Nastavlja se niz pravomoćnih presuda za preplaćene kamate iz euro i kunskih kredita, pa je tako 1. rujna 2020. Županijski sud u Šibeniku potvrdio pravomoćnost presude Općinskog suda u Makarskoj, Stalne službe u Imotskom, kojom je OTP banka osuđena zbog ugovaranja ništetnih odredaba o promjenjivoj kamatnoj stopi, pa mora vratiti tužitelju potrošaču oko 90.000 kuna preplaćenih kamata, što će zajedno sa zateznim kamatama biti oko 180.000 kuna, i još mora platiti 22.000 kuna sudskih troškova. Kredit je iznosio 140.000 eura odnosno oko milijun kuna.

Priopćili su to iz udruge Franak istaknuvši kako je presudu dobio uspješni splitski odvjetnik Srđan Kalebota, poznat po čitavom nizu presuda za sve valute i vrste kredita, na temelju kojih se tužiteljima moraju vratiti preplaćeni anuiteti, bilo zbog ništetnog tečaja CHF, bilo zbog ništetnih kamata, bilo zbog nezakonito naplaćenih izlaznih naknada za prijevremenu otplatu kredita.

Ukratko navode i kako je presudom utvrđeno: da se radi o jednakom kršenju prava kao i za potrošače u kreditima s valutnom klauzulom CHF; da meritum kolektivne presude vrijedi i za eure, i za kune, mada ta presuda nije izravno primjenjiva na te kredite, pa se mora provesti dokazni postupak; da nema zastare potraživanja, jer je tako utvrdio Vrhovni sud RH, po čijem pravnom shvaćanju od 30. siječnja 2020. zastara potraživanja počinje teći tek po utvrđenju ništetnosti.

- Mi naglašavamo kako je odredba o kamatnoj stopi koja se mijenja odlukom banke ništetna i za pravne osobe, jer se radi o neodredivoj ugovornoj obvezi, koja je ništetna u skladu s člancima 269. do 272. Zakona o obveznim odnosima.
Pozivamo stoga sve potrošače i pravne osobe koji su ugovarali kredite s promjenjivom kamatnom stopom prije 2013. godine, u bilo kojoj valuti, da se jave radi potrebnih informacija o tužbama na mail adresu: franak.tuzbe@gmail.com - poručili su iz udruge Franak.

Nastavlja se niz pravomoćnih presuda za preplaćene kamate iz euro i kunskih kredita, pa je tako 1. rujna 2020. Županijski sud u Šibeniku potvrdio pravomoćnost presude Općinskog suda u Makarskoj, Stalne službe u Imotskom, kojom je OTP banka osuđena zbog ugovaranja ništetnih odredaba o promjenjivoj kamatnoj stopi, pa mora vratiti tužitelju potrošaču oko 90.000 kuna preplaćenih kamata, što će zajedno sa zateznim kamatama biti oko 180.000 kuna, i još mora platiti 22.000 kuna sudskih troškova. Kredit je iznosio 140.000 eura odnosno oko milijun kuna.

Priopćili su to iz udruge Franak istaknuvši kako je presudu dobio uspješni splitski odvjetnik Srđan Kalebota, poznat po čitavom nizu presuda za sve valute i vrste kredita, na temelju kojih se tužiteljima moraju vratiti preplaćeni anuiteti, bilo zbog ništetnog tečaja CHF, bilo zbog ništetnih kamata, bilo zbog nezakonito naplaćenih izlaznih naknada za prijevremenu otplatu kredita.

Ukratko navode i kako je presudom utvrđeno: da se radi o jednakom kršenju prava kao i za potrošače u kreditima s valutnom klauzulom CHF; da meritum kolektivne presude vrijedi i za eure, i za kune, mada ta presuda nije izravno primjenjiva na te kredite, pa se mora provesti dokazni postupak; da nema zastare potraživanja, jer je tako utvrdio Vrhovni sud RH, po čijem pravnom shvaćanju od 30. siječnja 2020. zastara potraživanja počinje teći tek po utvrđenju ništetnosti.

- Mi naglašavamo kako je odredba o kamatnoj stopi koja se mijenja odlukom banke ništetna i za pravne osobe, jer se radi o neodredivoj ugovornoj obvezi, koja je ništetna u skladu s člancima 269. do 272. Zakona o obveznim odnosima.
Pozivamo stoga sve potrošače i pravne osobe koji su ugovarali kredite s promjenjivom kamatnom stopom prije 2013. godine, u bilo kojoj valuti, da se jave radi potrebnih informacija o tužbama na mail adresu: franak.tuzbe@gmail.com - poručili su iz udruge Franak.

Županijski sud u Šibeniku potvrdio presudu Općinskog suda u Makarskoj: OTP banka mora platiti 180.000 kn preplaćenih i zateznih kamata za euro kredit

Nastavlja se niz pravomoćnih presuda za preplaćene kamate iz euro i kunskih kredita, pa je tako 1. rujna 2020. Županijski sud u Šibeniku potvrdio pravomoćnost presude Općinskog suda u Makarskoj, Stalne službe u Imotskom, kojom je OTP banka osuđena zbog ugovaranja ništetnih odredaba o promjenjivoj kamatnoj stopi, pa mora vratiti tužitelju potrošaču oko 90.000 kuna preplaćenih kamata, što će zajedno sa zateznim kamatama biti oko 180.000 kuna, i još mora platiti 22.000 kuna sudskih troškova. Kredit je iznosio 140.000 eura odnosno oko milijun kuna.

Priopćili su to iz udruge Franak istaknuvši kako je presudu dobio uspješni splitski odvjetnik Srđan Kalebota, poznat po čitavom nizu presuda za sve valute i vrste kredita, na temelju kojih se tužiteljima moraju vratiti preplaćeni ...
