Županijsko državno odvjetništvo u Zadru je, nakon provedene istrage, podiglo pred Županijskim sudom u Zadru optužnicu protiv državljanke Republike Hrvatske (1972.) zbog počinjenih kaznenih djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi st. 1. Kaznenog zakona, prijevare u gospodarskom poslovanju iz čl. 247. st. 2. u svezi st. 1. KZ-a i prouzročenja stečaja iz čl. 249. st. 3. u svezi st. 1. KZ-a te protiv državljanina Republike Hrvatske (1966.) zbog počinjenih kaznenih djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi st. 1. Kaznenog zakona i prijevare u gospodarskom poslovanju iz čl. 247. st. 2. u svezi st. 1. KZ-a.

Okrivljenicima se stavlja na teret da su tijekom 2015. godine i od 2017. do 2020. godine, u jednom mjestu na Pagu, prvookrivljenica kao članica uprave jednog trgovačkog društva, a drugookrivljenik kao osnivač istog društva, postupili s ciljem da za to društvo ostvare nepripadnu materijalnu dobit. Tereti ih se da ju zatražili od nadležne lučke uprave odobrenje za mjesto u luci te ukrcaj i iskrcaj putnika za putnički brod u vlasništvu njihovog društva, lažno predočivši da će uredno ispunjavati sve obveze vezane za usluge uporabe obale i brodsku ležarinu za taj brod, a što im nije bila namjera. Tereti ih se da su u navedenom razdoblju propustili uplatiti citirane obveze u ukupnom iznosu od 36.473,55 eura (274.809,94 kune).

Prvookrivljenicu se, u istom svojstvu, tereti da je zajednički i dogovorno sa drugookrivljenikom, u istom svojstvu, 7. rujna 2020. zaključila sa drugookrivljenikom ugovor o kupoprodaji spomenutog putničkog broda za iznos od 24.885,53 eura (187.500,00 kuna) na temelju kojeg su prenijeli vlasništvo tog broda na drugo društvo koje je bilo u vlasništvu njihovog sina (drugookrivljenik je bio član uprave u tom društvu). Tereti ih se da su navedeno učinili iako kupoprodajna cijena nikada nije bila isplaćena niti je društvo njihovog sina imalo bilo kakvo potraživanje prema njihovom društvu pa su na taj način oštetili svoje društvo za spomenuti iznos. 

Prvookrivljenicu se tereti i da je u navedenom svojstvu, 7. rujna 2020. postupila kako bi umanjila stečajnu masu društva kojega je zastupala, svjesna pritom da to društvo ne može podmirivati svoje financijske obveze i da je račun toga društva u blokadi. Unatoč tome je, tereti ju se, zaključila prethodno spomenuti ugovor o kupoprodaji plovila za spomenuti iznos koji nikada nije isplaćen njezinom društvu kao prodavatelju, nakon čega je Trgovački sud u Rijeci, u rujnu 2021. godine, otvorio i zatvorio stečajni postupak nad njezinim društvom budući da imovina tog društva nije bila dostatna niti za podmirenje troškova stečajnog postupka.

Županijsko državno odvjetništvo u Zadru je, nakon provedene istrage, podiglo pred Županijskim sudom u Zadru optužnicu protiv državljanke Republike Hrvatske (1972.) zbog počinjenih kaznenih djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi st. 1. Kaznenog zakona, prijevare u gospodarskom poslovanju iz čl. 247. st. 2. u svezi st. 1. KZ-a i prouzročenja stečaja iz čl. 249. st. 3. u svezi st. 1. KZ-a te protiv državljanina Republike Hrvatske (1966.) zbog počinjenih kaznenih djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi st. 1. Kaznenog zakona i prijevare u gospodarskom poslovanju iz čl. 247. st. 2. u svezi st. 1. KZ-a.

Okrivljenicima se stavlja na teret da su tijekom 2015. godine i od 2017. do 2020. godine, u jednom mjestu na Pagu, prvookrivljenica kao članica uprave jednog trgovačkog društva, a drugookrivljenik kao osnivač istog društva, postupili s ciljem da za to društvo ostvare nepripadnu materijalnu dobit. Tereti ih se da ju zatražili od nadležne lučke uprave odobrenje za mjesto u luci te ukrcaj i iskrcaj putnika za putnički brod u vlasništvu njihovog društva, lažno predočivši da će uredno ispunjavati sve obveze vezane za usluge uporabe obale i brodsku ležarinu za taj brod, a što im nije bila namjera. Tereti ih se da su u navedenom razdoblju propustili uplatiti citirane obveze u ukupnom iznosu od 36.473,55 eura (274.809,94 kune).

Prvookrivljenicu se, u istom svojstvu, tereti da je zajednički i dogovorno sa drugookrivljenikom, u istom svojstvu, 7. rujna 2020. zaključila sa drugookrivljenikom ugovor o kupoprodaji spomenutog putničkog broda za iznos od 24.885,53 eura (187.500,00 kuna) na temelju kojeg su prenijeli vlasništvo tog broda na drugo društvo koje je bilo u vlasništvu njihovog sina (drugookrivljenik je bio član uprave u tom društvu). Tereti ih se da su navedeno učinili iako kupoprodajna cijena nikada nije bila isplaćena niti je društvo njihovog sina imalo bilo kakvo potraživanje prema njihovom društvu pa su na taj način oštetili svoje društvo za spomenuti iznos. 

Prvookrivljenicu se tereti i da je u navedenom svojstvu, 7. rujna 2020. postupila kako bi umanjila stečajnu masu društva kojega je zastupala, svjesna pritom da to društvo ne može podmirivati svoje financijske obveze i da je račun toga društva u blokadi. Unatoč tome je, tereti ju se, zaključila prethodno spomenuti ugovor o kupoprodaji plovila za spomenuti iznos koji nikada nije isplaćen njezinom društvu kao prodavatelju, nakon čega je Trgovački sud u Rijeci, u rujnu 2021. godine, otvorio i zatvorio stečajni postupak nad njezinim društvom budući da imovina tog društva nije bila dostatna niti za podmirenje troškova stečajnog postupka.

Podignuta optužnica protiv okrivljene 51-godišnjakinje i okrivljenog 57-godišnjaka - muljali s fiktivnom prodajom broda na Pagu

Županijsko državno odvjetništvo u Zadru je, nakon provedene istrage, podiglo pred Županijskim sudom u Zadru optužnicu protiv državljanke Republike Hrvatske (1972.) zbog počinjenih kaznenih djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi st. 1. Kaznenog zakona, prijevare u gospodarskom poslovanju iz čl. 247. st. 2. u svezi st. 1. KZ-a i prouzročenja stečaja iz čl. 249. st. 3. u svezi st. 1. KZ-a te protiv državljanina Republike Hrvatske (1966.) zbog počinjenih kaznenih djela zlouporabe povjerenja u gospodarskom poslovanju iz čl. 246. st. 2. u svezi st. 1. Kaznenog zakona i prijevare u gospodarskom poslovanju iz čl. 247. st. 2. u svezi st. 1. KZ-a.

Okrivljenicima se stavlja na teret da su tijekom 2015. godine i od 2017. do 2020. godine, u jednom mjestu na Pagu, prvookrivljenica kao članica uprave jednog trgovačkog društva, a drugookrivljenik kao osnivač istog društva, postupili s ciljem da za to društvo ostvare nepripadnu materijalnu dobit. Tereti ih se da ju zatražili od nadležne lučke uprave odobrenje za mjesto u luci te ukrcaj i iskrcaj putnika za putnički brod u vlasništvu njihovog društva, lažno predočivši da će uredno ispunjavati sve obveze vezane za usluge uporabe obale i brodsku ležarinu za taj brod, a što im nije bila namjera. Tereti ih se da su u navedenom razdoblju propustili uplatiti citirane obveze u ukupnom iznosu od 36.473,55 eura (274.809,94 kune).
