Prije nekoliko dana objavljena informacija da je temeljem optužnog prijedloga policije u Čakovcu tamošnji Općinski sud presudom trajno oduzeo tek godinu dana star i stotinjak tisuća eura vrijedan automobil marke Porsche Cayenne od 28-godišnjaka koji je višestruko prekršajno kažnjavan, izazvala je pozornost šire javnosti, a mnogi su se čudili kako je to moguće i od kada sudovi u Hrvatskoj imaju mogućnost oduzimanja nečije privatne imovine.

Da podsjetimo, takvi su potezi zakonski omogućeni policiji i sudovima već tri godine, točnije od 1. kolovoza 2019. godine kada je na snagu stupio izmjenjeni Zakona o sigurnosti prometa na cestama (ZSPC). Njime je policiji omogućeno da može vozilo privremeno oduzeti vozaču koji je najmanje već dva puta pravomoćno kažnjen u trogodišnjem razdoblju, a ponovno počini neki od najtežih prometnih prekršaja.

U takve prekršaje spadaju prekoračenje dozvoljene brzine kretanja u naseljenom mjestu za više od 50 km/h, vožnja u suprotnom ili zabranjenom smjeru na autocesti, brzoj cesti i cesti namijenjenoj isključivo za promet motornih vozila, namjerni prolazak kroz crveno svjetlo odnosno prolazak kroz crveno svjetlo bez smanjenja brzine, povećanjem brzine ili prolazak kroz dva ili više crvenih svjetala, odbijanje podvrgavanju ispitivanja radi provjere da li u organizmu ima alkohola ili droga, vožnja pod utjecajem alkohola iznad 1,5 g/kg i vožnja pod utjecajem droga, upravljanje vozilom prije stjecanja prava, upravljanje vozilom dok je vozačka dozvola ukinuta zbog prikupljenih negativnih prekršajnih bodova, upravljanje vozilom dok je vozačka dozvola oduzeta, dok je vozač isključen iz prometa ili mu je izrečena mjera privremenog oduzimanja vozačke dozvole ili zaštitna mjera. Privremeno oduzimanje vozila znači oduzimanje do odluke suda koji je dužan odluku donijeti u roku od 15 dana.

Vozila se trajno oduzimaju kad sudovi presude da je opasnost od ugrožavanja sigurnosti prometa veća nego pravo na privatno vlasništvo ili pravo na korištenje vozila.

Na području koje pokriva PU Splitsko-dalmatinska od kolovoza 2019. godine do danas je oduzeto ukupno 51 vozilo od čega su trojica prekršitelja ostala trajno bez svojih automobila. Zanimljiv je podatak da je jednom vozaču čak četiri puta oduzimano vozilo i to zato jer je vozio bez izdane vozačke dozvole i jer je vozio dok je imao zabranu upravljanja vozilom. Jedno mu je trajno oduzeto, a hoće li zauvijek ostati bez još tri vozila čeka se odluka suda.

Od kolovoza do kraja prosinca 2019. godine splitska je policija oduzela tek jedno vozilo, godinu dana poslije taj se broj popeo na jedanaest da bi prošle godine ukupno bilo oduzeto 18 vozila, a samo u prvih deset mjeseci ove godine 21 vozilo. Taj se broj još može povećati u preostala dva mjeseca.

Najviše je vozila oduzeto na području Trogira i Omiša i to po šesnaest! Makarska i hvarska policija su u tom periodu oduzeli po četiri vozila dok je na području Grada Splita troje vlasnika ostalo bez svojih vozila, isto toliko i na sinjskom području, a po jedno je vozilo oduzeto na području Imotskog i Brača.

Kako su pojasnili u splitskoj policiji, ne oduzimaju se samo automobili već su zaplijenjeni i motocikli tipa Suzuki, Piaggio, Yamaha, Suzuki, Gilera te mopedi marki Longija Vision, Gilera, Piaggio, Tomos APN... Što se tiče automobila, privremeno ili trajno oduzeta su vozila marki Peugeot 206, VW Golf, Alfa Romeo, Citroen, VW Passat, VW Tuareg, BMW, Opel Vectra, Ford Mondeo, Daewoo Matiz, Mercedes, Suzuki, Peugoet 306, Kia, BMW 530d, VW POLO.

Što se događa s trajno oduzetim vozilima? Prvo se ide na njihovu prodaju, a novac koji se na taj način zaradi uplaćuje se u državni proračun kao prihod. Ako se vozilo nije uspjelo prodati, a za njim postoji potreba i javni interes, ono se može, pojašnjavaju u MUP-u, besplatno dodijeliti tijelima državne vlasti, naravno ukoliko je pogodno za obavljanje njihove djelatnosti ili jedinicama lokalne i područne (regionalne) samouprave, pravnim osobama koje imaju javne ovlasti i neprofitnim organizacijama koje obavljaju odgovarajuću djelatnost ako je vozilo pogodno za obavljanje humanitarne, socijalne, druge društvene ili općekorisne djelatnosti.

Ukoliko se oduzeto vozilo nije uspjelo prodati, a nije pogodno da se da na korištenje nekom od gore navedenih subjekata, onda će se uništiti.

Prije nekoliko dana objavljena informacija da je temeljem optužnog prijedloga policije u Čakovcu tamošnji Općinski sud presudom trajno oduzeo tek godinu dana star i stotinjak tisuća eura vrijedan automobil marke Porsche Cayenne od 28-godišnjaka koji je višestruko prekršajno kažnjavan, izazvala je pozornost šire javnosti, a mnogi su se čudili kako je to moguće i od kada sudovi u Hrvatskoj imaju mogućnost oduzimanja nečije privatne imovine.

Da podsjetimo, takvi su potezi zakonski omogućeni policiji i sudovima već tri godine, točnije od 1. kolovoza 2019. godine kada je na snagu stupio izmjenjeni Zakona o sigurnosti prometa na cestama (ZSPC). Njime je policiji omogućeno da može vozilo privremeno oduzeti vozaču koji je najmanje već dva puta pravomoćno kažnjen u trogodišnjem razdoblju, a ponovno počini neki od najtežih prometnih prekršaja.

U takve prekršaje spadaju prekoračenje dozvoljene brzine kretanja u naseljenom mjestu za više od 50 km/h, vožnja u suprotnom ili zabranjenom smjeru na autocesti, brzoj cesti i cesti namijenjenoj isključivo za promet motornih vozila, namjerni prolazak kroz crveno svjetlo odnosno prolazak kroz crveno svjetlo bez smanjenja brzine, povećanjem brzine ili prolazak kroz dva ili više crvenih svjetala, odbijanje podvrgavanju ispitivanja radi provjere da li u organizmu ima alkohola ili droga, vožnja pod utjecajem alkohola iznad 1,5 g/kg i vožnja pod utjecajem droga, upravljanje vozilom prije stjecanja prava, upravljanje vozilom dok je vozačka dozvola ukinuta zbog prikupljenih negativnih prekršajnih bodova, upravljanje vozilom dok je vozačka dozvola oduzeta, dok je vozač isključen iz prometa ili mu je izrečena mjera privremenog oduzimanja vozačke dozvole ili zaštitna mjera. Privremeno oduzimanje vozila znači oduzimanje do odluke suda koji je dužan odluku donijeti u roku od 15 dana.

Vozila se trajno oduzimaju kad sudovi presude da je opasnost od ugrožavanja sigurnosti prometa veća nego pravo na privatno vlasništvo ili pravo na korištenje vozila.

Na području koje pokriva PU Splitsko-dalmatinska od kolovoza 2019. godine do danas je oduzeto ukupno 51 vozilo od čega su trojica prekršitelja ostala trajno bez svojih automobila. Zanimljiv je podatak da je jednom vozaču čak četiri puta oduzimano vozilo i to zato jer je vozio bez izdane vozačke dozvole i jer je vozio dok je imao zabranu upravljanja vozilom. Jedno mu je trajno oduzeto, a hoće li zauvijek ostati bez još tri vozila čeka se odluka suda.

Od kolovoza do kraja prosinca 2019. godine splitska je policija oduzela tek jedno vozilo, godinu dana poslije taj se broj popeo na jedanaest da bi prošle godine ukupno bilo oduzeto 18 vozila, a samo u prvih deset mjeseci ove godine 21 vozilo. Taj se broj još može povećati u preostala dva mjeseca.

Najviše je vozila oduzeto na području Trogira i Omiša i to po šesnaest! Makarska i hvarska policija su u tom periodu oduzeli po četiri vozila dok je na području Grada Splita troje vlasnika ostalo bez svojih vozila, isto toliko i na sinjskom području, a po jedno je vozilo oduzeto na području Imotskog i Brača.

Kako su pojasnili u splitskoj policiji, ne oduzimaju se samo automobili već su zaplijenjeni i motocikli tipa Suzuki, Piaggio, Yamaha, Suzuki, Gilera te mopedi marki Longija Vision, Gilera, Piaggio, Tomos APN... Što se tiče automobila, privremeno ili trajno oduzeta su vozila marki Peugeot 206, VW Golf, Alfa Romeo, Citroen, VW Passat, VW Tuareg, BMW, Opel Vectra, Ford Mondeo, Daewoo Matiz, Mercedes, Suzuki, Peugoet 306, Kia, BMW 530d, VW POLO.

Što se događa s trajno oduzetim vozilima? Prvo se ide na njihovu prodaju, a novac koji se na taj način zaradi uplaćuje se u državni proračun kao prihod. Ako se vozilo nije uspjelo prodati, a za njim postoji potreba i javni interes, ono se može, pojašnjavaju u MUP-u, besplatno dodijeliti tijelima državne vlasti, naravno ukoliko je pogodno za obavljanje njihove djelatnosti ili jedinicama lokalne i područne (regionalne) samouprave, pravnim osobama koje imaju javne ovlasti i neprofitnim organizacijama koje obavljaju odgovarajuću djelatnost ako je vozilo pogodno za obavljanje humanitarne, socijalne, druge društvene ili općekorisne djelatnosti.

Ukoliko se oduzeto vozilo nije uspjelo prodati, a nije pogodno da se da na korištenje nekom od gore navedenih subjekata, onda će se uništiti.
