Udruga ”Vlasnici zemljišta na Marjanu” je putem odvjetnika Tomislava Krke 6. studenog podigla tužbu protiv Splitsko-dalmatinske županije jer se nije očitovala o prijedlogu odluke da se promijeni granica park-šume Marjan poslanog 19. travnja, potvrdio nam je Krka.
- Nisu odgovorili u roku od 30 dana zato smo i podignuli tužbu. Županija je morala utvrditi što spada u zaštitu prirode, a to je šumsko zemljište koje se definira prema Zakonu o šumama kao zasađeno ili niklo zemljište koje služi za odmor i rekreaciju. Zakonom o zaštiti prirode šumsko zemljište mora biti zaštićeno, a ne poljoprivredno zemljište, vinogradi, maslinici vrtovi - kazao nam je.

Odvjetnik navodi kako je na sjevernoj strani Marjana šumsko zemljište, a na južnoj postoji 505 parcela koje su poljoprivredna zemljišta na koja su upisani privatni vlasnici, a u naravi su vinogradi, maslinici, vrtovi....
- Obje strane Marjana 1964. postaju zaštićeno područje što je potvrđeno 1988. Društveno vlasništvo se ukida 1991. i na poljoprivredna zemljišta se upisuju privatni vlasnici. Županija je po Zakonu o zaštiti prirode morala u roku od godine dana utvrditi granice šumskog zemljišta i Skupštini naložiti osnivanje Ustanove za upravljanje šumskim zemljištem. To su bili zahtjevi udruge.
Županija je mogla prenijeti pravo na Grad Split, ali to nije napravila zbog čega ustanova koja je nastavila s upravljanjem to čini protuzakonito, navodi Krka.

- Očekujemo da Visoki upravni sud kaže Županiji da jedini nisu uskladili akte sa Zakonom o zaštiti prirode jer su granice utvrđene prema zakonima iz SFRJ, a ne iz RH. Županija je bila dužna utvrditi nove granice i osnovati ustanovu za upravljanje ili prenijeti pravo na Grad, ali nije napravila ništa, nego je pustila ustanovi Grada koja za to nije ovlaštena da to stihijski obavlja.
Na navode o tome kako ih se naziva ”ilegalnim vlasnicima”, odvjetnik Krka je odgovorio kako je mišljenje da će ”graditi vile” krivo.
- Oni ne mogu graditi vile jer je GUP-om i DPU-om zabranjena gradnja. Pitanje gradnja je regulirano Zakonom o građenju. Ne smiju ni obrađivati ni kositi travu, saditi masline bez odobrenja županijske skupštine. To je poljoprivredno zemljište gdje se može staviti voda, alate za obradu. Grad ima čestice u svom vlasništvu kao i ceste na Marjanu – zaključuje Tomislav Krka.

Udruga ”Vlasnici zemljišta na Marjanu” je putem odvjetnika Tomislava Krke 6. studenog podigla tužbu protiv Splitsko-dalmatinske županije jer se nije očitovala o prijedlogu odluke da se promijeni granica park-šume Marjan poslanog 19. travnja, potvrdio nam je Krka.
- Nisu odgovorili u roku od 30 dana zato smo i podignuli tužbu. Županija je morala utvrditi što spada u zaštitu prirode, a to je šumsko zemljište koje se definira prema Zakonu o šumama kao zasađeno ili niklo zemljište koje služi za odmor i rekreaciju. Zakonom o zaštiti prirode šumsko zemljište mora biti zaštićeno, a ne poljoprivredno zemljište, vinogradi, maslinici vrtovi - kazao nam je.

Odvjetnik navodi kako je na sjevernoj strani Marjana šumsko zemljište, a na južnoj postoji 505 parcela koje su poljoprivredna zemljišta na koja su upisani privatni vlasnici, a u naravi su vinogradi, maslinici, vrtovi....
- Obje strane Marjana 1964. postaju zaštićeno područje što je potvrđeno 1988. Društveno vlasništvo se ukida 1991. i na poljoprivredna zemljišta se upisuju privatni vlasnici. Županija je po Zakonu o zaštiti prirode morala u roku od godine dana utvrditi granice šumskog zemljišta i Skupštini naložiti osnivanje Ustanove za upravljanje šumskim zemljištem. To su bili zahtjevi udruge.
Županija je mogla prenijeti pravo na Grad Split, ali to nije napravila zbog čega ustanova koja je nastavila s upravljanjem to čini protuzakonito, navodi Krka.

- Očekujemo da Visoki upravni sud kaže Županiji da jedini nisu uskladili akte sa Zakonom o zaštiti prirode jer su granice utvrđene prema zakonima iz SFRJ, a ne iz RH. Županija je bila dužna utvrditi nove granice i osnovati ustanovu za upravljanje ili prenijeti pravo na Grad, ali nije napravila ništa, nego je pustila ustanovi Grada koja za to nije ovlaštena da to stihijski obavlja.
Na navode o tome kako ih se naziva ”ilegalnim vlasnicima”, odvjetnik Krka je odgovorio kako je mišljenje da će ”graditi vile” krivo.
- Oni ne mogu graditi vile jer je GUP-om i DPU-om zabranjena gradnja. Pitanje gradnja je regulirano Zakonom o građenju. Ne smiju ni obrađivati ni kositi travu, saditi masline bez odobrenja županijske skupštine. To je poljoprivredno zemljište gdje se može staviti voda, alate za obradu. Grad ima čestice u svom vlasništvu kao i ceste na Marjanu – zaključuje Tomislav Krka.
Poslali smo upit Javnoj ustanovi da nam komentira ovaj potez vlasnika zemljišta, odgovor ćemo objaviti čim ga dobijemo.
