Nepravomoćnim presudama općinskog suda u Metkoviću zaposlenici Doma zdravlja Metković izgubili su radne sporove u kojima su tražili isplatu dodataka na plaću za razdoblje od 1. prosinca 2015. do 31. siječnja 2017.

Kako smo već pisali, 97 zaposlenika podnijeli su tužbu protiv poslodavca u kojoj traže isplatu osnovice uvećane za 6 posto uz pripadajuće dodatke koji ima nisu bili isplaćivani zbog pogreške u Centralnom obračunu plaća (COP).

Po mišljenju liječnika, medicinskih sestara, spremačica, vozača i tehničkog osoblja Dom zdravlja im duguje oko 92 tisuće eura bez zakonskih zateznih kamata. Riječ je u novčanom rasponu od nekoliko stotina pa do 1700 eura, ovisno o kojem se radnom mjestu radi i koliko je radnik imao radnog staža.

Suglasnost županijske Skupštine

Svoje tužbe temeljili su na suglasnosti Županijske skupštine Dubrovačko neretvanske od 18. listopada 2022. te na odluci Upravnog vijeća Doma zdravlja Metković od 31. ožujka 2022., prema kojima su polagali pravo na isplatu zaostataka.

"Razvidno je da smo tužbu podnijeli godinu dana od donošenja suglasnosti i odluke, a sve u interesu da ovaj spor riješimo mirnim putem odnosno dogovorom, napisala je početkom prosinca u priopćenju za javnost Martina Krstičević, predsjednica Radničkog vijeća i članica Upravnog vijeća Doma zdravlja Metković - predstavnica radnika.

Naime, čini mi se da nas je poslodavac izigrao, odugovlačio je rješenje našeg zahtjeva jer nije ni imao namjeru isplatiti nam naša potraživanja.

A još čudnije je da Dom zdravlja ne poštuje Odluke Upravnog vijeća, a ni suglasnosti Županijske skupštine. Također nama radnicima nije jasno da poslodavac (Dom zdravlja Metković) koji je obračunao i priznao naša potraživanja, a ista su potvrđena od strane Županijske skupštine, sada osporava.

Pitamo se je li to samovolja ili poigravanje sa propisima i pravima radnika, jer u nekom trenutku poslodavac svoju odluku "zamrzava", a sada u odgovoru na tužbu spominje da odluke nije ni bilo. Nama radnicima nije preostalo ništa drugo nego da ustanemo protiv takve samovolje", napisala je Krstičević tada u priopćenju.

Sporazum s Vladom

Svi radnici koji su podnijeli tužbe bili su zaposlenici Doma zdravlja Metković u vremenu od prosinca 2015. do siječnja 2017. godine. Sporazumom između Vlade i Sindikata javnih službi o osnovici plaće u javnim službama određeno je uvećanje osnovice od 6 posto.

Radnicima ta primanja nisu isplaćena premda su na njih imali pravo. S obzirom da je tužbu podnijelo 97 tužitelja s različitim iznosima tužbenih zahtjeva, sud je odvojeno raspravljao o zahtjevima tužitelja.

Međutim, nepravomoćnim presudom Općinskog suda u Metkoviću zahtjevi medicinskih sestara, spremačica, vozača tehničkog osoblja i liječnika (koji su imali i najveće pojedinačne iznose potraživanja) za isplatom su odbijeni kao neosnovani zbog zastare.

Radnici su se žalili na županijske sudove, ali prve odluke drugostupanjskih sudova također im ne idu u prilog, jer su potvrđene presude Općinskog suda u Metkoviću, pa bi tako radnici umjesto novca na računima mogli dobiti uplatnice za sudske troškove u iznosu od 500 eura.

Nepravomoćnim presudama općinskog suda u Metkoviću zaposlenici Doma zdravlja Metković izgubili su radne sporove u kojima su tražili isplatu dodataka na plaću za razdoblje od 1. prosinca 2015. do 31. siječnja 2017.

Kako smo već pisali, 97 zaposlenika podnijeli su tužbu protiv poslodavca u kojoj traže isplatu osnovice uvećane za 6 posto uz pripadajuće dodatke koji ima nisu bili isplaćivani zbog pogreške u Centralnom obračunu plaća (COP).

Po mišljenju liječnika, medicinskih sestara, spremačica, vozača i tehničkog osoblja Dom zdravlja im duguje oko 92 tisuće eura bez zakonskih zateznih kamata. Riječ je u novčanom rasponu od nekoliko stotina pa do 1700 eura, ovisno o kojem se radnom mjestu radi i koliko je radnik imao radnog staža.

Suglasnost županijske Skupštine

Svoje tužbe temeljili su na suglasnosti Županijske skupštine Dubrovačko neretvanske od 18. listopada 2022. te na odluci Upravnog vijeća Doma zdravlja Metković od 31. ožujka 2022., prema kojima su polagali pravo na isplatu zaostataka.

"Razvidno je da smo tužbu podnijeli godinu dana od donošenja suglasnosti i odluke, a sve u interesu da ovaj spor riješimo mirnim putem odnosno dogovorom, napisala je početkom prosinca u priopćenju za javnost Martina Krstičević, predsjednica Radničkog vijeća i članica Upravnog vijeća Doma zdravlja Metković - predstavnica radnika.

Naime, čini mi se da nas je poslodavac izigrao, odugovlačio je rješenje našeg zahtjeva jer nije ni imao namjeru isplatiti nam naša potraživanja.

A još čudnije je da Dom zdravlja ne poštuje Odluke Upravnog vijeća, a ni suglasnosti Županijske skupštine. Također nama radnicima nije jasno da poslodavac (Dom zdravlja Metković) koji je obračunao i priznao naša potraživanja, a ista su potvrđena od strane Županijske skupštine, sada osporava.

Pitamo se je li to samovolja ili poigravanje sa propisima i pravima radnika, jer u nekom trenutku poslodavac svoju odluku "zamrzava", a sada u odgovoru na tužbu spominje da odluke nije ni bilo. Nama radnicima nije preostalo ništa drugo nego da ustanemo protiv takve samovolje", napisala je Krstičević tada u priopćenju.

Sporazum s Vladom

Svi radnici koji su podnijeli tužbe bili su zaposlenici Doma zdravlja Metković u vremenu od prosinca 2015. do siječnja 2017. godine. Sporazumom između Vlade i Sindikata javnih službi o osnovici plaće u javnim službama određeno je uvećanje osnovice od 6 posto.

Radnicima ta primanja nisu isplaćena premda su na njih imali pravo. S obzirom da je tužbu podnijelo 97 tužitelja s različitim iznosima tužbenih zahtjeva, sud je odvojeno raspravljao o zahtjevima tužitelja.

Međutim, nepravomoćnim presudom Općinskog suda u Metkoviću zahtjevi medicinskih sestara, spremačica, vozača tehničkog osoblja i liječnika (koji su imali i najveće pojedinačne iznose potraživanja) za isplatom su odbijeni kao neosnovani zbog zastare.

Radnici su se žalili na županijske sudove, ali prve odluke drugostupanjskih sudova također im ne idu u prilog, jer su potvrđene presude Općinskog suda u Metkoviću, pa bi tako radnici umjesto novca na računima mogli dobiti uplatnice za sudske troškove u iznosu od 500 eura.

Zaposlenici Doma zdravlja tražili zaostatke plaća pa dobili odbijenice, sada moraju čak platiti sudske troškove

Nepravomoćnim presudama općinskog suda u Metkoviću zaposlenici Doma zdravlja Metković izgubili su radne sporove u kojima su tražili isplatu dodataka na plaću za razdoblje od 1. prosinca 2015. do 31. siječnja 2017.

Kako smo već pisali, 97 zaposlenika podnijeli su tužbu protiv poslodavca u kojoj traže isplatu osnovice uvećane za 6 posto uz pripadajuće dodatke koji ima nisu bili isplaćivani zbog pogreške u Centralnom obračunu plaća (COP).
