Bivši saborski zastupnik HDZ-a Franjo Lucić nije na Ustavnom sudu uspio srušiti presudu kojom je kažnjen s godinom dana zatvora zbog podmićivanja novinara portala Telegram.hr Drage Hedla, piše N1.

Lucić je nudio Hedlu mito da ne piše o njemu. Novinar je sve to snimio i raskrinkao HDZ-ovog zastupnika. U ustavnoj tužbi Lucić je tvrdio da nije imao pravedno suđenje te opetovano isticao kako nije mogao biti osuđen za davanje mita novinaru, kad novinar nije ni službena ni odgovorna osoba. Objašnjavao je kako prema hrvatskom Kaznenom zakonu mito mogu primiti samo službene ili odgovorna osobe što novinari nisu. Nuđenje novca novinaru, prema tom Lucićevom viđenju, ne bi smjelo biti kažnjivo.

Tvrdio je i da je kažnjen prestrogo, odnosno da kazna nije razmjerna onome što je učinio. Ovdje valja podsjetiti da je najprije dobio godinu dana rada za opće dobro, ali je nakon žalbe USKOK-a ta kazna zamijenjena bezuvjetnom zatvorskom kaznom.

Lucić se žalio i na to da nije sudjelovao na sjednici Vrhovnog suda RH koji je raspravljao o žalbi USKOK-a, iako je, priznao je, dobio poziv. Nije mu se, međutim, odazvao, svjestan da kao okrivljenik ne bi imao pravo sudjelovati u raspravi. Upravo je to isticao kao propust tijekom procesa. Lucić je tražio od Ustavnog suda i da mu omogući odgodu odlaska na odsluženje kazne, ali je taj zahtjev postao bespredmetan nakon što mu je tužba odbijena.

Većina ustavnih sudaca u odluci koju je potpisao predsjednik Ustavnog suda RH Miroslav Šeparović kaže da je Lucićevo suđenje bilo u skladu s Ustavom i Europskom konvencijom o ljudskim pravima. To što nije došao na Vrhovni sud RH, iako je pozvan, je njegova osobna odluka koja nije utjecala na pravednost procesa.

Ni sa statusom novinara kao osobe kojoj je nuđeno mito ništa, po stavu većine sudaca Ustavnog suda, nema ništa sporno. Naime, status novinara protumačen je kao status "odgovorne osobe" budući da mu je Lucić nudio mito kako ne bi obavio novinarski posao.

“To je posao što ga je novinar morao obaviti kao odgovorna osoba, a Franjo Lucić tražio je da ga u zamjenu za mito ne obavi”, zaključio je Ustavni sud i odbio taj Lucićev argument.

Doduše, dvojica sudaca nisu se složila sa stavom većine. Riječ je o sucima Branku Brkiću i Miroslavu Šumanoviću koji smatraju da novinar baš nikakvim tumačenjem zakona ne može biti definiran ni kao službena ni odgovorna osoba.

“Mišljenja sam da novinari zaposleni ili ugovorno angažirani od strane trgovačkih društava koja se bave medijskom djelatnošću ne potpadaju pod opseg primjene kaznenopravnih odredaba o javnom podmićivanju s obzirom na to da se prema zakonu ne mogu smatrati odgovornim osobama jer ne obavljaju javne ovlasti

koje bi im de iure ili de facto bile povjerene. U kaznenom zakonu, naime, nedostaje adekvatna kaznena odredba na osnovi koje bi novinari podlijegali korupcijskim kaznenim djelima, primjerice kao primatelji mita ili počinitelji zlouporabe položaja ili ovlasti”, poručio je u svom izdvojenom mišljenju ustavni sudac Šumanović, piše N1..

Bivši saborski zastupnik HDZ-a Franjo Lucić nije na Ustavnom sudu uspio srušiti presudu kojom je kažnjen s godinom dana zatvora zbog podmićivanja novinara portala Telegram.hr Drage Hedla, piše N1.

Lucić je nudio Hedlu mito da ne piše o njemu. Novinar je sve to snimio i raskrinkao HDZ-ovog zastupnika. U ustavnoj tužbi Lucić je tvrdio da nije imao pravedno suđenje te opetovano isticao kako nije mogao biti osuđen za davanje mita novinaru, kad novinar nije ni službena ni odgovorna osoba. Objašnjavao je kako prema hrvatskom Kaznenom zakonu mito mogu primiti samo službene ili odgovorna osobe što novinari nisu. Nuđenje novca novinaru, prema tom Lucićevom viđenju, ne bi smjelo biti kažnjivo.

Tvrdio je i da je kažnjen prestrogo, odnosno da kazna nije razmjerna onome što je učinio. Ovdje valja podsjetiti da je najprije dobio godinu dana rada za opće dobro, ali je nakon žalbe USKOK-a ta kazna zamijenjena bezuvjetnom zatvorskom kaznom.

Lucić se žalio i na to da nije sudjelovao na sjednici Vrhovnog suda RH koji je raspravljao o žalbi USKOK-a, iako je, priznao je, dobio poziv. Nije mu se, međutim, odazvao, svjestan da kao okrivljenik ne bi imao pravo sudjelovati u raspravi. Upravo je to isticao kao propust tijekom procesa. Lucić je tražio od Ustavnog suda i da mu omogući odgodu odlaska na odsluženje kazne, ali je taj zahtjev postao bespredmetan nakon što mu je tužba odbijena.

Većina ustavnih sudaca u odluci koju je potpisao predsjednik Ustavnog suda RH Miroslav Šeparović kaže da je Lucićevo suđenje bilo u skladu s Ustavom i Europskom konvencijom o ljudskim pravima. To što nije došao na Vrhovni sud RH, iako je pozvan, je njegova osobna odluka koja nije utjecala na pravednost procesa.

Ni sa statusom novinara kao osobe kojoj je nuđeno mito ništa, po stavu većine sudaca Ustavnog suda, nema ništa sporno. Naime, status novinara protumačen je kao status "odgovorne osobe" budući da mu je Lucić nudio mito kako ne bi obavio novinarski posao.

“To je posao što ga je novinar morao obaviti kao odgovorna osoba, a Franjo Lucić tražio je da ga u zamjenu za mito ne obavi”, zaključio je Ustavni sud i odbio taj Lucićev argument.

Doduše, dvojica sudaca nisu se složila sa stavom većine. Riječ je o sucima Branku Brkiću i Miroslavu Šumanoviću koji smatraju da novinar baš nikakvim tumačenjem zakona ne može biti definiran ni kao službena ni odgovorna osoba.

“Mišljenja sam da novinari zaposleni ili ugovorno angažirani od strane trgovačkih društava koja se bave medijskom djelatnošću ne potpadaju pod opseg primjene kaznenopravnih odredaba o javnom podmićivanju s obzirom na to da se prema zakonu ne mogu smatrati odgovornim osobama jer ne obavljaju javne ovlasti

koje bi im de iure ili de facto bile povjerene. U kaznenom zakonu, naime, nedostaje adekvatna kaznena odredba na osnovi koje bi novinari podlijegali korupcijskim kaznenim djelima, primjerice kao primatelji mita ili počinitelji zlouporabe položaja ili ovlasti”, poručio je u svom izdvojenom mišljenju ustavni sudac Šumanović, piše N1..

Bivši saborski zastupnik HDZ-a Franjo Lucić nije na Ustavnom sudu uspio srušiti presudu kojom je kažnjen s godinom dana zatvora zbog podmićivanja novinara portala Telegram.hr Drage Hedla, piše N1.

Lucić je nudio Hedlu mito da ne piše o njemu. Novinar je sve to snimio i raskrinkao HDZ-ovog zastupnika. U ustavnoj tužbi Lucić je tvrdio da nije imao pravedno suđenje te opetovano isticao kako nije mogao biti osuđen za davanje mita novinaru, kad novinar nije ni službena ni odgovorna osoba. Objašnjavao je kako prema hrvatskom Kaznenom zakonu mito mogu primiti samo službene ili odgovorna osobe što novinari nisu. Nuđenje novca novinaru, prema tom Lucićevom viđenju, ne bi smjelo biti kažnjivo.

Tvrdio je i da je kažnjen prestrogo, odnosno da kazna nije razmjerna onome što je učinio. Ovdje valja podsjetiti da je najprije dobio godinu dana rada za opće dobro, ali je nakon žalbe USKOK-a ta kazna zamijenjena bezuvjetnom zatvorskom kaznom.

Lucić se žalio i na to da nije sudjelovao na sjednici Vrhovnog suda RH koji je raspravljao o žalbi USKOK-a, iako je, priznao je, dobio poziv. Nije mu se, međutim, odazvao, svjestan da kao okrivljenik ne bi imao pravo sudjelovati u raspravi. Upravo je to isticao kao propust tijekom procesa. Lucić je tražio od Ustavnog suda i da mu omogući odgodu odlaska na odsluženje kazne, ali je taj zahtjev postao bespredmetan nakon što mu je tužba odbijena.
