Uhićenja u Osijeku svakako su obilježila ovaj utorak, a njih je u Dnevniku HRT-a komentirao odvjetnik i bivši sudac Damir Primorac koji je objasnio koja su saznanja potrebna Uskoku kako bi mogao privesti suce kao što se ranije dogodilo.

- Kao što smo čuli sucima je tijekom jučerašnjeg dana skinut imunitet. imunitet se odnosio na mogućnost vođenja kaznenog postupka i određivanja istražnog zatvora. Sada Uskok ima slobodne ruke da poduzima radnje koje su propisane Zakonom o kaznenom postupku. To znači da u roku 24 sata trebaju biti dovedeni pritvorskom nadzorniku kao što većina već jeste, a u roku od 16 sati od dovođenja pritvorskom nadzorniku moraju biti ispitani od strane Uskoka. Hoće li nakon toga biti doneseno rješenje o pokretanju istrage ili ne o tome odlučuje Uskok. Jednako tako treba vidjeti hoće li ići nakon toga s prijedlogom za određivanje istražnog zatvora- kazao je Primorac koji je istaknuo kako se ne slaže s ranijom izjavom Ljube Pavasovića Viskovića.

Spomenuti odvjetnik gostovao je u emisiji RTL Danas gdje je bio u ulozi odvjetnika jednog od uhićenih sudaca. 

- Cijela priča se radi jer je Mamićev cilj srušiti presudu na Ustavnom sudu. Nigdje se ne stavlja Krušlinu na teret da je od Mamića ili njegovog prijatelja primio novac. Sklizak je ovo teren za USKOK, pitanje je hoće li dokazati išta. Zdravko Mamić je nespretno sebe doveo u situaciju da bude izručen. USKOK ovo radi jer je prepoznao enormno veliki, dragocjeni pokajnički potencijal kod Mamića. Oni ga žele ovdje”, kazao je Pavasović Visković. 

Bivši sudac Primorac s tom se idejom ne slaže. 

- Ja na to gledam iz jedne druge perspektive - Uskok je došao do određenih saznanja, proveo je određene izvide, istraživanja, donio je zaključak da postoji osnovana sumnja da je počinjeno kazneno djelo, poduzeo je odgovarajuće radnje i sad treba vidjeti kako će se ovaj postupak zapravo dalje odvijati. Ali ono što je zanimljivo i ono što je kolega Pavasović rekao je da su djela počinjena 2016., 2017. godine. 2012. je potpisan ugovor BiH i RH o izručenju vlastitih državljana i sada se postavlja pitanje, obzirom da se taj ugovor primjenjuje od datuma potpisivanja, hoće li RH ako se donese rješenje o provođenju istrage zatražiti izručenje g. Mamića ili ne, budući da su ispunjeni uvjeti za njegovo izručenje prema tom Ugovoru. Ako se to i dogodi, odluku o izručenju će donijeti nadležni sud u BiH, odnosno tamošnji ministar pravde- objasnio je Primorac. 

Postavljeno mu je i pitanje o tome može li Hrvatska zatražiti izručenje Mamića.

- Ugovor je potpisan, u ugovoru nigdje ne stoji da mora doći do izručenja. U ugovoru je navedeno da može doći do izručenja i tu će, ako dođe do molbe za izručenje, odluka biti na tijelima te u konačnici na ministru pravde BiH. Ministar pravde može odlučiti i protiv izručenja i nakon što sudbena tijela donesu odluku o izručenju, ako utvrdi razloge protiv izručenja. To je pitanje koje će biti zanimljivo pratiti, ustvrdio je.

Osvrnuo se i na učestalost pokušaja potkupljivanja sudaca, a progovorio je i o svom iskustvu. 

- Moram priznati da od 1996 do 2008. kada sam radio kao sudac na Općinskom i Županijskom sudu u Splitu nikada nisam bio u iskušenju niti mi je itko ponudio mito i čvrsto vjerujem da je to slučaj i s najvećim brojem sudaca. Međutim, kada se dogode ovakva uhićenja, kao što je to uhićenje trojice sudaca Županijskog suda u Osijeku, moram priznati da je to nešto jako loše, nešto strašno, vrlo loša poruka svim građanima RH. Tu će mrlju biti jako teško očistiti. Međutim, većina sudaca, u to sam čvrsto uvjeren, časno i čestito obnaša svoj posao i ja sam siguran da ta većina želi da se u ovakvim i sličnim situacijama utvrdi istina i da se takvi suci udalje iz sustava- zaključio je Primorac.

Uhićenja u Osijeku svakako su obilježila ovaj utorak, a njih je u Dnevniku HRT-a komentirao odvjetnik i bivši sudac Damir Primorac koji je objasnio koja su saznanja potrebna Uskoku kako bi mogao privesti suce kao što se ranije dogodilo.

- Kao što smo čuli sucima je tijekom jučerašnjeg dana skinut imunitet. imunitet se odnosio na mogućnost vođenja kaznenog postupka i određivanja istražnog zatvora. Sada Uskok ima slobodne ruke da poduzima radnje koje su propisane Zakonom o kaznenom postupku. To znači da u roku 24 sata trebaju biti dovedeni pritvorskom nadzorniku kao što većina već jeste, a u roku od 16 sati od dovođenja pritvorskom nadzorniku moraju biti ispitani od strane Uskoka. Hoće li nakon toga biti doneseno rješenje o pokretanju istrage ili ne o tome odlučuje Uskok. Jednako tako treba vidjeti hoće li ići nakon toga s prijedlogom za određivanje istražnog zatvora- kazao je Primorac koji je istaknuo kako se ne slaže s ranijom izjavom Ljube Pavasovića Viskovića.

Spomenuti odvjetnik gostovao je u emisiji RTL Danas gdje je bio u ulozi odvjetnika jednog od uhićenih sudaca. 

- Cijela priča se radi jer je Mamićev cilj srušiti presudu na Ustavnom sudu. Nigdje se ne stavlja Krušlinu na teret da je od Mamića ili njegovog prijatelja primio novac. Sklizak je ovo teren za USKOK, pitanje je hoće li dokazati išta. Zdravko Mamić je nespretno sebe doveo u situaciju da bude izručen. USKOK ovo radi jer je prepoznao enormno veliki, dragocjeni pokajnički potencijal kod Mamića. Oni ga žele ovdje”, kazao je Pavasović Visković. 

Bivši sudac Primorac s tom se idejom ne slaže. 

- Ja na to gledam iz jedne druge perspektive - Uskok je došao do određenih saznanja, proveo je određene izvide, istraživanja, donio je zaključak da postoji osnovana sumnja da je počinjeno kazneno djelo, poduzeo je odgovarajuće radnje i sad treba vidjeti kako će se ovaj postupak zapravo dalje odvijati. Ali ono što je zanimljivo i ono što je kolega Pavasović rekao je da su djela počinjena 2016., 2017. godine. 2012. je potpisan ugovor BiH i RH o izručenju vlastitih državljana i sada se postavlja pitanje, obzirom da se taj ugovor primjenjuje od datuma potpisivanja, hoće li RH ako se donese rješenje o provođenju istrage zatražiti izručenje g. Mamića ili ne, budući da su ispunjeni uvjeti za njegovo izručenje prema tom Ugovoru. Ako se to i dogodi, odluku o izručenju će donijeti nadležni sud u BiH, odnosno tamošnji ministar pravde- objasnio je Primorac. 

Postavljeno mu je i pitanje o tome može li Hrvatska zatražiti izručenje Mamića.

- Ugovor je potpisan, u ugovoru nigdje ne stoji da mora doći do izručenja. U ugovoru je navedeno da može doći do izručenja i tu će, ako dođe do molbe za izručenje, odluka biti na tijelima te u konačnici na ministru pravde BiH. Ministar pravde može odlučiti i protiv izručenja i nakon što sudbena tijela donesu odluku o izručenju, ako utvrdi razloge protiv izručenja. To je pitanje koje će biti zanimljivo pratiti, ustvrdio je.

Osvrnuo se i na učestalost pokušaja potkupljivanja sudaca, a progovorio je i o svom iskustvu. 

- Moram priznati da od 1996 do 2008. kada sam radio kao sudac na Općinskom i Županijskom sudu u Splitu nikada nisam bio u iskušenju niti mi je itko ponudio mito i čvrsto vjerujem da je to slučaj i s najvećim brojem sudaca. Međutim, kada se dogode ovakva uhićenja, kao što je to uhićenje trojice sudaca Županijskog suda u Osijeku, moram priznati da je to nešto jako loše, nešto strašno, vrlo loša poruka svim građanima RH. Tu će mrlju biti jako teško očistiti. Međutim, većina sudaca, u to sam čvrsto uvjeren, časno i čestito obnaša svoj posao i ja sam siguran da ta većina želi da se u ovakvim i sličnim situacijama utvrdi istina i da se takvi suci udalje iz sustava- zaključio je Primorac.

Uhićenja u Osijeku svakako su obilježila ovaj utorak, a njih je u Dnevniku HRT-a komentirao odvjetnik i bivši sudac Damir Primorac koji je objasnio koja su saznanja potrebna Uskoku kako bi mogao privesti suce kao što se ranije dogodilo.

- Kao što smo čuli sucima je tijekom jučerašnjeg dana skinut imunitet. imunitet se odnosio na mogućnost vođenja kaznenog postupka i određivanja istražnog zatvora. Sada Uskok ima slobodne ruke da poduzima radnje koje su propisane Zakonom o kaznenom postupku. To znači da u roku 24 sata trebaju biti dovedeni pritvorskom nadzorniku kao što većina već jeste, a u roku od 16 sati od dovođenja pritvorskom nadzorniku moraju biti ispitani od strane Uskoka. Hoće li nakon toga biti doneseno rješenje o pokretanju istrage ili ne o tome odlučuje...
