Općinski prekršaji sud u Zagrebu donio je osuđujuću presudu protiv tvrtke iz Zagreba i njezine direktorice jer Fini nisu dostavili financijska izvješća za 2020. godinu.

Tvrtka ili direktorica to su trebali napraviti do 30. lipnja 2021. godine. Bilancu, račun gubitka i dobiti su mogli dostaviti u bilo kojoj poslovnici Fine ili putem internetskog sustava uz korištenje digitalnog certifikata. No, to nisu napravili.

Tako su počinili prekršaj iz Zakona o računovodstvu, a sudski postupak pokrenut će povodom prekršajnog naloga Financijske agencije.

Okrivljenici, koji do sada nisu bili osuđivani, su, kako navodi sud, priznali krivnju.

Tvrtka je dobila 2000 kuna, odnosno 265,45 eura kazne, dok je direktorica kažnjena sa samo 100 kuna ili 13,27 eura. Sud ih je oslobodio obveze naknade paušalne svote troškova sudskog postupka kako ne bi bila dovedena u pitanje njihova egzistencija.

Ako presuda postane pravomoćna, u roku tri mjeseca mogu platiti samo dvije trećine kazne kako bi se smatralo da je u ona cijelosti plaćena.

Zbog nepodnošenje financijski izvještaja Fini tri godine za redom, prije više godine su brojne tvrtke bile izbrisane iz sudskog registra. S jedne strane, vlasnici i direktori su to koristili kako bi na ta način besplatno ugasili svoje tvrtke, koji postupci zatvaranja tvrtke u redovnom postupku nikada nisu jeftini. 

Drugi vlasnici nisu imali namjeru ugasiti svoje tvrtke nepodnošenjem financijskih izvještaja jer su im se na te tvrtke vodile vrijedne nekretnine koje su onda morali preuzimati u postupcima na trgovačkim sudovima uz skupo plaćanje troškova stečajnih upravitelja koji imaju pravo na dio kupoprodajne cijene nekretnine.

Općinski prekršaji sud u Zagrebu donio je osuđujuću presudu protiv tvrtke iz Zagreba i njezine direktorice jer Fini nisu dostavili financijska izvješća za 2020. godinu.

Tvrtka ili direktorica to su trebali napraviti do 30. lipnja 2021. godine. Bilancu, račun gubitka i dobiti su mogli dostaviti u bilo kojoj poslovnici Fine ili putem internetskog sustava uz korištenje digitalnog certifikata. No, to nisu napravili.

Tako su počinili prekršaj iz Zakona o računovodstvu, a sudski postupak pokrenut će povodom prekršajnog naloga Financijske agencije.

Okrivljenici, koji do sada nisu bili osuđivani, su, kako navodi sud, priznali krivnju.

Tvrtka je dobila 2000 kuna, odnosno 265,45 eura kazne, dok je direktorica kažnjena sa samo 100 kuna ili 13,27 eura. Sud ih je oslobodio obveze naknade paušalne svote troškova sudskog postupka kako ne bi bila dovedena u pitanje njihova egzistencija.

Ako presuda postane pravomoćna, u roku tri mjeseca mogu platiti samo dvije trećine kazne kako bi se smatralo da je u ona cijelosti plaćena.

Zbog nepodnošenje financijski izvještaja Fini tri godine za redom, prije više godine su brojne tvrtke bile izbrisane iz sudskog registra. S jedne strane, vlasnici i direktori su to koristili kako bi na ta način besplatno ugasili svoje tvrtke, koji postupci zatvaranja tvrtke u redovnom postupku nikada nisu jeftini. 

Drugi vlasnici nisu imali namjeru ugasiti svoje tvrtke nepodnošenjem financijskih izvještaja jer su im se na te tvrtke vodile vrijedne nekretnine koje su onda morali preuzimati u postupcima na trgovačkim sudovima uz skupo plaćanje troškova stečajnih upravitelja koji imaju pravo na dio kupoprodajne cijene nekretnine.
