Hrvatski liječnički sindikat (HLS) trenutno se organizacijski priprema za četvrti štrajk liječnika u novijoj hrvatskoj povijesti, nakon što su prethodna tri prekinuta sudskim zabranama ili uvođenjem radne obaveze zbog ugroženosti pružanja zdravstvene zaštite stanovništvu. 

Uvođenjem radne obaveza prekinuti su veliki štrajkovi liječnika 2003. i 2013. pokrenuti zbog nezadovoljstva visinom plaća, dok je sudski zabranjen trodnevni štrajk 2005. godine. kojim se tražila isplata dodataka na temelju kolektivnog ugovora.

Sva tri štrajka organizacijski je vodio bivši predsjednik HLS-a Ivica Babić, a sada se priprema prvi štrajk koji će voditi Renata Čulinović Čaić koja je vodstvo sindikata preuzela 2017. 

2003: Radna obveza

Prvi veliki štrajk održan je 2003. u mandatu koalicijske vlade Ivice Račana i resornog ministra Andre Vlahušića. Trajao je gotovo mjesec dana, a HLS je želio natjerati Vladu da plaće liječnika poveća na dvije prosječne hrvatske plaće, a plaće specijalista na dvije i pol prosječne plaće.

Taj je dugi štrajk iscrpio liječnike, pacijente pa i građane koji su u početku podržavali sindikalce, dajući im potporu od 49 posto, ali nakon nekoliko tjedana ta je podrška pala na svega 29 posto.

Zahtjev HLS-a nije prihvaćen uz obrazloženje da državni proračun za to nema novca. Umjesto toga, dobili su dodatke na plaću od 5 do 20 posto, ovisno o uvjetima rada, a Vlada je liječnicima uvela radnu obavezu zbog ugroženosti Ustavom zajamčenog prava građana na zdravstvenu zaštitu.

2005: Sudska zabrana

Drugi štrajk, za mandata premijera Ive Sanadera i ministra Nevena Ljubičića, bio je 2005. i trajao je samo tri dana, nakon čega ga je zabranio Županijski sud u Zagrebu.

HLS je tada pozvao 8000 liječnika i stomatologa u državnim bolnicama u štrajk zbog neprimjene tada potpisanog Strukovnog kolektivnog ugovora (SKU) kojim im je bio zajamčen dodatak od 10 posto godišnje na liječničku odgovornost i druga materijalna i strukovna prava.

Vlada je odbila primijeniti SKU uz ocjenu da je nezakonito donesen, ali je donijela uredbu kojom je liječnicima odobrila dodatak od deset posto, čime su im plaće porasle između 500 i 850 kuna.

2013: Radna obveza

Treći štrajk, 2013. u mandatu Rajka Ostojića, najdulje je trajao - 58 dana, tijekom kojih su se u bolnicama obavljali samo hitni zahvati. HLS je pozvao pacijente da ne dolaze u bolnicu ako nisu hitni slučajevi.

Zbog štrajka u nekim su bolnicama produžene liste čekanja dva do tri puta, a zbog ugroženosti prava građana na zdravstvenu zaštitu prekinut je 14. studenog odlukom vlade Zorana Milanovića o uvođenju radne obveze, koju je kasnije, temeljem tužbe sindikata, poništio Ustavni sud.

U prosincu 2013. potpisan je granski kolektivni ugovor za zdravstvo bez HLS-a. Babić ga je odbio potpisati jer su mu bila sporna dva članka koja se odnose na dežurstva i pripravnost.

Stupanjem na snagu tog ugovora počeli su i problemi s obračunom isplate prekovremenih sati i dodataka na plaću, a 2014. liječnički je sindikat izbačen iz kolektivnog pregovaranja po Zakonu o reprezentativnosti zbog nedostatnog broja članova.

Reprezentativnost mu je vraćena zakonskim izmjenama u listopadu prošle godine.

2023: Kako izbjeći isti scenarij?

Aktualna predsjednica HLS-a Renata Čulinović Čaić poručuje da će i ovaj put, u slučaju pokretanja štrajka - hitni i onkološki pacijenti, kao i djeca biti zbrinuti, no "hladni pogon" mogao bi ostati na čekanju. 

Hoće li do štrajka doista doći odlučit će izvanredna skupština sindikata krajem tjedna. To bi bio i prvi štrajk u kojemu će se bolničkim liječnicima pridružiti primarna zdravstvena zaštita.

Liječnici ovaj put traže usklađivanje platnih koeficijenata, donošenje zakona o svom radno-pravnom statusu, donošenje vremensko-kadrovskih normativa i ukidanje "robovlasničkih" ugovora za specijalizante. 

Sindikat mora pronaći dobro zakonsko utemeljenje za štrajk, jer ga u protivnom može zabraniti sud ako ocijeni da je štrajk nezakonit. Eventualno uvođenje radne obaveze, s obzirom na izmjene zakona o zdravstvenoj zaštiti i europske direktive, bilo bi pravno jako upitno. I u tumačenju odluke Ustavnog suda, kojom je poništeno uvođenje radne obaveze 2013., stoji da je Milanovićeva vlada tada posegnula za  političkom odlukom u kojoj se pozvala na nevažeći tekst Zakona o zdravstvenoj zaštiti.

Hrvatski liječnički sindikat (HLS) trenutno se organizacijski priprema za četvrti štrajk liječnika u novijoj hrvatskoj povijesti, nakon što su prethodna tri prekinuta sudskim zabranama ili uvođenjem radne obaveze zbog ugroženosti pružanja zdravstvene zaštite stanovništvu. 

Uvođenjem radne obaveza prekinuti su veliki štrajkovi liječnika 2003. i 2013. pokrenuti zbog nezadovoljstva visinom plaća, dok je sudski zabranjen trodnevni štrajk 2005. godine. kojim se tražila isplata dodataka na temelju kolektivnog ugovora.

Sva tri štrajka organizacijski je vodio bivši predsjednik HLS-a Ivica Babić, a sada se priprema prvi štrajk koji će voditi Renata Čulinović Čaić koja je vodstvo sindikata preuzela 2017. 

2003: Radna obveza

Prvi veliki štrajk održan je 2003. u mandatu koalicijske vlade Ivice Račana i resornog ministra Andre Vlahušića. Trajao je gotovo mjesec dana, a HLS je želio natjerati Vladu da plaće liječnika poveća na dvije prosječne hrvatske plaće, a plaće specijalista na dvije i pol prosječne plaće.

Taj je dugi štrajk iscrpio liječnike, pacijente pa i građane koji su u početku podržavali sindikalce, dajući im potporu od 49 posto, ali nakon nekoliko tjedana ta je podrška pala na svega 29 posto.

Zahtjev HLS-a nije prihvaćen uz obrazloženje da državni proračun za to nema novca. Umjesto toga, dobili su dodatke na plaću od 5 do 20 posto, ovisno o uvjetima rada, a Vlada je liječnicima uvela radnu obavezu zbog ugroženosti Ustavom zajamčenog prava građana na zdravstvenu zaštitu.

2005: Sudska zabrana

Drugi štrajk, za mandata premijera Ive Sanadera i ministra Nevena Ljubičića, bio je 2005. i trajao je samo tri dana, nakon čega ga je zabranio Županijski sud u Zagrebu.

HLS je tada pozvao 8000 liječnika i stomatologa u državnim bolnicama u štrajk zbog neprimjene tada potpisanog Strukovnog kolektivnog ugovora (SKU) kojim im je bio zajamčen dodatak od 10 posto godišnje na liječničku odgovornost i druga materijalna i strukovna prava.

Vlada je odbila primijeniti SKU uz ocjenu da je nezakonito donesen, ali je donijela uredbu kojom je liječnicima odobrila dodatak od deset posto, čime su im plaće porasle između 500 i 850 kuna.

2013: Radna obveza

Treći štrajk, 2013. u mandatu Rajka Ostojića, najdulje je trajao - 58 dana, tijekom kojih su se u bolnicama obavljali samo hitni zahvati. HLS je pozvao pacijente da ne dolaze u bolnicu ako nisu hitni slučajevi.

Zbog štrajka u nekim su bolnicama produžene liste čekanja dva do tri puta, a zbog ugroženosti prava građana na zdravstvenu zaštitu prekinut je 14. studenog odlukom vlade Zorana Milanovića o uvođenju radne obveze, koju je kasnije, temeljem tužbe sindikata, poništio Ustavni sud.

U prosincu 2013. potpisan je granski kolektivni ugovor za zdravstvo bez HLS-a. Babić ga je odbio potpisati jer su mu bila sporna dva članka koja se odnose na dežurstva i pripravnost.

Stupanjem na snagu tog ugovora počeli su i problemi s obračunom isplate prekovremenih sati i dodataka na plaću, a 2014. liječnički je sindikat izbačen iz kolektivnog pregovaranja po Zakonu o reprezentativnosti zbog nedostatnog broja članova.

Reprezentativnost mu je vraćena zakonskim izmjenama u listopadu prošle godine.

2023: Kako izbjeći isti scenarij?

Aktualna predsjednica HLS-a Renata Čulinović Čaić poručuje da će i ovaj put, u slučaju pokretanja štrajka - hitni i onkološki pacijenti, kao i djeca biti zbrinuti, no "hladni pogon" mogao bi ostati na čekanju. 

Hoće li do štrajka doista doći odlučit će izvanredna skupština sindikata krajem tjedna. To bi bio i prvi štrajk u kojemu će se bolničkim liječnicima pridružiti primarna zdravstvena zaštita.

Liječnici ovaj put traže usklađivanje platnih koeficijenata, donošenje zakona o svom radno-pravnom statusu, donošenje vremensko-kadrovskih normativa i ukidanje "robovlasničkih" ugovora za specijalizante. 

Sindikat mora pronaći dobro zakonsko utemeljenje za štrajk, jer ga u protivnom može zabraniti sud ako ocijeni da je štrajk nezakonit. Eventualno uvođenje radne obaveze, s obzirom na izmjene zakona o zdravstvenoj zaštiti i europske direktive, bilo bi pravno jako upitno. I u tumačenju odluke Ustavnog suda, kojom je poništeno uvođenje radne obaveze 2013., stoji da je Milanovićeva vlada tada posegnula za  političkom odlukom u kojoj se pozvala na nevažeći tekst Zakona o zdravstvenoj zaštiti.

Hrvatski liječnički sindikat (HLS) trenutno se organizacijski priprema za četvrti štrajk liječnika u novijoj hrvatskoj povijesti, nakon što su prethodna tri prekinuta sudskim zabranama ili uvođenjem radne obaveze zbog ugroženosti pružanja zdravstvene zaštite stanovništvu. 

Uvođenjem radne obaveza prekinuti su veliki štrajkovi liječnika 2003. i 2013. pokrenuti zbog nezadovoljstva visinom plaća, dok je sudski zabranjen trodnevni štrajk 2005. godine. kojim se tražila isplata dodataka na temelju kolektivnog ugovora.
