Nastavlja se agonija trojice naših sugrađana koji su jednom već platili stanove u zgradi Lazarica za koje Trgovački sud u Splitu inzistira da se ponovo prodaju zbog stečaja tvrtke "Atrium Spalatum".

U javnost je do sada izišao Pavle Đonlić koji nam je nedavno ispričao kako je, dok je radio u Njemačkoj, platio stan i poslovni prostor u Lazarici. 

Kada smo upitali Trgovački sud u Splitu zbog čega ne pričekaju da trojica naših sugrađana završe parnice protiv "Atrium Spalatuma" u stečaju, kako bi na sudu dokazali da su svoje nekretnine platili, predsjednica suda odgovorila je da oni te nekretnine nisu platili u cijelosti, ali da im je iznos koji jesu uplatili priznat kao potraživanje.

Stoga smo o tom slučaju pitali Tomislava Bausa koji je do otvaranja stečaja 2015. godine bio vlasnik i direktor "Atrium Spalatuma". 

– Uopće nije sporno da je Pavle Đonlić u cijelosti sve platio, inače mu ne bih dao ključeve i uveo ga u posjed. Ono o čemu sud govori je to da stan nije knjigovodstveno zatvoren – kaže nam Tomislav Baus, te objašnjava:

– Stan ili poslovni prostor možete knjigovodstveno zatvoriti onoga trenutka kada objekt prođe tehnički pregled, dobije uporabnu dozvolu, potpišete kupoprodajni ugovor za nekretninu i predate je kupcu.

Do potpisivanja ugovora, sve što kupac uplati po predugovoru u knjigovodstvu se vodi kao predujam. I sama stečajna upraviteljica je nakon otvaranja stečaja kazala da na računu ima između 30 milijuna i 40 milijuna kuna uplaćenog predujma.

Baus napominje da je Lazarica 2012. dobila uporabnu dozvolu.

– Nakon toga pa do otvaranja stečaja nad tvrtkom "Atrium Spalatum", Đonlić nije potpisao ugovor jer je radio u Njemačkoj. No, nije sporno da je on vlasnik stana i da je sve platio. Naime, sud govori o tome da stan nije zatvoren u knjigovodstvu firme.

Znači, kupci su uplaćivali po predugovorima i Baus je to knjižio kao predujam. 

– Onog trenutka kad kupac potpiše kupoprodajni ugovor, ja iz tog predujma zatvaram kupoprodajnu cijenu. U slučaju Đonlića koji nije stigao potpisati kupoprodajni ugovor prije otvaranja stečaja, njegov stan nikada nije knjigovodstveno zatvoren. To je pozicija o kojoj sud govori. To ne znači da Đonlić nije sve platio – naglašava Baus.

Đonliću je Trgovački sud u Splitu zadao još jedan udarac kada je po drugi put odbio donijeti privremenu mjeru zabrane prodaje njegova stana dok se ne završi parnica. U toj parnici od "Atrium Spalatuma" u stečaju traži da mu izda tabularnu prijavu na osnovi koje bi se uknjižio kao vlasnik strana.

Također, od tvrtke "Adriatic Assets", koja je otkupila potraživanja banke prema "Atrium Spalatumu" u stečaju, traži ispravu na temelju koje bi se skinula hipoteka s njegova stana.

Taj predmet otkriva da je Đonlić jedan od brojnih naših sugrađana koji su svojim uplatama investitorima sufinancirali izgradnju stambeno-poslovnih objekata.

Još 1997. godine uplatio je 500 tisuća njemačkih maraka trojici tadašnjih investitora Lazarice, i to za financiranje pripremnih radnji za izgradnju tog objekta na Firulama, te je za to dobio priznanicu. Zauzvrat je trebao dobiti stan i poslovni prostor. Koji točno stan i poslovni prostor definirano je predugovorom 2003. godine.

Dok je Visokom trgovačkom sudu bilo jasno da je uobičajena praksa da kupci stanova investitorima sufinanciraju gradnju svojih stanova, te je uputio Trgovački sud u Splitu da donese privremenu mjeru, splitskom sudu opisano sufinanciranje gradnje od kupaca stanova nije "životno ni logično", pa je odbio donijeti privremenu mjeru zabrane prodaje stana, koju je taj isti sud naložio.

Nastavlja se agonija trojice naših sugrađana koji su jednom već platili stanove u zgradi Lazarica za koje Trgovački sud u Splitu inzistira da se ponovo prodaju zbog stečaja tvrtke "Atrium Spalatum".

U javnost je do sada izišao Pavle Đonlić koji nam je nedavno ispričao kako je, dok je radio u Njemačkoj, platio stan i poslovni prostor u Lazarici. 

Kada smo upitali Trgovački sud u Splitu zbog čega ne pričekaju da trojica naših sugrađana završe parnice protiv "Atrium Spalatuma" u stečaju, kako bi na sudu dokazali da su svoje nekretnine platili, predsjednica suda odgovorila je da oni te nekretnine nisu platili u cijelosti, ali da im je iznos koji jesu uplatili priznat kao potraživanje.

Stoga smo o tom slučaju pitali Tomislava Bausa koji je do otvaranja stečaja 2015. godine bio vlasnik i direktor "Atrium Spalatuma". 

– Uopće nije sporno da je Pavle Đonlić u cijelosti sve platio, inače mu ne bih dao ključeve i uveo ga u posjed. Ono o čemu sud govori je to da stan nije knjigovodstveno zatvoren – kaže nam Tomislav Baus, te objašnjava:

– Stan ili poslovni prostor možete knjigovodstveno zatvoriti onoga trenutka kada objekt prođe tehnički pregled, dobije uporabnu dozvolu, potpišete kupoprodajni ugovor za nekretninu i predate je kupcu.

Do potpisivanja ugovora, sve što kupac uplati po predugovoru u knjigovodstvu se vodi kao predujam. I sama stečajna upraviteljica je nakon otvaranja stečaja kazala da na računu ima između 30 milijuna i 40 milijuna kuna uplaćenog predujma.

Baus napominje da je Lazarica 2012. dobila uporabnu dozvolu.

– Nakon toga pa do otvaranja stečaja nad tvrtkom "Atrium Spalatum", Đonlić nije potpisao ugovor jer je radio u Njemačkoj. No, nije sporno da je on vlasnik stana i da je sve platio. Naime, sud govori o tome da stan nije zatvoren u knjigovodstvu firme.

Znači, kupci su uplaćivali po predugovorima i Baus je to knjižio kao predujam. 

– Onog trenutka kad kupac potpiše kupoprodajni ugovor, ja iz tog predujma zatvaram kupoprodajnu cijenu. U slučaju Đonlića koji nije stigao potpisati kupoprodajni ugovor prije otvaranja stečaja, njegov stan nikada nije knjigovodstveno zatvoren. To je pozicija o kojoj sud govori. To ne znači da Đonlić nije sve platio – naglašava Baus.

Đonliću je Trgovački sud u Splitu zadao još jedan udarac kada je po drugi put odbio donijeti privremenu mjeru zabrane prodaje njegova stana dok se ne završi parnica. U toj parnici od "Atrium Spalatuma" u stečaju traži da mu izda tabularnu prijavu na osnovi koje bi se uknjižio kao vlasnik strana.

Također, od tvrtke "Adriatic Assets", koja je otkupila potraživanja banke prema "Atrium Spalatumu" u stečaju, traži ispravu na temelju koje bi se skinula hipoteka s njegova stana.

Taj predmet otkriva da je Đonlić jedan od brojnih naših sugrađana koji su svojim uplatama investitorima sufinancirali izgradnju stambeno-poslovnih objekata.

Još 1997. godine uplatio je 500 tisuća njemačkih maraka trojici tadašnjih investitora Lazarice, i to za financiranje pripremnih radnji za izgradnju tog objekta na Firulama, te je za to dobio priznanicu. Zauzvrat je trebao dobiti stan i poslovni prostor. Koji točno stan i poslovni prostor definirano je predugovorom 2003. godine.

Dok je Visokom trgovačkom sudu bilo jasno da je uobičajena praksa da kupci stanova investitorima sufinanciraju gradnju svojih stanova, te je uputio Trgovački sud u Splitu da donese privremenu mjeru, splitskom sudu opisano sufinanciranje gradnje od kupaca stanova nije "životno ni logično", pa je odbio donijeti privremenu mjeru zabrane prodaje stana, koju je taj isti sud naložio.
