Sud u Strasbourgu je presudio da je Hrvatska prekršila ljudska prava osuđeniku za sudjelovanje u ubojstvu Ive Pukanića, Amiru Mafalaniju, jer su parnični troškovi koje je odlukom hrvatskog suda morao platiti državi bili veći od naknade koju je dobio zbog ozljeda u prijevozu policijskim kombijem.

Mafalani je u tužbi potraživao ukupno 18.000 kuna (2389 eura), tj. 5000 kuna za strah, 3000 kuna za tjelesne boli i 10.000 kuna za povredu dostojanstva. Tijekom postupka smanjio je tužbeni zahtjev na ukupno 7500 kuna (995 eura) od čega 500 kuna za strah, 1000 kuna za fizičku bol i 6000 kuna za povredu dostojanstva, izvijestio je ured hrvatske predstavnice pred Europskim sudom za ljudska prava (ESLJP).

Općinski građanski sud u Zagrebu je djelomično prihvatio podnositeljev zahtjev u visini od 1220 kuna (162 eura), a odbio u preostalom dijelu od 6280 kuna (833 eura) koji se najvećim dijelom odnosio na navodnu povredu njegova dostojanstva.

Prvostupanjski sud je smatrao da je podnositelj zahtjeva uspio sa 16,27 posto svog zahtjeva, a država sa 83,73 posto te je sukladno tome izvršio prijeboj međusobnih troškova i naložio podnositelju da državi plati 881,71 kuna (117 eura) parničnih troškova.

Presuda je postala pravomoćna, a država je zatim podnositelju isplatila ukupno 676,19 kuna (90 eura) u vidu glavnice za naknadu štete i obračunatih kamata.

Sukladno ranijoj praksi sud je ponovio da u situacijama djelomičnog uspjeha u sporu, visoki troškovi postupka mogu „pojesti“ veliki dio ili cijelu novčanu naknadu, a ako ne postoje važni razlozi koji bi opravdali takav rezultat, takva situacija čini parnicu bespredmetnom i čini pravo te stranke na sud tek teoretskim i iluzornim.

U konkretnom slučaju troškovi koje je podnositelj morao platiti državi iznosili su 72 posto dosuđene naknade, a odbijanjem njegovih vlastitih troškova "izgubio" je cijelu dosuđenu naknadu za prouzročenu štetu. Nadalje, sud nije smatrao otegotnim po podnositelja to što je isprva postavio viši tužbeni zahtjev u odnosu na konačno postavljeni tijekom postupka, budući da je visinu nematerijalne štete, samu po sebi, teško procijeniti, navode u priopćenju.

Također, sud nije našao otegotnim ni okolnost što nije uspio sa osnovom tužbe za povredu prava osobnosti zato što je u svakom slučaju podnositelj uspio dokazati postojanje protupravnosti i uzročnu vezu sa pretrpljenom štetom.

Sud u Strasbourgu je utvrdio da su Mafalaniju povrijeđena prava zajamčena Konvencijom o zaštiti ljudskih prava i temeljnih sloboda te pripadajućim prvim protoklom te mu je dosudio iznos od 117 eura za materijalnu štetu, 2500 eura za nematerijalnu štetu i 3200 eura za troškove i izdatke.

Sud u Strasbourgu je presudio da je Hrvatska prekršila ljudska prava osuđeniku za sudjelovanje u ubojstvu Ive Pukanića, Amiru Mafalaniju, jer su parnični troškovi koje je odlukom hrvatskog suda morao platiti državi bili veći od naknade koju je dobio zbog ozljeda u prijevozu policijskim kombijem.

Mafalani je u tužbi potraživao ukupno 18.000 kuna (2389 eura), tj. 5000 kuna za strah, 3000 kuna za tjelesne boli i 10.000 kuna za povredu dostojanstva. Tijekom postupka smanjio je tužbeni zahtjev na ukupno 7500 kuna (995 eura) od čega 500 kuna za strah, 1000 kuna za fizičku bol i 6000 kuna za povredu dostojanstva, izvijestio je ured hrvatske predstavnice pred Europskim sudom za ljudska prava (ESLJP).

Općinski građanski sud u Zagrebu je djelomično prihvatio podnositeljev zahtjev u visini od 1220 kuna (162 eura), a odbio u preostalom dijelu od 6280 kuna (833 eura) koji se najvećim dijelom odnosio na navodnu povredu njegova dostojanstva.

Prvostupanjski sud je smatrao da je podnositelj zahtjeva uspio sa 16,27 posto svog zahtjeva, a država sa 83,73 posto te je sukladno tome izvršio prijeboj međusobnih troškova i naložio podnositelju da državi plati 881,71 kuna (117 eura) parničnih troškova.

Presuda je postala pravomoćna, a država je zatim podnositelju isplatila ukupno 676,19 kuna (90 eura) u vidu glavnice za naknadu štete i obračunatih kamata.

Sukladno ranijoj praksi sud je ponovio da u situacijama djelomičnog uspjeha u sporu, visoki troškovi postupka mogu „pojesti“ veliki dio ili cijelu novčanu naknadu, a ako ne postoje važni razlozi koji bi opravdali takav rezultat, takva situacija čini parnicu bespredmetnom i čini pravo te stranke na sud tek teoretskim i iluzornim.

U konkretnom slučaju troškovi koje je podnositelj morao platiti državi iznosili su 72 posto dosuđene naknade, a odbijanjem njegovih vlastitih troškova "izgubio" je cijelu dosuđenu naknadu za prouzročenu štetu. Nadalje, sud nije smatrao otegotnim po podnositelja to što je isprva postavio viši tužbeni zahtjev u odnosu na konačno postavljeni tijekom postupka, budući da je visinu nematerijalne štete, samu po sebi, teško procijeniti, navode u priopćenju.

Također, sud nije našao otegotnim ni okolnost što nije uspio sa osnovom tužbe za povredu prava osobnosti zato što je u svakom slučaju podnositelj uspio dokazati postojanje protupravnosti i uzročnu vezu sa pretrpljenom štetom.

Sud u Strasbourgu je utvrdio da su Mafalaniju povrijeđena prava zajamčena Konvencijom o zaštiti ljudskih prava i temeljnih sloboda te pripadajućim prvim protoklom te mu je dosudio iznos od 117 eura za materijalnu štetu, 2500 eura za nematerijalnu štetu i 3200 eura za troškove i izdatke.

Hrvatska izgubila na sudu u Strasbourgu: ‘Osuđenom za ubojstvo Ive Pukanića prekršena su ljudska prava‘

Sud u Strasbourgu je presudio da je Hrvatska prekršila ljudska prava osuđeniku za sudjelovanje u ubojstvu Ive Pukanića, Amiru Mafalaniju, jer su parnični troškovi koje je odlukom hrvatskog suda morao platiti državi bili veći od naknade koju je dobio zbog ozljeda u prijevozu policijskim kombijem.

Mafalani je u tužbi potraživao ukupno 18.000 kuna (2389 eura), tj. 5000 kuna za strah, 3000 kuna za tjelesne boli i 10.000 kuna za povredu dostojanstva. Tijekom postupka smanjio je tužbeni zahtjev na ukupno 7500 kuna (995 eura) od čega 500 kuna za strah, 1000 kuna za fizičku bol i 6000 kuna za povredu dostojanstva, izvijestio je ured hrvatske predstavnice pred Europskim sudom za ljudska prava (ESLJP).

Općinski građanski sud u Zagrebu je djelomično prihvatio podnositeljev zahtjev u visini od 1220 kuna (162 eura), a odbio u preostalom dijelu od 6280 kuna (833 eura) koji se najvećim dijelom odnosio na navodnu povredu njegova dostojanstva.

Prvostupanjski sud je smatrao da je podnositelj zahtjeva uspio sa 16,27 posto svog zahtjeva, a država sa 83,73 posto te je sukladno tome izvršio prijeboj međusobnih troškova i naložio podnositelju da državi plati 881,71 kuna (117 eura) parničnih troškova.

Presuda je postala pravomoćna, a država je zatim podnositelju isplatila ukupno 676,19 kuna (90 eura) u vidu glavnice za naknadu štete i obračunatih kamata.
