku pristupit će se izmjeni postojećeg, i to kako bi se olakšalo poziciju dužnika. To znači da se ovrhe na stanu neće moći provoditi zimi te kako će biti proširen krug primanja zaštićenih od prisilne naplate.

Vlada još uvijek traži model za sprečavanje tsunamija ovrha koji prijeti nakon 18. listopada, kada istječe moratorij na ovrhe, uveden zbog posebnih okolnosti nastalih zbog pandemije koronavirusa. Prvi put je tromjesečni moratorij uveden 17. travnja, a nakon njegova isteka u srpnju, Vlada ga je odlučila produljiti za još tri mjeseca.
Zastoj ovrha u prvom je tromjesečju bio uveden za ukupno 1,089.620 osnova za plaćanje, a odnosile su se na 234.587 građana i 10.269 fizičkih osoba koje obavljaju registriranu djelatnost - obrtnika.
Prema nekim neslužbenim procjenama, nakon 18. listopada, kada istekne i drugi moratorij, odjednom bismo mogli imati oko 400.000 građana pod ovrhom. Kako bi ublažila udar, Vlada je najprije razmišljala o tome da se omogući obročna otplata duga, no nakon nekoliko sastanaka s javnim bilježnicima i ovrhovoditeljima, od toga se odustalo. S jedne strane, taj model nije prihvatljiv ovrhovoditeljima, a mogao bi izazvati i praktične probleme. Suci su, naime, komentirali kako bi to moglo izazvati seriju prigovora, što bi predmete preselilo na sud i zakompliciralo njihovo rješavanje.
Prema neslužbenim informacijama, trenutačno je na stolu prijedlog prema kojemu bi se ovrhe provodile u dva vala. U prvome bi se rješavale one koje su zaprimljene do 18. srpnja, odnosno u prva tri mjeseca moratorija. Te bi se ovrhe na temelju vjerodostojne isprave počele provoditi od 19. listopada.
U drugome valu rješavale bi se ovrhe koje su stigle u drugom tromjesečju, između srpnja i listopada, a one bi se počele provoditi od 1. siječnja 2021. godine. Ovrhe koje bi stigle od 25. listopada nadalje odmah bi se stavile u proceduru i provodile bi se bez ikakvih odgoda.
Prema našim informacijama, Vlada pravno ta pitanja želi riješiti donošenjem uredbe sa zakonskom snagom, a onda bi trebala stupiti na snagu od 25. listopada ove godine. U Ministarstvu pravosuđa na tu temu treba se ovaj tjedan održati još jedan sastanak s javnim bilježnicima, na kojemu bi se trebalo razmotriti taj model te vidjeti koliko je provediv.
Neki javni bilježnici s kojima smo razgovarali kažu kako bismo tim mjerama dobili i treći mini moratorij, a problem vide i u tome što bi ovrhovoditelji koji su naplatu svoga duga zatražili u svibnju ove godine, čekali na red do listopada, dok bi oni koji će krajem listopada tek pokretati ovršne postupke, odmah biti u proceduri.
Koliko će točno ovrha biti krajem godine i koliko blokiranih građana, zasad se ne može precizno znati. Tijekom moratorija na ovrhe, koji ukupno traje šest mjeseci, podneseno je 175.000 novih zahtjeva za pokretanjem postupaka. U Vladinom planu zakonodavnih aktivnosti su izmjene Ovršnog zakona.
Potpuno se odustalo od ranijeg koncepta vraćanja ovrha na sudove, uz zadržavanje javnih bilježnika, i pisat će se potpuno novi zakon. No, u provom koraku pristupit će se izmjeni postojećeg, i to kako bi se olakšalo poziciju dužnika. To znači da se ovrhe na stanu neće moći provoditi zimi te kako će biti proširen krug primanja zaštićenih od prisilne naplate.
