Vlada RH, HNB i trinaest banaka potpisale su memorandum o novim pravilima prekoračenja po tekućem računu.

Riječ je o onim bankama koje odobravaju prešutno prekoračenje. Memorandum omogućuje prelazak s „prešutno prihvaćenih" na „dopuštena prekoračenja" za gotovo milijun i osamsto tisuća potrošača kojima je odobreno prešutno prihvaćeno prekoračenje, javlja HRT. 

U objavi piše da će: Prelaskom na dopuštena prekoračenja, svim potrošačima će biti zajamčena niža cijena korištenja prekoračenja te postupna otplata duga u slučaju smanjenja ili ukidanja prekoračenja. Budući da se ova promjena odnosi na polovicu Hrvata, nova pravila za HRT pojasnio je viceguverner HNB-a Bojan Fras.

Viceguverner HNB-a Bojan Fras kazao je u emisiji "Studio 4" kako se na memorandumu radilo gotovo godinu dana, a potreba za njim postala je očigledna nakon nekoliko prigovora potrošača zatečenih činjenicom da su njihova dopuštena prekoračenja prenesena u prešutna prekoračenja.

- Proveli smo šire istraživanje i utvrdili da su banke od 2018. nadalje masovno migrirale svoje korisnike tekućih računa i njihove minuse iz dopuštenih prekoračenja na prešutna.

Razlika između te dvije vrste prekoračenja, objašnjava Fras, jest da se dopušteno prekoračenje ugovara otvaranjem tekućeg računa.

- Ono bolje štiti potrošače i omogućava im bolju informiranost o sadržaju njihovog odnosa s prekoračenjem te je jeftinije za potrošače od prešutnog prekoračenja, jer se na dopušteno prekoračenje primjenjuje ograničenje efektivne kamatne stope koja je sada temeljem zakona 7,31%. Kod prešutnih osiguranja ne postoji takvo ograničenje, postoji samo ograničenje maksimalne nominalne kamatne stope od 7,97%, ali na to se još dodaju bankovne naknade. Potrošači koji koriste prešutna ograničenja u prosjeku plaćaju od 2 do 3 posto višu efektivnu kamatnu stopu u odnosu na one u zoni dopuštenog prekoračenja, objašnjava.

-  Ta se zaštita najbolje manifestira u situacijama kada je banka zbog prestanka primitaka na računu dužna umanjiti iznos minusa ili ga ukinuti – kod dopuštenog prekoračenja banka je dužna potrošaču ponuditi otplatu razlike u 12 mjeseci, a kod prešutnog prekoračenja to banka nije dužna učiniti. Banke još nisu posezale za tim pravom, ali ne znamo što bi se dogodilo kad bi došlo do neke nove krizne situacije. Najvažnije za korisnike tekućih računa jest to da se iznosi odobrenih minusa, na koje su korisnici imali pravo u trenutku potpisivanja memoranduma, ne mijenjaju – ostaju identični. Banke su do 30. 6. 2023. dužne svojim korisnicima ponuditi dopušteno prekoračenje do iste visine koju i sada imaju, napominje Fras, javlja HRT.

Memorandum će također, dodaje, s namjerom zaštite potrošača, spriječiti mogućnost da se pogodnosti ugovorene tim memorandumom u korist potrošača zapravo ne dovedu u pitanje mogućnošću da banka proda dug potrošača nekoj agenciji za naplatu potraživanja.

Objašnjava kako su banke dužne svojim potrošačima i korisnicima prekoračenja na tekućim računima ponuditi u istoj visini dopušteno prekoračenje, kao i kombinaciju novog dopuštenog i novog prešutnog prekoračenja – uz određena pravila.

- Koncepti ova dva prekoračenja su komplementarni. Nadopunjavaju se na način da se prvenstveno odobrava dopušteno prekoračenje koje je redovni oblik prekoračenja. Povrh njega bi se eventualno moglo još nadodati prešutno prekoračenje za neke klijente ili situacije. Prvo pravilo je da, kada banka nudi novo dopušteno prekoračenje, do visine prešutnog prekoračenja koje klijent sada uživa, banka mora najmanje polovicu tog iznosa dati u dopuštenom prekoračenju. Drugo pravilo je da iznos prešutnog prekoračenja u kombiniranom prekoračenju može iznositi najviše jedno mjesečno primanje.

Već od 1. rujna ove godine banke će početi s primjenom ograničenja efektivne kamatne stope na postojeća prešutna prekoračenja. To u praksi znači jednu od dvije najvažnije pogodnosti predviđene memorandumom, kaže Fras.

- Potrošač će od 1. rujna početi za svoja postojeća prešutna prekoračenja odmah početi uživati nižu efektivnu kamatnu stopu, i to će za građane biti jeftinije. Ostalo će trajati određeno razdoblje.

Nova pravila su na stolu. Memorandum banaka, HNB-a, Vlade i Ministarstva financija potpisan. Sad je vrijeme za vaš individualni konačni obračun. Nekima se vjerojatno neće svidjeti novo ograničenje „života na dug". Drugi već sad strepe kako će podmiriti razliku, javlja HRT.

Riječ je o onim bankama koje odobravaju prešutno prekoračenje. Memorandum omogućuje prelazak s „prešutno prihvaćenih" na „dopuštena prekoračenja" za gotovo milijun i osamsto tisuća potrošača kojima je odobreno prešutno prihvaćeno prekoračenje, javlja HRT. 

U objavi piše da će: Prelaskom na dopuštena prekoračenja, svim potrošačima će biti zajamčena niža cijena korištenja prekoračenja te postupna otplata duga u slučaju smanjenja ili ukidanja prekoračenja. Budući da se ova promjena odnosi na polovicu Hrvata, nova pravila za HRT pojasnio je viceguverner HNB-a Bojan Fras.

Viceguverner HNB-a Bojan Fras kazao je u emisiji "Studio 4" kako se na memorandumu radilo gotovo godinu dana, a potreba za njim postala je očigledna nakon nekoliko prigovora potrošača zatečenih činjenicom da su njihova dopuštena prekoračenja prenesena u prešutna prekoračenja.

- Proveli smo šire istraživanje i utvrdili da su banke od 2018. nadalje masovno migrirale svoje korisnike tekućih računa i njihove minuse iz dopuštenih prekoračenja na prešutna.

Razlika između te dvije vrste prekoračenja, objašnjava Fras, jest da se dopušteno prekoračenje ugovara otvaranjem tekućeg računa.

- Ono bolje štiti potrošače i omogućava im bolju informiranost o sadržaju njihovog odnosa s prekoračenjem te je jeftinije za potrošače od prešutnog prekoračenja, jer se na dopušteno prekoračenje primjenjuje ograničenje efektivne kamatne stope koja je sada temeljem zakona 7,31%. Kod prešutnih osiguranja ne postoji takvo ograničenje, postoji samo ograničenje maksimalne nominalne kamatne stope od 7,97%, ali na to se još dodaju bankovne naknade. Potrošači koji koriste prešutna ograničenja u prosjeku plaćaju od 2 do 3 posto višu efektivnu kamatnu stopu u odnosu na one u zoni dopuštenog prekoračenja, objašnjava.

-  Ta se zaštita najbolje manifestira u situacijama kada je banka zbog prestanka primitaka na računu dužna umanjiti iznos minusa ili ga ukinuti – kod dopuštenog prekoračenja banka je dužna potrošaču ponuditi otplatu razlike u 12 mjeseci, a kod prešutnog prekoračenja to banka nije dužna učiniti. Banke još nisu posezale za tim pravom, ali ne znamo što bi se dogodilo kad bi došlo do neke nove krizne situacije. Najvažnije za korisnike tekućih računa jest to da se iznosi odobrenih minusa, na koje su korisnici imali pravo u trenutku potpisivanja memoranduma, ne mijenjaju – ostaju identični. Banke su do 30. 6. 2023. dužne svojim korisnicima ponuditi dopušteno prekoračenje do iste visine koju i sada imaju, napominje Fras, javlja HRT.

Memorandum će također, dodaje, s namjerom zaštite potrošača, spriječiti mogućnost da se pogodnosti ugovorene tim memorandumom u korist potrošača zapravo ne dovedu u pitanje mogućnošću da banka proda dug potrošača nekoj agenciji za naplatu potraživanja.

Objašnjava kako su banke dužne svojim potrošačima i korisnicima prekoračenja na tekućim računima ponuditi u istoj visini dopušteno prekoračenje, kao i kombinaciju novog dopuštenog i novog prešutnog prekoračenja – uz određena pravila.

- Koncepti ova dva prekoračenja su komplementarni. Nadopunjavaju se na način da se prvenstveno odobrava dopušteno prekoračenje koje je redovni oblik prekoračenja. Povrh njega bi se eventualno moglo još nadodati prešutno prekoračenje za neke klijente ili situacije. Prvo pravilo je da, kada banka nudi novo dopušteno prekoračenje, do visine prešutnog prekoračenja koje klijent sada uživa, banka mora najmanje polovicu tog iznosa dati u dopuštenom prekoračenju. Drugo pravilo je da iznos prešutnog prekoračenja u kombiniranom prekoračenju može iznositi najviše jedno mjesečno primanje.

Već od 1. rujna ove godine banke će početi s primjenom ograničenja efektivne kamatne stope na postojeća prešutna prekoračenja. To u praksi znači jednu od dvije najvažnije pogodnosti predviđene memorandumom, kaže Fras.

- Potrošač će od 1. rujna početi za svoja postojeća prešutna prekoračenja odmah početi uživati nižu efektivnu kamatnu stopu, i to će za građane biti jeftinije. Ostalo će trajati određeno razdoblje.

Nova pravila su na stolu. Memorandum banaka, HNB-a, Vlade i Ministarstva financija potpisan. Sad je vrijeme za vaš individualni konačni obračun. Nekima se vjerojatno neće svidjeti novo ograničenje „života na dug". Drugi već sad strepe kako će podmiriti razliku, javlja HRT.
