Profesoru dr. sc. Hrvoju Kačeru, pročelniku Katedre za građansko pravo splitskoga Pravnog fakulteta, na šibenskom Županijskom sudu je po treći put izrečena presuda za zloporabu položaja i ovlasti i krivotvorenje isprave.

Redoviti profesor Pravnog fakulteta, kojeg mnogi studenti prava nose zauvijek u svojim mislima, ovaj je put oslobođen optužbi za zlouporabu položaja i ovlasti i krivotvorenje. No, da ne bi ispalo da je prošao potpuno "lišo", osuđen je nepravomoćno na tri mjeseca zatvora s rokom kušnje od godinu dana zbog poticanja Ante Kragića, danas pokojnog bivšeg direktora Teniskog kluba "Split", na falsificiranje pet putnih naloga. Uz Kačera okrivljeni su bili već spomenuti Kragić te teniski trener Željko Stanić, koji je sad oslobođen krivnje.

Bitne povrede

Sva su trojica prvi put bili osuđena 2011. godine. Kačer je tada dobio godinu i pol bezuvjetnog zatvora zbog zloporabe položaja i ovlasti i krivotvorenja isprave, no ta je presuda ukinuta zbog bitne povrede Kaznenog zakona i dopune činjeničnog stanja. Drugi put je ista šibenska sutkinja, Jadranka Biga Milutin, u studenome 2013. godine, opet osudila Kačera na identičnu zatvorsku kaznu, dok je Stanić, kao i prvi put, kažnjen s uvjetnom kaznom od šest mjeseci s rokom kušnje od dvije godine, i to za pomaganje. I ta je presuda bila ukinuta, no treći put nije im sudila sutkinja Biga Milutin.

Kačera i Stanića se, zajedno s pokojnim Kragićem, teretilo da su od 1998. do 2003. godine zajednički i u dogovoru, na traženje i u korist Hrvoja Kačera, ispisivali fiktivne putne naloge za putovanja na kojima nisu bili te da su tako oštetili Teniski klub "Split" za oko 270 tisuća kuna. Prema optužnici podignutoj još krajem veljače 2006. godine, tri godine nakon što je policija podnijela kaznenu prijavu, Kragić je u navedenom razdoblju ispisao ukupno 161 neistiniti putni nalog, od čega 150 na svoje ime, a tijekom 2003. godine 11 neistinitih putnih naloga na Stanićevo ime.

Službene potrebe

U nalozima je navedeno kako su Kragić i Stanić za službene potrebe kluba putovali u različita mjesta u Hrvatskoj i inozemstvu, a Kragić ih je potpisao i ovjerio pečatom kluba, iako je znao da to nije istina. Ujedno je obračunavao i troškove po tim nalozima koji nisu ostvareni ili su ostvareni u druge svrhe, a po kojim nalozima su on i Stanić uzimali novac te su uzimali novac uz isplatnice i na ime akontacija za putovanja na koja nikada nisu odlazili niti su ih potkrijepili putnim nalozima. Teretilo ih se u početku za štetu od oko 460 tisuća kuna koje su dali Kačeru, no ona je prepolovljena nakon što je tijekom postupaka obrana uspjela dokazati da je dio putovanja uistinu i obavljen.

Ovo je očito posljednji susret Kačera sa šibenskim sudom u ovom slučaju jer početkom lipnja nastupa apsolutna zastara kaznenog progona. Njegov odvjetnik Joško Čeh kazao nam je da se, kako stvari sad stoje, neće žaliti na ovu presudu. Stanićev odvjetnik Željko Gulišija, pak, istaknuo je kako je, bez obzira na prethodne osuđujuće presude, očekivao ovakav najpovoljniji ishod za svojega branjenika.

Profesoru dr. sc. Hrvoju Kačeru, pročelniku Katedre za građansko pravo splitskoga Pravnog fakulteta, na šibenskom Županijskom sudu je po treći put izrečena presuda za zloporabu položaja i ovlasti i krivotvorenje isprave.

Redoviti profesor Pravnog fakulteta, kojeg mnogi studenti prava nose zauvijek u svojim mislima, ovaj je put oslobođen optužbi za zlouporabu položaja i ovlasti i krivotvorenje. No, da ne bi ispalo da je prošao potpuno "lišo", osuđen je nepravomoćno na tri mjeseca zatvora s rokom kušnje od godinu dana zbog poticanja Ante Kragića, danas pokojnog bivšeg direktora Teniskog kluba "Split", na falsificiranje pet putnih naloga. Uz Kačera okrivljeni su bili već spomenuti Kragić te teniski trener Željko Stanić, koji je sad oslobođen krivnje.

Bitne povrede

Sva su trojica prvi put bili osuđena 2011. godine. Kačer je tada dobio godinu i pol bezuvjetnog zatvora zbog zloporabe položaja i ovlasti i krivotvorenja isprave, no ta je presuda ukinuta zbog bitne povrede Kaznenog zakona i dopune činjeničnog stanja. Drugi put je ista šibenska sutkinja, Jadranka Biga Milutin, u studenome 2013. godine, opet osudila Kačera na identičnu zatvorsku kaznu, dok je Stanić, kao i prvi put, kažnjen s uvjetnom kaznom od šest mjeseci s rokom kušnje od dvije godine, i to za pomaganje. I ta je presuda bila ukinuta, no treći put nije im sudila sutkinja Biga Milutin.

Kačera i Stanića se, zajedno s pokojnim Kragićem, teretilo da su od 1998. do 2003. godine zajednički i u dogovoru, na traženje i u korist Hrvoja Kačera, ispisivali fiktivne putne naloge za putovanja na kojima nisu bili te da su tako oštetili Teniski klub "Split" za oko 270 tisuća kuna. Prema optužnici podignutoj još krajem veljače 2006. godine, tri godine nakon što je policija podnijela kaznenu prijavu, Kragić je u navedenom razdoblju ispisao ukupno 161 neistiniti putni nalog, od čega 150 na svoje ime, a tijekom 2003. godine 11 neistinitih putnih naloga na Stanićevo ime.

Službene potrebe

U nalozima je navedeno kako su Kragić i Stanić za službene potrebe kluba putovali u različita mjesta u Hrvatskoj i inozemstvu, a Kragić ih je potpisao i ovjerio pečatom kluba, iako je znao da to nije istina. Ujedno je obračunavao i troškove po tim nalozima koji nisu ostvareni ili su ostvareni u druge svrhe, a po kojim nalozima su on i Stanić uzimali novac te su uzimali novac uz isplatnice i na ime akontacija za putovanja na koja nikada nisu odlazili niti su ih potkrijepili putnim nalozima. Teretilo ih se u početku za štetu od oko 460 tisuća kuna koje su dali Kačeru, no ona je prepolovljena nakon što je tijekom postupaka obrana uspjela dokazati da je dio putovanja uistinu i obavljen.

Ovo je očito posljednji susret Kačera sa šibenskim sudom u ovom slučaju jer početkom lipnja nastupa apsolutna zastara kaznenog progona. Njegov odvjetnik Joško Čeh kazao nam je da se, kako stvari sad stoje, neće žaliti na ovu presudu. Stanićev odvjetnik Željko Gulišija, pak, istaknuo je kako je, bez obzira na prethodne osuđujuće presude, očekivao ovakav najpovoljniji ishod za svojega branjenika.

Profesoru dr. sc. Hrvoju Kačeru, pročelniku Katedre za građansko pravo splitskoga Pravnog fakulteta, na šibenskom Županijskom sudu je po treći put izrečena presuda za zloporabu položaja i ovlasti i krivotvorenje isprave.

Redoviti profesor Pravnog fakulteta, kojeg mnogi studenti prava nose zauvijek u svojim mislima, ovaj je put oslobođen optužbi za zlouporabu položaja i ovlasti i krivotvorenje. No, da ne bi ispalo da je prošao potpuno "lišo", osuđen je nepravomoćno na tri mjeseca zatvora s rokom kušnje od godinu dana zbog poticanja Ante Kragića, danas pokojnog bivšeg direktora Teniskog kluba "Split", na falsificiranje pet putnih naloga. Uz Kačera okrivljeni su bili već spomenuti Kragić te teniski trener Željko Stanić, koji je sad oslobođen krivnje.
