Miroslav Kutle pravomoćno je oslobođen i u aferi "Tisak".

Zbog nje je 2004. godine bio osuđen na 6,5 godina zatvora i završio u Remetincu, ali je presuda poslije ukinuta. Optužnica je do sada mijenjana pet puta, a šteta s prvotnih 47 milijuna kuna na koncu spala na nekih 30 milijuna kuna.

DORH je posljednji pravni manevar izveo 2016. godine, kada je u strahu od zastare pokušao iskoristiti institut ratnog profiterstva. To im nije prošlo jer je sud uvažio da su "djela počinjena za vrijeme neposredne ugroženosti neovisnosti, ali da pri tome nije opisan način na koji su optuženici iskoristili navedeno stanje..."

Živ sam i zdrav

Sudu je na koncu ostalo konstatirati kako je nastupila zastara za djela za koja su se Kutle i ekipa teretili. Sličan scenarij protiv simbola tajkunske privatizacije "devedesetih", kako ga se oslovljavalo u medijima, viđen je do sada u nizu slučajeva.

I ovu presudu Miroslav Kutle dočekao je u susjednoj Bosni i Hercegovini. Tamo je već dobrih 10 godina, točnije od kada mu je 2010. godine izrečena pravomoćna presuda u jednom drugom slučaju, aferi "Gradski podrumi". Osuđen je na dvije godine i osam mjeseci zatvora, Hrvatska je tražila njegovo izručenje, ali ju je BiH odbila s obrazloženjem da ono za što je Kutle osuđen, tamo nije kazneno djelo. Jedino što je osuđenik trebao paziti jest zastarni rok od 10 godina, koji je nedavno istekao.

- Živ sam i zdrav - rekao nam je Kutle u telefonskom razgovoru u utorak.

Dobili smo ga na broj jednog od operatera mobilne telefonije u susjednoj državi, ali nije iskazivao posebno zadovoljstvo ishodom još jednom pravosudnog spora u kojemu je imao glavnu ulogu.

- To vam je predmet otprije 2000. godine. Nema kod mene mlađeg od 22 godine, vuku se tamo još od 1998. A ovo što se desilo bila je neminovnost. Optužnica je nastala na predmetu političke volje, postupak je vođen pod pritiskom politike, pa su u konačnici morali profunkcionirati pravo i pravda. Trebale su, doduše, 22 godine - komentirao nam je.

- Ne bih ja ulazio u polemike tko stoji iza svih tih slučajeva protiv mene. Prošle godine sam imao 11 oslobađajućih prvostupanjskih presuda. Nije li čudno da neki ljudi, njih 100 iz iste kompanije i koji nemaju nikakav doticaj s kriminalom, odjednom završi u više od 20 procesa. Svi oni sada, ako nisu pod patronatom politike, završavaju oslobađajućim presudama. Ali traju dvadeset i neku godinu. Za to vrijeme vam se promijene životi. Za novinara istražitelja ima tu puno pitanja. To je interesantnije od pitanja kako je došlo do oslobađajuće presude. To što je tamo napisano u tim optužnicama sa stajališta prava bilo je smiješno - ističe Kutle.

Izvorna domovina

Sam nije mogao precizirati koliko se protiv njega u RH u ovome trenutku još vodi postupaka.

- Imam ih nešto, a većina ih čeka drugostupanjsku presudu. Ne znam točan broj. Odvjetnici znaju - odgovorio je.

Ono što nas je posebno zanimalo bilo je ima li se jednog dana namjeru vratiti u Hrvatsku. Prema nekim tumačenjima, još jedina veća prepreka je "slučaj Diona", koji je vraćen na prvi stupanj i zastara nastupa krajem ove godine. Malo je vjerojatno da će taj rok uhvatiti domaće pravosuđe, ako mu nije bilo dovoljno skoro dva desetljeća.

- Ja živim u BiH. Tu sam više od 10 godina. Da sam mogao opstati u smislu zaštite države, prava i ljudskih sloboda, živio bih vjerojatno u Hrvatskoj. Ja živim ovdje normalno i ovo je moja izvorna domovina. Ostajem u BiH do daljnjega - poručio nam je Kutle.

Posljednjih godina, inače, živi na relaciji Mostar-Sarajevo-Banja Luka, ali najviše vremena provodi na Kupresu. Tamo je i pokrenuo biznis s uzgojem aromatičnog bilja, poput kamilice i slično. Želja mu je podići tvornicu čaja, za što je već i unajmio jedan pogon u samom mjestu. Nasadi se nalaze u blizini lani otvorenog hotela "Jezero", u podnožju Čajuše i skijališta kod "Adria-ski" hotela.

Na dugom čišćenju

- Miroslava Kutlu sigurno još dugo nećete vidjeti u Hrvatskoj. On se plaši nekoga novog montiranog postupka, a vrijeme do ulaska BiH u Europsku uniju želi iskoristiti da se očisti od svih optužnica. I ja bih na njegovu mjestu isto rezonirao – komentirao nam je jedan njegov bliski hercegovački prijatelj.

Miroslav Kutle pravomoćno je oslobođen i u aferi "Tisak".

Zbog nje je 2004. godine bio osuđen na 6,5 godina zatvora i završio u Remetincu, ali je presuda poslije ukinuta. Optužnica je do sada mijenjana pet puta, a šteta s prvotnih 47 milijuna kuna na koncu spala na nekih 30 milijuna kuna.

DORH je posljednji pravni manevar izveo 2016. godine, kada je u strahu od zastare pokušao iskoristiti institut ratnog profiterstva. To im nije prošlo jer je sud uvažio da su "djela počinjena za vrijeme neposredne ugroženosti neovisnosti, ali da pri tome nije opisan način na koji su optuženici iskoristili navedeno stanje..."

Živ sam i zdrav

Sudu je na koncu ostalo konstatirati kako je nastupila zastara za djela za koja su se Kutle i ekipa teretili. Sličan scenarij protiv simbola tajkunske privatizacije "devedesetih", kako ga se oslovljavalo u medijima, viđen je do sada u nizu slučajeva.

I ovu presudu Miroslav Kutle dočekao je u susjednoj Bosni i Hercegovini. Tamo je već dobrih 10 godina, točnije od kada mu je 2010. godine izrečena pravomoćna presuda u jednom drugom slučaju, aferi "Gradski podrumi". Osuđen je na dvije godine i osam mjeseci zatvora, Hrvatska je tražila njegovo izručenje, ali ju je BiH odbila s obrazloženjem da ono za što je Kutle osuđen, tamo nije kazneno djelo. Jedino što je osuđenik trebao paziti jest zastarni rok od 10 godina, koji je nedavno istekao.

- Živ sam i zdrav - rekao nam je Kutle u telefonskom razgovoru u utorak.

Dobili smo ga na broj jednog od operatera mobilne telefonije u susjednoj državi, ali nije iskazivao posebno zadovoljstvo ishodom još jednom pravosudnog spora u kojemu je imao glavnu ulogu.

- To vam je predmet otprije 2000. godine. Nema kod mene mlađeg od 22 godine, vuku se tamo još od 1998. A ovo što se desilo bila je neminovnost. Optužnica je nastala na predmetu političke volje, postupak je vođen pod pritiskom politike, pa su u konačnici morali profunkcionirati pravo i pravda. Trebale su, doduše, 22 godine - komentirao nam je.

- Ne bih ja ulazio u polemike tko stoji iza svih tih slučajeva protiv mene. Prošle godine sam imao 11 oslobađajućih prvostupanjskih presuda. Nije li čudno da neki ljudi, njih 100 iz iste kompanije i koji nemaju nikakav doticaj s kriminalom, odjednom završi u više od 20 procesa. Svi oni sada, ako nisu pod patronatom politike, završavaju oslobađajućim presudama. Ali traju dvadeset i neku godinu. Za to vrijeme vam se promijene životi. Za novinara istražitelja ima tu puno pitanja. To je interesantnije od pitanja kako je došlo do oslobađajuće presude. To što je tamo napisano u tim optužnicama sa stajališta prava bilo je smiješno - ističe Kutle.

Izvorna domovina

Sam nije mogao precizirati koliko se protiv njega u RH u ovome trenutku još vodi postupaka.

- Imam ih nešto, a većina ih čeka drugostupanjsku presudu. Ne znam točan broj. Odvjetnici znaju - odgovorio je.

Ono što nas je posebno zanimalo bilo je ima li se jednog dana namjeru vratiti u Hrvatsku. Prema nekim tumačenjima, još jedina veća prepreka je "slučaj Diona", koji je vraćen na prvi stupanj i zastara nastupa krajem ove godine. Malo je vjerojatno da će taj rok uhvatiti domaće pravosuđe, ako mu nije bilo dovoljno skoro dva desetljeća.

- Ja živim u BiH. Tu sam više od 10 godina. Da sam mogao opstati u smislu zaštite države, prava i ljudskih sloboda, živio bih vjerojatno u Hrvatskoj. Ja živim ovdje normalno i ovo je moja izvorna domovina. Ostajem u BiH do daljnjega - poručio nam je Kutle.

Posljednjih godina, inače, živi na relaciji Mostar-Sarajevo-Banja Luka, ali najviše vremena provodi na Kupresu. Tamo je i pokrenuo biznis s uzgojem aromatičnog bilja, poput kamilice i slično. Želja mu je podići tvornicu čaja, za što je već i unajmio jedan pogon u samom mjestu. Nasadi se nalaze u blizini lani otvorenog hotela "Jezero", u podnožju Čajuše i skijališta kod "Adria-ski" hotela.

Na dugom čišćenju

- Miroslava Kutlu sigurno još dugo nećete vidjeti u Hrvatskoj. On se plaši nekoga novog montiranog postupka, a vrijeme do ulaska BiH u Europsku uniju želi iskoristiti da se očisti od svih optužnica. I ja bih na njegovu mjestu isto rezonirao – komentirao nam je jedan njegov bliski hercegovački prijatelj.

Miroslav Kutle pravomoćno je oslobođen i u aferi "Tisak".

Zbog nje je 2004. godine bio osuđen na 6,5 godina zatvora i završio u Remetincu, ali je presuda poslije ukinuta. Optužnica je do sada mijenjana pet puta, a šteta s prvotnih 47 milijuna kuna na koncu spala na nekih 30 milijuna kuna.

DORH je posljednji pravni manevar izveo 2016. godine, kada je u strahu od zastare pokušao iskoristiti institut ratnog profiterstva. To im nije prošlo jer je sud uvažio da su "djela počinjena za vrijeme neposredne ugroženosti neovisnosti, ali da pri tome nije opisan način na koji su optuženici iskoristili navedeno stanje..."

Živ sam i zdrav

Sudu je na koncu ostalo konstatirati kako je nastupila zastara za djela za koja su se Kutle i ekipa teretili. Sličan scenarij protiv simbola tajkunske priv...
