Iako je još krajem siječnja ove godine inspekcija Ministarstva prometa izdala rješenje prema kojem "Hrvatske ceste" (HC) moraju u roku od 30 dana riješiti problem štandova, štekata i kioska na Domagojevoj obali, to se još nije dogodilo i pitanje je kad će i tko rješavati taj gorući komunalni problem.
U tom je inspekcijskom rješenju stajalo da HC na potezu od Pothodnika do autobusnog kolodvora mora odrediti granice državne ceste i poduzeti "upravno-tehničke mjere uklanjanja štandova, štekata i kioska s ceste postavljenih na pješačkoj stazi, odnosno uzdignutom nogostupu bez suglasnosti i uvjeta upravljača ceste".
Državna tvrtka žalila se Upravnom sudu u Splitu tražeći da se to rješenje poništi, jer oni ne održavaju nogostup uz Domagojevu obalu, odnosno taj dio na koji su već desetljećima postavljena prodajna mjesta koja, prema inspektorskim navodima, ometaju pješačku komunikaciju. Upravni sud nepravomoćno je odlučio da je inspekcijsko rješenje - ništavno. Na to, naravno, postoji pravo žalbe, pa je sigurno da će se trakavica nastaviti.
Milijunske tužbe
Iz HC-a su u tužbi tvrdili i da su na jednom sastanku predstavnici Grada izjavili kako upravo lokalna vlast "temeljem Zakona o komunalnom gospodarstvu i Zakona o cestama kontinuirano ugovara zakup predmetnih površina i održava nogostup te prometnice".
- Ako bismo postupili po inspekcijskom rješenju, bili bismo možebitno izloženi teškoj i nepopravljivoj šteti jer bi vlasnici štandova, štekata i kioska koji su do 31. prosinca 2019. imali sklopljene ugovore o zakupu s Gradom podnijeli milijunske tužbe radi naknade štete - naglasili su iz državne tvrtke.
Spomenimo i da od tog datuma, po izjavama predstavnika Grada danih inspekciji, nitko od vlasnika poslovnih objekata nema sklopljen ugovor s Banovinom o zakupu javne površine, što znači da svi ti štekati, kiosci i štandovi već više od devet mjeseci ilegalno rade.

"Hrvatske ceste", dakle, smatraju da nisu odgovorne za nered na tom dijelu Istočne obale nego da je odgovornost na Gradu. Promatrajući stvar laički, teško je ne donijeti isti zaključak. Jer ako već lokalna vlast daje prostor u zakup i ubire novac za to, kako onda nije odgovorna za sređivanje tog nereda?
Ministarstvo je u svojem odgovoru na tužbu i tijekom postupka ustvrdilo da se u ovom slučaju ne radi o održavanju pješačke staze, već o zaposjedanju dijela javne, k tome i državne ceste, a budući da inspektori tijekom pregleda nisu utvrdili granice ceste, naređeno je upravo HC-u kao upravljaču javne prometnice da ukloni sporne objekte koji su tamo postavljeni bez njihove suglasnosti.
Neutvrđene granice
U presudi Upravnog suda donesenoj prije dva dana navodi se, među ostalim, da u konkretnom slučaju nisu utvrđene granice navedene ceste i da zemljišne parcele koje se nalaze na tom potezu nisu uknjižene kao javno dobro, odnosno državna cesta kojom upravlja HC, pa stoga oni i ne mogu izvršiti izrečenu obvezu.
- Prema ocjeni ovog suda nije moguće naložiti "Hrvatskim cestama" da na državnoj cesti - Domagojeva obala - poduzmu mjere uklanjanja štandova, štekata i kioska s ceste postavljenih na uzdignutom nogostupu, a da prethodno nije nesporno utvrđeno čini li predmetna pješačka staza dio javne ceste ili spada u javne površine na kojima nije dopušten promet motornim vozilima u skladu s odredbama Zakona o komunalnom gospodarstvu.
Stoga, kako činjenično stanje nije nesporno utvrđeno, postavlja se pitanje u čijoj je nadležnosti postupanje u ovoj upravnoj stvari te je osporavano rješenje Ministarstva u konkretnom slučaju pravno i stvarno neizvršivo - navodi se, među ostalim, u presudi.

Iako je još krajem siječnja ove godine inspekcija Ministarstva prometa izdala rješenje prema kojem "Hrvatske ceste" (HC) moraju u roku od 30 dana riješiti problem štandova, štekata i kioska na Domagojevoj obali, to se još nije dogodilo i pitanje je kad će i tko rješavati taj gorući komunalni problem.
U tom je inspekcijskom rješenju stajalo da HC na potezu od Pothodnika do autobusnog kolodvora mora odrediti granice državne ceste i poduzeti "upravno-tehničke mjere uklanjanja štandova, štekata i kioska s ceste postavljenih na pješačkoj stazi, odnosno uzdignutom nogostupu bez suglasnosti i uvjeta upravljača ceste".
Državna tvrtka žalila se Upravnom sudu u Splitu tražeći da se to rješenje poništi, jer oni ne održavaju nogostup uz Domagojevu obalu, odnosno taj dio na koji su već desetljećima postavljena prodajna mjesta koja, prema inspektorskim navodima, ometaju pješačku komunikaciju. Upravni sud nepravomoćno je odlučio da je inspekcijsko rješenje - ništavno. Na to, naravno, postoji pravo žalbe, pa je sigurno da će se trakavica nastaviti.
Milijunske tužbe
Iz HC-a su u tužbi tvrdili i da su na jednom sastanku predstavnici Grada izjavili kako upravo lokalna vlast "temeljem Zakona o komunalnom gospodarstvu i Zakona o cestama kontinuirano ugovara zakup predmetnih površina i održava nogostup te prometnice".
- Ako bismo postupili po inspekcijskom rješenju, bili bismo možebitno izloženi teškoj i nepopravljivoj šteti jer bi vlasnici štandova, štekata i kioska koji su do 31. prosinca 2019. imali sklopljene ugovore o zakupu s Gradom podnijeli milijunske tužbe radi naknade štete - naglasili su iz državne tvrtke.
Spomenimo i da od tog datuma, po izjavama predstavnika Grada danih inspekciji, nitko od vlasnika poslovnih objekata nema sklopljen ugovor s Banovinom o zakupu javne površine, što znači da svi ti štekati, kiosci i štandovi već više od devet mjeseci ilegalno rade.

"Hrvatske ceste", dakle, smatraju da nisu odgovorne za nered na tom dijelu Istočne obale nego da je odgovornost na Gradu. Promatrajući stvar laički, teško je ne donijeti isti zaključak. Jer ako već lokalna vlast daje prostor u zakup i ubire novac za to, kako onda nije odgovorna za sređivanje tog nereda?
Ministarstvo je u svojem odgovoru na tužbu i tijekom postupka ustvrdilo da se u ovom slučaju ne radi o održavanju pješačke staze, već o zaposjedanju dijela javne, k tome i državne ceste, a budući da inspektori tijekom pregleda nisu utvrdili granice ceste, naređeno je upravo HC-u kao upravljaču javne prometnice da ukloni sporne objekte koji su tamo postavljeni bez njihove suglasnosti.
Neutvrđene granice
U presudi Upravnog suda donesenoj prije dva dana navodi se, među ostalim, da u konkretnom slučaju nisu utvrđene granice navedene ceste i da zemljišne parcele koje se nalaze na tom potezu nisu uknjižene kao javno dobro, odnosno državna cesta kojom upravlja HC, pa stoga oni i ne mogu izvršiti izrečenu obvezu.
- Prema ocjeni ovog suda nije moguće naložiti "Hrvatskim cestama" da na državnoj cesti - Domagojeva obala - poduzmu mjere uklanjanja štandova, štekata i kioska s ceste postavljenih na uzdignutom nogostupu, a da prethodno nije nesporno utvrđeno čini li predmetna pješačka staza dio javne ceste ili spada u javne površine na kojima nije dopušten promet motornim vozilima u skladu s odredbama Zakona o komunalnom gospodarstvu.
Stoga, kako činjenično stanje nije nesporno utvrđeno, postavlja se pitanje u čijoj je nadležnosti postupanje u ovoj upravnoj stvari te je osporavano rješenje Ministarstva u konkretnom slučaju pravno i stvarno neizvršivo - navodi se, među ostalim, u presudi.
