Suvlasnici, stanari i korisnici nekretnina uokolo ograđenog gradilišta na vrhu pazara uputili su priopćenje javnosti u kojem navoda da je "Small Mall - rupa dubine 20 metara do vrha puna nejasnoća".
- Realna mogućnost i osnovana bojazan da prilikom izgradnje najavljivanog Small Malla dođe do oštećenja okolnih stambenih zgrada prilikom iskopavanja 20 metara duboke građevinske jame uz same temelje postojećih zgrada, istaknula je u podnesku i sama tvrtka Small Mall u postupku osiguranja dokaza i očevida. Riziku od potencijalne štete za ljude i imovinu treba pridodati mnogobrojne pravne i financijske nejasnoće.

- U izvanparničnom postupku Općinski sud u Splitu pozvao je sveukupno 116 suvlasnika i Grad Split kako bi se osigurali dokazi i izvršio očevid, sve prije početka građevinskih radova. Uz tih 116 suvlasnika dolazi na stotine članova njihovih obitelji i poslovnih korisnika. U tom postupku su složni stanari privremeno zaustavili Small Mall pozivajući se na činjenicu da investitor nema aktivnu legitimaciju.
- Radi ovakvih okolnosti, stanari su se ponovno okupili dana 10. srpnja 2023. godine u Kotaru Lučac Manuš, kako bi temeljito razgovarali o vlastitoj sigurnosti i sigurnosti svojih nekretnina.
- Stanare brine i straši što investitor s minimalnim temeljnim kapitalom nije pružio valjane dokaze o financijskoj sposobnosti da nadoknadi višestruku štetu koju bi ova izgradnja mogla uzrokovati. Sveukupna vrijednost potencijalne štete može doseći iznos neusporedivo veći od iznosa zamišljene realizacije.

- Još više čudi i baca sumnju na zakonitost cjelokupne investicije činjenica da se Stanouprava, tvrtka u javnom vlasništvu, ujedno upravitelj većine okolnih zgrada, nije odazvala na pozive suvlasnika da zaštiti stanarske interese, što je bila dužna učiniti prema međuvlasničkom ugovoru. Radi ovakvog postupanja, odnosno nepostupanja Stanouprave, stanari su prisiljeni sami angažirati nezavisni odvjetnički ured putem kojeg će poduzeti sve moguće radnje kako bi se osigurala zakonitost ove investicije, kao i konkretna garancija suvlasnicima okolnih zgrada.
- Stanari i suvlasnici su i ovaj put složni ići do kraja u zaštiti zajedničkog prostora.
U ime većine suvlasnika, stanara i drugih korisnika, a uoči današnje javne prezentacije, priopćenje za medije potpisuje Mariana Bucat, sudska vještakinja za arhitekturu i procjenu nekretnina.

Suvlasnici, stanari i korisnici nekretnina uokolo ograđenog gradilišta na vrhu pazara uputili su priopćenje javnosti u kojem navoda da je "Small Mall - rupa dubine 20 metara do vrha puna nejasnoća".
- Realna mogućnost i osnovana bojazan da prilikom izgradnje najavljivanog Small Malla dođe do oštećenja okolnih stambenih zgrada prilikom iskopavanja 20 metara duboke građevinske jame uz same temelje postojećih zgrada, istaknula je u podnesku i sama tvrtka Small Mall u postupku osiguranja dokaza i očevida. Riziku od potencijalne štete za ljude i imovinu treba pridodati mnogobrojne pravne i financijske nejasnoće.

- U izvanparničnom postupku Općinski sud u Splitu pozvao je sveukupno 116 suvlasnika i Grad Split kako bi se osigurali dokazi i izvršio očevid, sve prije početka građevinskih radova. Uz tih 116 suvlasnika dolazi na stotine članova njihovih obitelji i poslovnih korisnika. U tom postupku su složni stanari privremeno zaustavili Small Mall pozivajući se na činjenicu da investitor nema aktivnu legitimaciju.
- Radi ovakvih okolnosti, stanari su se ponovno okupili dana 10. srpnja 2023. godine u Kotaru Lučac Manuš, kako bi temeljito razgovarali o vlastitoj sigurnosti i sigurnosti svojih nekretnina.
- Stanare brine i straši što investitor s minimalnim temeljnim kapitalom nije pružio valjane dokaze o financijskoj sposobnosti da nadoknadi višestruku štetu koju bi ova izgradnja mogla uzrokovati. Sveukupna vrijednost potencijalne štete može doseći iznos neusporedivo veći od iznosa zamišljene realizacije.

- Još više čudi i baca sumnju na zakonitost cjelokupne investicije činjenica da se Stanouprava, tvrtka u javnom vlasništvu, ujedno upravitelj većine okolnih zgrada, nije odazvala na pozive suvlasnika da zaštiti stanarske interese, što je bila dužna učiniti prema međuvlasničkom ugovoru. Radi ovakvog postupanja, odnosno nepostupanja Stanouprave, stanari su prisiljeni sami angažirati nezavisni odvjetnički ured putem kojeg će poduzeti sve moguće radnje kako bi se osigurala zakonitost ove investicije, kao i konkretna garancija suvlasnicima okolnih zgrada.
- Stanari i suvlasnici su i ovaj put složni ići do kraja u zaštiti zajedničkog prostora.
U ime većine suvlasnika, stanara i drugih korisnika, a uoči današnje javne prezentacije, priopćenje za medije potpisuje Mariana Bucat, sudska vještakinja za arhitekturu i procjenu nekretnina.
