Europski sud za ljudska prava objavio je presudu kojom je utvrdio da je Hrvatska povrijedila prava Trajektne luke Split zbog načina vođenja postupka pred Ustavnim sudom koji je ukinuo presude Upravnog suda povoljne za tu tvrtku.
Ured hrvatske predstavnice pred sudom u Strasbourgu izvijestio je kako se glavno pitanje u tom ustavno-sudskom postupku odnosilo na opseg prioritetne koncesije za obavljanje nekoliko lučkih djelatnosti na koju su bivša društvena poduzeća, poput Trajektne luke Split, imala pravo temeljem Zakona o morskim lukama.
Trajektna luka Split prigovorila je pred Europskim sudom povredi načela jednakosti stranaka i kontradiktornosti postupka, nedostatku usmene rasprave pred Visokim upravnim sudom kao i povredi načela jednakosti stranaka pred Ustavnim sudom. Prigovorili su i povredi prava na mirno uživanje vlasništva zbog odluka hrvatskih sudova koje su donijeli u tim postupcima.

Europski sud je primijetio da ustavne tužbe Lučke uprave nikada nisu bile dostavljene Trajektnoj luci Split te da Ustavni sud nije izričito odgovorio na ključne prigovore o dopuštenosti ustavne tužbe Lučke uprave već je razmatranja o tome pridružio razmatranju o meritumu spora, što nije u skladu sa praksom Europskog suda, stoji u priopćenju.
Stoga je Europski sud utvrdio povredu Konvencije o zaštiti ljudskih prava i temeljnih sloboda. Nije smatrao potrebnim baviti se daljnjim prigovorima u vezi sa stadijem domaćeg postupka pred Visokim upravnim sudom.

U odnosu na pitanje prava vlasništva, sud je napomenuo da, iako se koncesija može smatrati „posjedom“ Trajektnoj luci Split nikada nije niti jednom odlukom dodijeljena prioritetna koncesija željenog opsega.
Budući da u ovom slučaju postoji spor o ispravnom tumačenju i primjeni domaćeg prava, ne može se smatrati da zahtjev ima dovoljnu osnovu u domaćem pravu pa je taj dio zahtjeva društva podnositelja Europski sud odbacio kao nedopušten, priopćio je ured.
Europski sud nije dosudio naknadu štete i sudskih troškova zbog povrede Konvencije, a presuda je konačna.

Europski sud za ljudska prava objavio je presudu kojom je utvrdio da je Hrvatska povrijedila prava Trajektne luke Split zbog načina vođenja postupka pred Ustavnim sudom koji je ukinuo presude Upravnog suda povoljne za tu tvrtku.
Ured hrvatske predstavnice pred sudom u Strasbourgu izvijestio je kako se glavno pitanje u tom ustavno-sudskom postupku odnosilo na opseg prioritetne koncesije za obavljanje nekoliko lučkih djelatnosti na koju su bivša društvena poduzeća, poput Trajektne luke Split, imala pravo temeljem Zakona o morskim lukama.
Trajektna luka Split prigovorila je pred Europskim sudom povredi načela jednakosti stranaka i kontradiktornosti postupka, nedostatku usmene rasprave pred Visokim upravnim sudom kao i povredi načela jednakosti stranaka pred Ustavnim sudom. Prigovorili su i povredi prava na mirno uživanje vlasništva zbog odluka hrvatskih sudova koje su donijeli u tim postupcima.

Europski sud je primijetio da ustavne tužbe Lučke uprave nikada nisu bile dostavljene Trajektnoj luci Split te da Ustavni sud nije izričito odgovorio na ključne prigovore o dopuštenosti ustavne tužbe Lučke uprave već je razmatranja o tome pridružio razmatranju o meritumu spora, što nije u skladu sa praksom Europskog suda, stoji u priopćenju.
Stoga je Europski sud utvrdio povredu Konvencije o zaštiti ljudskih prava i temeljnih sloboda. Nije smatrao potrebnim baviti se daljnjim prigovorima u vezi sa stadijem domaćeg postupka pred Visokim upravnim sudom.

U odnosu na pitanje prava vlasništva, sud je napomenuo da, iako se koncesija može smatrati „posjedom“ Trajektnoj luci Split nikada nije niti jednom odlukom dodijeljena prioritetna koncesija željenog opsega.
Budući da u ovom slučaju postoji spor o ispravnom tumačenju i primjeni domaćeg prava, ne može se smatrati da zahtjev ima dovoljnu osnovu u domaćem pravu pa je taj dio zahtjeva društva podnositelja Europski sud odbacio kao nedopušten, priopćio je ured.
Europski sud nije dosudio naknadu štete i sudskih troškova zbog povrede Konvencije, a presuda je konačna.
