Nakon žalbi političkih stranaka Možemo!, BM365 i Mosta da je netko koristeći se telefonskim brojem 01 314 1505 biračima manipulirao govoreći im neistine o pojedinim kandidatkinjama i kandidatima za gradonačelnika/icu Zagreba, te nakon što je gradonačelnička kandidatkinja Vesna Škare Ožbolt Državnom odvjetništvu podnijela kaznenu prijavu protiv nepoznatog počinitelja, HAKOM (Hrvatska regulatorna agencija za mrežne djelatnosti) je proveo ispekcijski nadzor nad operaterom 4Tel Telekomunikacije, tvrtkom koja je odmah rekla kako su taj broj dali u zakup jednom svom klijentu, piše Jutarnji list.

U najbitnijem, inspekcijom je utvrđeno da se spornim brojem koristila tvrtka Akter Public, koja obavlja usluge oglašavanja u ovoj kampanji za Domovinski pokret i njihove kandidate i kandidatkinje, i koja je ranije negirala svoju povezanost s tim brojem.

"Inspektor elektroničkih komunikacija Hrvatske regulatorne agencije za mrežne djelatnosti (dalje: inspektor) pokrenuo je inspekcijski nadzor nad operatorom javnih komunikacijskih usluga 4Tel Telekomunikacije d.o.o. iz Samobora (dalje: 4Tel) zbog nemogućnosti jasnog utvrđivanja korisnika broja 385 1 3141 505. Naime, HAKOM je zaprimio 6. svibnja 2021. prijavu Izbornog povjerenstva Grada Zagreba o zlouporabi broja 385 1 3141 505 te nakon što je utvrđeno u evidenciji HAKOM-a da je broj primarnom dodjelom dodijeljen 4Tel-u, poslan je zahtjev za očitovanje 4Tel-u o korisniku koji koristi navedeni broj. 4Tel je dostavio u svom očitovanju kako je broj dodijeljen korisniku Akter Public d.o.o. iz Zagreba (dalje: Akter Public). S obzirom da je Akter Public, nakon što je očitovanje o korisniku broja dostavljeno Izbornom povjerenstvu Grada Zagreba dostavio očitovanje HAKOM-u da nije korisnik predmetnog broja, inspektor je odlučio o potrebi otvaranja inspekcijskog nadzora kako bi se utvrdile sve potrebne činjenice i nedvojbeno utvrdio korisnik predmetnog broja. Slijedom navedenog, 13. svibnja 2021., od 4Tel-a zatražena je dostava informacije korisnika broja 385 1 3141 505 te je zatražena dostava dokumentacije iz koje se može nedvojbeno potvrditi navod o dostavljenom korisniku broja. Istog dana 4Tel je dostavio ponovljenu informaciju kako je korisnik broja Akter Public te je kao dokaz dostavio popisani Ugovor između 4Tel-a i Akter Public-a. Dodatno, 4Tel dostavlja ispise iz sustava iz kojih je vidljivo da navedeni broj koristi Akter Public. Tijekom istog dana Akter Public je dostavio očitovanje HAKOM-u kako je došlo do nesporazuma te da povlače prijavu o tome da nisu korisnici broja.

Nastavno na očitovanje, inspektor je izvršio provjeru sveukupne dostavljene dokumentacije, kao i čitavu korespondenciju između svih strana u ovom postupku te utvrdio sljedeće. Iako 4Tel nema potpisani dokument dvije strane iz kojeg se nedvojbeno može utvrditi kako je broj 385 1 3141 505 sekundarno dodijeljen Akter Public-u, temeljem Ugovora se može utvrditi kako su u poslovnom odnosu, a što je temelj navodima kako je u sustavima 4Tel-a predmetni broj vođen pod korisnikom Akter Public.

S obzirom da je Akter Public za vrijeme trajanje inspekcijskog nadzora povukao svoju prijavu i ne negira da je korisnik broja, inspektor je u ovom slučaju unatoč nepotpunoj dokumentaciji utvrdio kako je korisnik predmetnog broja Akter Public", stoji, među ostalim, u rješenju HAKOM-a.

Nakon žalbi političkih stranaka Možemo!, BM365 i Mosta da je netko koristeći se telefonskim brojem 01 314 1505 biračima manipulirao govoreći im neistine o pojedinim kandidatkinjama i kandidatima za gradonačelnika/icu Zagreba, te nakon što je gradonačelnička kandidatkinja Vesna Škare Ožbolt Državnom odvjetništvu podnijela kaznenu prijavu protiv nepoznatog počinitelja, HAKOM (Hrvatska regulatorna agencija za mrežne djelatnosti) je proveo ispekcijski nadzor nad operaterom 4Tel Telekomunikacije, tvrtkom koja je odmah rekla kako su taj broj dali u zakup jednom svom klijentu, piše Jutarnji list.

U najbitnijem, inspekcijom je utvrđeno da se spornim brojem koristila tvrtka Akter Public, koja obavlja usluge oglašavanja u ovoj kampanji za Domovinski pokret i njihove kandidate i kandidatkinje, i koja je ranije negirala svoju povezanost s tim brojem.

"Inspektor elektroničkih komunikacija Hrvatske regulatorne agencije za mrežne djelatnosti (dalje: inspektor) pokrenuo je inspekcijski nadzor nad operatorom javnih komunikacijskih usluga 4Tel Telekomunikacije d.o.o. iz Samobora (dalje: 4Tel) zbog nemogućnosti jasnog utvrđivanja korisnika broja 385 1 3141 505. Naime, HAKOM je zaprimio 6. svibnja 2021. prijavu Izbornog povjerenstva Grada Zagreba o zlouporabi broja 385 1 3141 505 te nakon što je utvrđeno u evidenciji HAKOM-a da je broj primarnom dodjelom dodijeljen 4Tel-u, poslan je zahtjev za očitovanje 4Tel-u o korisniku koji koristi navedeni broj. 4Tel je dostavio u svom očitovanju kako je broj dodijeljen korisniku Akter Public d.o.o. iz Zagreba (dalje: Akter Public). S obzirom da je Akter Public, nakon što je očitovanje o korisniku broja dostavljeno Izbornom povjerenstvu Grada Zagreba dostavio očitovanje HAKOM-u da nije korisnik predmetnog broja, inspektor je odlučio o potrebi otvaranja inspekcijskog nadzora kako bi se utvrdile sve potrebne činjenice i nedvojbeno utvrdio korisnik predmetnog broja. Slijedom navedenog, 13. svibnja 2021., od 4Tel-a zatražena je dostava informacije korisnika broja 385 1 3141 505 te je zatražena dostava dokumentacije iz koje se može nedvojbeno potvrditi navod o dostavljenom korisniku broja. Istog dana 4Tel je dostavio ponovljenu informaciju kako je korisnik broja Akter Public te je kao dokaz dostavio popisani Ugovor između 4Tel-a i Akter Public-a. Dodatno, 4Tel dostavlja ispise iz sustava iz kojih je vidljivo da navedeni broj koristi Akter Public. Tijekom istog dana Akter Public je dostavio očitovanje HAKOM-u kako je došlo do nesporazuma te da povlače prijavu o tome da nisu korisnici broja.

Nastavno na očitovanje, inspektor je izvršio provjeru sveukupne dostavljene dokumentacije, kao i čitavu korespondenciju između svih strana u ovom postupku te utvrdio sljedeće. Iako 4Tel nema potpisani dokument dvije strane iz kojeg se nedvojbeno može utvrditi kako je broj 385 1 3141 505 sekundarno dodijeljen Akter Public-u, temeljem Ugovora se može utvrditi kako su u poslovnom odnosu, a što je temelj navodima kako je u sustavima 4Tel-a predmetni broj vođen pod korisnikom Akter Public.

S obzirom da je Akter Public za vrijeme trajanje inspekcijskog nadzora povukao svoju prijavu i ne negira da je korisnik broja, inspektor je u ovom slučaju unatoč nepotpunoj dokumentaciji utvrdio kako je korisnik predmetnog broja Akter Public", stoji, među ostalim, u rješenju HAKOM-a.

Nakon žalbi političkih stranaka Možemo!, BM365 i Mosta da je netko koristeći se telefonskim brojem 01 314 1505 biračima manipulirao govoreći im neistine o pojedinim kandidatkinjama i kandidatima za gradonačelnika/icu Zagreba, te nakon što je gradonačelnička kandidatkinja Vesna Škare Ožbolt Državnom odvjetništvu podnijela kaznenu prijavu protiv nepoznatog počinitelja, HAKOM (Hrvatska regulatorna agencija za mrežne djelatnosti) je proveo ispekcijski nadzor nad operaterom 4Tel Telekomunikacije, tvrtkom koja je odmah rekla kako su taj broj dali u zakup jednom svom klijentu, piše Jutarnji list.

U najbitnijem, inspekcijom je utvrđeno da se spornim brojem koristila tvrtka Akter Public, koja obavlja usluge oglašavanja u ovoj kampanji za Domovinski pokret i njihove kandidate i kandidatkinje, i koja je ranije negirala svoju povezanost s tim brojem.
