Visoki upravni sud Republike Hrvatske ukinuo je pravilnik kojim su povećane cijene najamnina javne površine u Splitu koji je stupio na snagu 1. travnja 2022. godine.
Udruga ugostitelja Split podnijela je zahtjev za ocjenu zakonitosti Pravilnika o određivanju visine zakupnine/naknade, zonama i načinu korištenja javnih površina za postavljanje kioska, štekata, štandova, pokretnih naprava i drugoga na području Grada Splita koji je donio gradonačelnik Ivica Puljak.
Prvi problem je, stoji u obrazloženju presude, što je pravilnik donio gradonačelnik umjesto Gradskog vijeća, a drugi što je donesen na temelju odluke koja je prestala važiti.
- Pravilnik je donesen na temelju odluke koja je prestala važiti. Dakle, pravni temelj za donošenje spornog Pravilnika preosta je važiti, stoga se sporni pravilnik ne može ocijeniti zakonitim te ga je trebalo temeljem odredbe članka 86. stavka 3. ZUS-a u cijelosti ukinuti - stoji u obrazloženju.
Podsjetimo, vijećnica iz redova Mosta Ivana Ljulj Cvitanić u veljači ove godine upozoravala je na problematičnost donošenja ovog pravilnika baš iz razloga što ga nije donio lokalni parlament. Istaknula je tada, da ni bivši gradonačelnik Andro Krstulović Opara, nije smio samostalno donijeti tu odluku.

- Upozoravala sam u najboljoj namjeri na nezakonitost takve prakse postupanja. Takve primjedbe iznosile su i zainteresirane strane kroz postupak javnog savjetovanja tako da je bilo očekivano da će netko predložiti postupak ocjene zakonitosti. Upravo iz tog razloga nisam iznenađena ovim ishodom. Sada očekujem da gradska vlast i službe pronađu rješenje za izlaz iz ove situacije - kazala nam je Ljulj Cvitanić.
Dogradonačelnik Bojan Ivošević nam je kazao da nisu službeno zaprimili presudu, ali da je pravilnik donesen na isti način kao i u mandatu Andre Krstulovića Opare.

- Ako sud kaže da pravilnik mora donijeti Gradsko vijeće, predložit ćemo to na sjednici - kazao nam je Ivošević.
No, vjerujemo da će pravilnik kada dođe pred Gradske vijećnike proći bez velikih problema s obzirom da vladajući imaju 15 ruku i nedostaje im samo jedna za većinu.

Visoki upravni sud Republike Hrvatske ukinuo je pravilnik kojim su povećane cijene najamnina javne površine u Splitu koji je stupio na snagu 1. travnja 2022. godine.
Udruga ugostitelja Split podnijela je zahtjev za ocjenu zakonitosti Pravilnika o određivanju visine zakupnine/naknade, zonama i načinu korištenja javnih površina za postavljanje kioska, štekata, štandova, pokretnih naprava i drugoga na području Grada Splita koji je donio gradonačelnik Ivica Puljak.
Prvi problem je, stoji u obrazloženju presude, što je pravilnik donio gradonačelnik umjesto Gradskog vijeća, a drugi što je donesen na temelju odluke koja je prestala važiti.
- Pravilnik je donesen na temelju odluke koja je prestala važiti. Dakle, pravni temelj za donošenje spornog Pravilnika preosta je važiti, stoga se sporni pravilnik ne može ocijeniti zakonitim te ga je trebalo temeljem odredbe članka 86. stavka 3. ZUS-a u cijelosti ukinuti - stoji u obrazloženju.
Podsjetimo, vijećnica iz redova Mosta Ivana Ljulj Cvitanić u veljači ove godine upozoravala je na problematičnost donošenja ovog pravilnika baš iz razloga što ga nije donio lokalni parlament. Istaknula je tada, da ni bivši gradonačelnik Andro Krstulović Opara, nije smio samostalno donijeti tu odluku.

- Upozoravala sam u najboljoj namjeri na nezakonitost takve prakse postupanja. Takve primjedbe iznosile su i zainteresirane strane kroz postupak javnog savjetovanja tako da je bilo očekivano da će netko predložiti postupak ocjene zakonitosti. Upravo iz tog razloga nisam iznenađena ovim ishodom. Sada očekujem da gradska vlast i službe pronađu rješenje za izlaz iz ove situacije - kazala nam je Ljulj Cvitanić.
Dogradonačelnik Bojan Ivošević nam je kazao da nisu službeno zaprimili presudu, ali da je pravilnik donesen na isti način kao i u mandatu Andre Krstulovića Opare.

- Ako sud kaže da pravilnik mora donijeti Gradsko vijeće, predložit ćemo to na sjednici - kazao nam je Ivošević.
No, vjerujemo da će pravilnik kada dođe pred Gradske vijećnike proći bez velikih problema s obzirom da vladajući imaju 15 ruku i nedostaje im samo jedna za većinu.
