Ustavni sud je zaključio da bivšem premijeru i predsjedniku HDZ-a Ivi Sanaderu nisu povrijeđena prava kada mu je nakon nepravomoćne presude u slučaju Ina-MOL određen istražni zatvor, iako se već nalazio iza rešetaka po pravomoćnoj presudi u slučaju Planinska.

Takvu odluku Ustavni sud je donio odbacivši Sanaderovu ustavnu tužbu kojom se žalio na istražni zatvor koji mu je određen kada je krajem 2019. u ponovljenom suđenju osuđen zbog primanja mita od hrvatskom pravosuđu nedostupnog čelnika MOL-a Zsolta Hernadija.

Uz šest godina zatvora dosuđen mu je i tzv. obligatorni istražni zatvor koji se određuje uz nepravomoćne presude dulje od pet godina.

Sanader se na tu odluku najprije žalio Vrhovnom sudu koji je zaključio da mu istražni zatvor u slučaju Ina-MOL počinje teći nakon izvršenja šestogodišnje kazne u slučaju Planinska.

"Pri tome iz obrazloženja osporenih rješenja jasno proizlazi o izdržavanju koje kazne je riječ pa navedeno za podnositelja ne stvara stanje pravne nesigurnosti i pravne neizvjesnosti", ustvrdio je Ustavni sud.

Stoga je neutemeljenim ocijenio Sanaderove tvrdnje da je određivanje istražnog zatvora protiv njega bespredmetno te da je izraz "ekscesivnog formalizma suprotnog Ustavu".

Neutemeljenim je Ustavni sud cijenio i Sanaderove navode "kojima ponavlja žalbene prigovore navodeći da su u konkretnom predmetu istekli propisani maksimalni rokovi trajanja istražnog zatvora te da se stoga protiv njega više ne može odrediti istražni zatvor", stoji u odluci Ustavnog suda.

Sanader, koji od travnja prošle godine izdržava zatvorsku kaznu zbog slučaja Planinska, u prosincu 2019. je nepravomoćno osuđen zbog 10 milijuna eura mita primljenog od mađarskog MOL-a prilikom preuzimanja Ine, a 2018. i za profitersku proviziju od austrijske Hypo banke. Nepravomoćno je oslobođen optužbi za prodaju jeftinije HEP-ove struje tvrtki Dioki.

Na zagrebačkom Županijskom sudu pri kraju je i ponovljeno suđenje u slučaju Fimi media u kojem je ranije nepravomoćno osuđen na devet godina zatvora, a zbog izvlačenja novca iz državnih institucija i tvrtki s pet milijuna kuna kažnjena je i njegova bivša stranka HDZ. Nepravomoćnu presudu u tom slučaju iz 2013. Vrhovni sud je ukinuo 2015. godine.

Ustavni sud je zaključio da bivšem premijeru i predsjedniku HDZ-a Ivi Sanaderu nisu povrijeđena prava kada mu je nakon nepravomoćne presude u slučaju Ina-MOL određen istražni zatvor, iako se već nalazio iza rešetaka po pravomoćnoj presudi u slučaju Planinska.

Takvu odluku Ustavni sud je donio odbacivši Sanaderovu ustavnu tužbu kojom se žalio na istražni zatvor koji mu je određen kada je krajem 2019. u ponovljenom suđenju osuđen zbog primanja mita od hrvatskom pravosuđu nedostupnog čelnika MOL-a Zsolta Hernadija.

Uz šest godina zatvora dosuđen mu je i tzv. obligatorni istražni zatvor koji se određuje uz nepravomoćne presude dulje od pet godina.

Sanader se na tu odluku najprije žalio Vrhovnom sudu koji je zaključio da mu istražni zatvor u slučaju Ina-MOL počinje teći nakon izvršenja šestogodišnje kazne u slučaju Planinska.

"Pri tome iz obrazloženja osporenih rješenja jasno proizlazi o izdržavanju koje kazne je riječ pa navedeno za podnositelja ne stvara stanje pravne nesigurnosti i pravne neizvjesnosti", ustvrdio je Ustavni sud.

Stoga je neutemeljenim ocijenio Sanaderove tvrdnje da je određivanje istražnog zatvora protiv njega bespredmetno te da je izraz "ekscesivnog formalizma suprotnog Ustavu".

Neutemeljenim je Ustavni sud cijenio i Sanaderove navode "kojima ponavlja žalbene prigovore navodeći da su u konkretnom predmetu istekli propisani maksimalni rokovi trajanja istražnog zatvora te da se stoga protiv njega više ne može odrediti istražni zatvor", stoji u odluci Ustavnog suda.

Sanader, koji od travnja prošle godine izdržava zatvorsku kaznu zbog slučaja Planinska, u prosincu 2019. je nepravomoćno osuđen zbog 10 milijuna eura mita primljenog od mađarskog MOL-a prilikom preuzimanja Ine, a 2018. i za profitersku proviziju od austrijske Hypo banke. Nepravomoćno je oslobođen optužbi za prodaju jeftinije HEP-ove struje tvrtki Dioki.

Na zagrebačkom Županijskom sudu pri kraju je i ponovljeno suđenje u slučaju Fimi media u kojem je ranije nepravomoćno osuđen na devet godina zatvora, a zbog izvlačenja novca iz državnih institucija i tvrtki s pet milijuna kuna kažnjena je i njegova bivša stranka HDZ. Nepravomoćnu presudu u tom slučaju iz 2013. Vrhovni sud je ukinuo 2015. godine.

Ustavni sud: Sanaderu nisu prekršena prava istražnim zatvorom u slučaju Ina-MOL

Ustavni sud je zaključio da bivšem premijeru i predsjedniku HDZ-a Ivi Sanaderu nisu povrijeđena prava kada mu je nakon nepravomoćne presude u slučaju Ina-MOL određen istražni zatvor, iako se već nalazio iza rešetaka po pravomoćnoj presudi u slučaju Planinska.

Takvu odluku Ustavni sud je donio odbacivši Sanaderovu ustavnu tužbu kojom se žalio na istražni zatvor koji mu je određen kada je krajem 2019. u ponovljenom suđenju osuđen zbog primanja mita od hrvatskom pravosuđu nedostupnog čelnika MOL-a Zsolta Hernadija.

Uz šest godina zatvora dosuđen mu je i tzv. obligatorni istražni zatvor koji se određuje uz nepravomoćne presude dulje od pet godina.

Sanader se na tu odluku najprije žalio Vrhovnom sudu koji je zaključio da mu istražni zatvor u slučaju Ina-MOL počinje teći...
