Željka Markić, predsjednica udruge “U ime obitelji”, dužna je, po nepravomoćno javno objavljenoj presudi zagrebačkog Općinskog građanskog suda, isplatiti po 10 tisuća kuna, odnosno ukupno 2654 eura naknade štete Miloradu Pupovcu i Samostalnoj demokratskoj srpskoj stranci, kojoj je on na čelu.
Ako presuda postane pravomoćna, Markić će morati isplatiti odštetu i još 1155,73 eura troškova jer je 19. listopada 2020. godine gostovala u emisiji “Bujica” i tada je na pitanje voditelja Velimira Bujanca: “Mislite li da je gnijezdo domaćeg terorizma u SDSS-u?” odgovorila: “Dakle, de facto gospodin Plenković je u koaliciji s ljudima koji odgovaraju opisu onoga što je on nazvao domaćim terorizmom.”
Kako su Pupovac i njegova stranka naveli u tužbi, Markić je, prikazujući ih kao teroriste, apsolutno difamirala, osramotila i moralno diskreditirala kako čelnika i samu stranku tako i druge članove SDSS-a. Praktički ih je, navodi se, okvalificirala kao “kriminalnu organizaciju”, “državnog neprijatelja’’ i nekoga tko predstavlja opasnost za sigurnost RH.

---”Svoju izjavu je dala u emisiji ‘Bujica’, svjesna da većinu gledatelja predmetne emisije čine pretežno pripadnici desnih radikalnih političkih opcija i ideologija, koji neskriveno izražavaju netrpeljivost prema I tužitelju (Pupovcu) te II tužiteljici (SDSS-u) i njenim članovima”, navodi se, uz ostalo, u prihvaćenoj tužbi. U njoj je bilo navedeno i da će odštetu, ako je dobiju, uplatiti u karitativne svrhe.

Sama Željka Markić je, pak, u svojem odgovoru kazala da joj nije jasno zašto je Pupovac tuži jer uopće nije bio predmet razgovora u TV emisiji. Pojasnila je, uz ostalo, da je sedam dana prije njezina gostovanja na TV-u Daniel Bezuk na Markovu trgu vatrenim oružjem napao policajce koji su čuvali zgradu Vlade RH te da je Andrej Plenković, predsjednik Vlade, nedugo nakon napada izjavio kako navedeni napad “... ne samo da je pokušaj teškog ubojstva, nego ima i elemente terorističkog akta...”. Kazala je da je Plenković tada istaknuo tko su, po njegovu mišljenju, huškači koji šire govor mržnje osobito prema njemu.

Stoga je jasno kako se njena izjava odnosi na stranku i njenog predsjednika. To nije vrijednosni sud jer izjava da je netko domaći terorist ne može biti vrijednosni sud budući je to činjenična tvrdnja, kvalifikacija za kazneno djelo terorizma. Tu je tvrdnju moguće jedino dokazati pravomoćnom presudom, a kako ne postoji takva presuda niti za stranku niti za tužitelja kao predsjednika stranke i saborskog zastupnika, takva tvrdnja nije istinita”, obrazloženo je, uz ostalo, u presudi suca Saše Bušića.

Željka Markić, predsjednica udruge “U ime obitelji”, dužna je, po nepravomoćno javno objavljenoj presudi zagrebačkog Općinskog građanskog suda, isplatiti po 10 tisuća kuna, odnosno ukupno 2654 eura naknade štete Miloradu Pupovcu i Samostalnoj demokratskoj srpskoj stranci, kojoj je on na čelu.
Ako presuda postane pravomoćna, Markić će morati isplatiti odštetu i još 1155,73 eura troškova jer je 19. listopada 2020. godine gostovala u emisiji “Bujica” i tada je na pitanje voditelja Velimira Bujanca: “Mislite li da je gnijezdo domaćeg terorizma u SDSS-u?” odgovorila: “Dakle, de facto gospodin Plenković je u koaliciji s ljudima koji odgovaraju opisu onoga što je on nazvao domaćim terorizmom.”
Kako su Pupovac i njegova stranka naveli u tužbi, Markić je, prikazujući ih kao teroriste, apsolutno difamirala, osramotila i moralno diskreditirala kako čelnika i samu stranku tako i druge članove SDSS-a. Praktički ih je, navodi se, okvalificirala kao “kriminalnu organizaciju”, “državnog neprijatelja’’ i nekoga tko predstavlja opasnost za sigurnost RH.

---”Svoju izjavu je dala u emisiji ‘Bujica’, svjesna da većinu gledatelja predmetne emisije čine pretežno pripadnici desnih radikalnih političkih opcija i ideologija, koji neskriveno izražavaju netrpeljivost prema I tužitelju (Pupovcu) te II tužiteljici (SDSS-u) i njenim članovima”, navodi se, uz ostalo, u prihvaćenoj tužbi. U njoj je bilo navedeno i da će odštetu, ako je dobiju, uplatiti u karitativne svrhe.

Sama Željka Markić je, pak, u svojem odgovoru kazala da joj nije jasno zašto je Pupovac tuži jer uopće nije bio predmet razgovora u TV emisiji. Pojasnila je, uz ostalo, da je sedam dana prije njezina gostovanja na TV-u Daniel Bezuk na Markovu trgu vatrenim oružjem napao policajce koji su čuvali zgradu Vlade RH te da je Andrej Plenković, predsjednik Vlade, nedugo nakon napada izjavio kako navedeni napad “... ne samo da je pokušaj teškog ubojstva, nego ima i elemente terorističkog akta...”. Kazala je da je Plenković tada istaknuo tko su, po njegovu mišljenju, huškači koji šire govor mržnje osobito prema njemu.
”Iskaz tužene kako se navedena izjava odnosi isključivo na gospodina Stanimirovića nije točna jer je tužena, na odgovor da li smatra da je SDSS gnijezdo domaćeg terorizma, iskazala da je defacto gospodin Plenković u koaliciji s ljudima koji odgovaraju opisom onoga što je on nazvao domaćim terorizmom.

Stoga je jasno kako se njena izjava odnosi na stranku i njenog predsjednika. To nije vrijednosni sud jer izjava da je netko domaći terorist ne može biti vrijednosni sud budući je to činjenična tvrdnja, kvalifikacija za kazneno djelo terorizma. Tu je tvrdnju moguće jedino dokazati pravomoćnom presudom, a kako ne postoji takva presuda niti za stranku niti za tužitelja kao predsjednika stranke i saborskog zastupnika, takva tvrdnja nije istinita”, obrazloženo je, uz ostalo, u presudi suca Saše Bušića.
