Nakon pravomoćne presude Vrhovnog suda, mogućnosti žalbe nema, rekao je u Novom danu N1 televizije Veljko Miljević, jedan od odvjetnika Zdravka Mamića.

- Preostaju izvanredni pravni lijekovi, vidim mogućnost pisanja prijedloga za podizanje zahtjeva za zaštitu zakonitosti”, rekao je Veljko Miljević, dodavši kako su već ukazivali na nezakonitost prvostupanjske presude, a takav zahtjev ide glavnom državnom odvjetniku, dok o istome odlučuje Vrhovni sud - pojasnio je.

- Hoće li iz ovog što je Mamić jučer inicirao proisteći mogućnost eventualne obnove kaznenog postupka, to ovisi o rezultatima tog postupka - rekao je odvjetnik, pa podsjetio da je Mamić, kako je sam jučer naveo, 8. listopada DORH-u predao stick na kojem je, kako je rekao Miljević, iznio određene činjenice, a DORH je potvrdio da od tog dana provodi istražne radnje i istražuje optužbe.

Rekao je i da je prije godinu dana prije toga Mamić i u pisanom obliku izrazio spremnost za suradnju s hrvatskim pravosuđem.

- Međutim, očito je dugo trebalo da se u tom pravcu nešto pokrene - dodao je.

Kaže kako do pred mjesec dana nije znao da je Zdravko Mamić predao stick. Upitan kako je Mamić mogao predati takve dokaze, rekao je da fizički sigurno nije bio u Uskoku, a za sebe kaže da to nije dio njegovog posla i u tome nije sudjelovao.

- Neka vam Uskok da te informacije, oni znaju tko ih je kontaktirao - poručio je.

Ponovio je da te informacije ima već mjesec dana i ne vidi ništa sporno u načinu na koji je to učinjeno.

- Nažalost, hrvatska javnost je naviknuta da se tajni podaci objavljuju na naslovnicama i za koje mi, aktivni sudionici, ne znamo - istaknuo je Miljević.

Neke stvari mogu se egzaktno utvrditi jer postoje snimke, rekao je i ponovio kako je on zadužen za rad u sudnici i za pravne radnje, a što se tiče samog sticka, osobno nije pogledao i ne zna što se na njemu nalazi.

- O tome on sam odlučuje, što ne znači da nemam saznanja o tome - rekao je, pojasnivši da ga branjenik može obavijestiti o svojim namjerama, ali on sam odlučuje što će poduzeti.

Nakon pravomoćne presude, rok za pisanje ustavne tužbe zbog presude Zdravku Mamiću je 30 dana od dana uručenja presude, rekao je te pojasnio koji je rok za izvršenje zatvorske kazne.

- Onog momenta kad je presuda pravomoćna, sa ZKP-a se sele ljudi na izvršenje kazne. Početna je radnja da sudac izvršenja Županijskog suda mjesta prebivališta, za Mamića je to bio zadnji Zagreb, on upućuje poziv osuđeniku, pod uvjetom da je na slobodi. Mora se izvršiti akt pozivanja na dobrovoljno izvršenje kazne, a tog zakonskog roka nema. Radi se o žurnom postupku.

Upitan koliko dugo Zdravko Mamić i drugi okrivljenici mogu na slobodi čekati odlazak na izvršenje zatvorske kazne, odgovorio je kako je pitanje veoma zanimljivo:

- Te su odredbe fleksibilne, po mom ukusu kao pravnika, i previše fleksibilne. U ukupnom iznosu, to ne bi smjelo trajati duže od godine dana - rekao je Miljević za N1.

Nakon pravomoćne presude Vrhovnog suda, mogućnosti žalbe nema, rekao je u Novom danu N1 televizije Veljko Miljević, jedan od odvjetnika Zdravka Mamića.

- Preostaju izvanredni pravni lijekovi, vidim mogućnost pisanja prijedloga za podizanje zahtjeva za zaštitu zakonitosti”, rekao je Veljko Miljević, dodavši kako su već ukazivali na nezakonitost prvostupanjske presude, a takav zahtjev ide glavnom državnom odvjetniku, dok o istome odlučuje Vrhovni sud - pojasnio je.

- Hoće li iz ovog što je Mamić jučer inicirao proisteći mogućnost eventualne obnove kaznenog postupka, to ovisi o rezultatima tog postupka - rekao je odvjetnik, pa podsjetio da je Mamić, kako je sam jučer naveo, 8. listopada DORH-u predao stick na kojem je, kako je rekao Miljević, iznio određene činjenice, a DORH je potvrdio da od tog dana provodi istražne radnje i istražuje optužbe.

Rekao je i da je prije godinu dana prije toga Mamić i u pisanom obliku izrazio spremnost za suradnju s hrvatskim pravosuđem.

- Međutim, očito je dugo trebalo da se u tom pravcu nešto pokrene - dodao je.

Kaže kako do pred mjesec dana nije znao da je Zdravko Mamić predao stick. Upitan kako je Mamić mogao predati takve dokaze, rekao je da fizički sigurno nije bio u Uskoku, a za sebe kaže da to nije dio njegovog posla i u tome nije sudjelovao.

- Neka vam Uskok da te informacije, oni znaju tko ih je kontaktirao - poručio je.

Ponovio je da te informacije ima već mjesec dana i ne vidi ništa sporno u načinu na koji je to učinjeno.

- Nažalost, hrvatska javnost je naviknuta da se tajni podaci objavljuju na naslovnicama i za koje mi, aktivni sudionici, ne znamo - istaknuo je Miljević.

Neke stvari mogu se egzaktno utvrditi jer postoje snimke, rekao je i ponovio kako je on zadužen za rad u sudnici i za pravne radnje, a što se tiče samog sticka, osobno nije pogledao i ne zna što se na njemu nalazi.

- O tome on sam odlučuje, što ne znači da nemam saznanja o tome - rekao je, pojasnivši da ga branjenik može obavijestiti o svojim namjerama, ali on sam odlučuje što će poduzeti.

Nakon pravomoćne presude, rok za pisanje ustavne tužbe zbog presude Zdravku Mamiću je 30 dana od dana uručenja presude, rekao je te pojasnio koji je rok za izvršenje zatvorske kazne.

- Onog momenta kad je presuda pravomoćna, sa ZKP-a se sele ljudi na izvršenje kazne. Početna je radnja da sudac izvršenja Županijskog suda mjesta prebivališta, za Mamića je to bio zadnji Zagreb, on upućuje poziv osuđeniku, pod uvjetom da je na slobodi. Mora se izvršiti akt pozivanja na dobrovoljno izvršenje kazne, a tog zakonskog roka nema. Radi se o žurnom postupku.

Upitan koliko dugo Zdravko Mamić i drugi okrivljenici mogu na slobodi čekati odlazak na izvršenje zatvorske kazne, odgovorio je kako je pitanje veoma zanimljivo:

- Te su odredbe fleksibilne, po mom ukusu kao pravnika, i previše fleksibilne. U ukupnom iznosu, to ne bi smjelo trajati duže od godine dana - rekao je Miljević za N1.

Nakon pravomoćne presude Vrhovnog suda, mogućnosti žalbe nema, rekao je u Novom danu N1 televizije Veljko Miljević, jedan od odvjetnika Zdravka Mamića.

- Preostaju izvanredni pravni lijekovi, vidim mogućnost pisanja prijedloga za podizanje zahtjeva za zaštitu zakonitosti”, rekao je Veljko Miljević, dodavši kako su već ukazivali na nezakonitost prvostupanjske presude, a takav zahtjev ide glavnom državnom odvjetniku, dok o istome odlučuje Vrhovni sud - pojasnio je.

- Hoće li iz ovog što je Mamić jučer inicirao proisteći mogućnost eventualne obnove kaznenog postupka, to ovisi o rezultatima tog postupka - rekao je odvjetnik, pa podsjetio da je Mamić, kako je sam jučer naveo, 8. listopada DORH-u predao stick na kojem je, kako je rekao Miljević, iznio određene činjenice, a DORH ...
