Službenik Općine Ližnjan koji je unatrag tri godine dobio otkaz, a koji se potom i žalio na tu odluku, ima razloga za slavlje. Bt će mu isplaćeno 700 tisuća kuna, a, po svemu sudeći, bit će vraćen i na posao, piše Glas Istre.

Naime, presudom Visokog upravnog suda ovih je dana potvrđena zapravo presuda Upravnog suda u Rijeci kojim je poništeno rješenje bivše načelnice Općine Ližnjan Maje Cvek datirano od 11. rujna 2015. godine o, dakle, otkazu ugovora o radu, a istovremeno tom je presudom potvrđena i odluka o obustavi upravnog postupka u kojem je doneseno navedeno rješenje.

Kako je pojašnjeno, budući da se poništavanjem rješenja istovremeno poništavaju i sve pravne posljedice tog rješenja, Općina Ližnjan će morati uspostaviti stanje kakvo je bilo prije donošenja rješenja.

Posljedica je da Općina Ližnjan sad mora otpuštenog službenika vratiti na posao te mu isplatiti i sve troškove, odnosno isplatiti sve neisplaćene plaće, doprinose na plaću, naravno kamate i sve dodatke koji proizlaze iz kolektivnog ugovora za period u kojem nije radio.

Aktualni načelnik Marko Ravnić nije želio komentirati cijeli ovaj slučaj, pa niti gotovu sudsku presudu.

Službenik Općine Ližnjan koji je unatrag tri godine dobio otkaz, a koji se potom i žalio na tu odluku, ima razloga za slavlje. Bt će mu isplaćeno 700 tisuća kuna, a, po svemu sudeći, bit će vraćen i na posao, piše Glas Istre.

Naime, presudom Visokog upravnog suda ovih je dana potvrđena zapravo presuda Upravnog suda u Rijeci kojim je poništeno rješenje bivše načelnice Općine Ližnjan Maje Cvek datirano od 11. rujna 2015. godine o, dakle, otkazu ugovora o radu, a istovremeno tom je presudom potvrđena i odluka o obustavi upravnog postupka u kojem je doneseno navedeno rješenje.

Kako je pojašnjeno, budući da se poništavanjem rješenja istovremeno poništavaju i sve pravne posljedice tog rješenja, Općina Ližnjan će morati uspostaviti stanje kakvo je bilo prije donošenja rješenja.

Posljedica je da Općina Ližnjan sad mora otpuštenog službenika vratiti na posao te mu isplatiti i sve troškove, odnosno isplatiti sve neisplaćene plaće, doprinose na plaću, naravno kamate i sve dodatke koji proizlaze iz kolektivnog ugovora za period u kojem nije radio.

Aktualni načelnik Marko Ravnić nije želio komentirati cijeli ovaj slučaj, pa niti gotovu sudsku presudu.
