Vrhovni sud u Portugalu naredio je muškarcu da bivšoj partnerici isplati više od 60.000 eura za kućne poslove koje je obavljala tijekom gotovo 30 godina zajedničkog života, piše nova.rs.

Prema presudi Vrhovnog suda pravde, nedavanje nadoknade za kućne poslove koje isključivo ili u najvećoj mjeri obavlja jedan član izvanbračne zajednice dovodi do njegovog ” stvarnog osiromašenja”, a pošto to također oslobađa drugog člana zajednice od obavljanja tih zadataka, to dovodi do njegovog bogaćenja jer ne plaća troškove, ni doprinose.

Žena koja je dobila presudu tražila je nadokandu od 240.000 eura, ali je niži sud odbio njen zahtjev.

Nakon njene žalbe, Žalbeni sud podržao je njen zahtjev i odredio da joj se isplati 60.782 eura. Njen bivši partner žalio se Vrhovnom sudu, koji je potvrdio presudu Žalbeni suda.

“Zahtjev za jednakošću odavno je svojstven ideji pravde, tako da nije moguće smatrati da obavljanje svih ili velikog dijela poslova u kući u kojoj živi nevjenčan par od strane jednog od partnera odgovara ispunjavanju prirodne obaveze, zasnovane na dužnosti pravde”, navodi se u presudi.

U ovom slučaju dokazano je da je žena tijekom gotovo 30 godina zajedničkog života brinula o kući i pripremala obroke za partnera.

U utvrđivanju vrijednosti kućnih poslova, sud je kao kriterij usvojio nacionalnu minimalnu platu, pomnožio je s 12 mjeseci i godinama zajedničkog života, a zatim oduzeo trećinu iznosa na račun ženinih troškova.

Vrhovni sud u Portugalu naredio je muškarcu da bivšoj partnerici isplati više od 60.000 eura za kućne poslove koje je obavljala tijekom gotovo 30 godina zajedničkog života, piše nova.rs.

Prema presudi Vrhovnog suda pravde, nedavanje nadoknade za kućne poslove koje isključivo ili u najvećoj mjeri obavlja jedan član izvanbračne zajednice dovodi do njegovog ” stvarnog osiromašenja”, a pošto to također oslobađa drugog člana zajednice od obavljanja tih zadataka, to dovodi do njegovog bogaćenja jer ne plaća troškove, ni doprinose.

Žena koja je dobila presudu tražila je nadokandu od 240.000 eura, ali je niži sud odbio njen zahtjev.

Nakon njene žalbe, Žalbeni sud podržao je njen zahtjev i odredio da joj se isplati 60.782 eura. Njen bivši partner žalio se Vrhovnom sudu, koji je potvrdio presudu Žalbeni suda.

“Zahtjev za jednakošću odavno je svojstven ideji pravde, tako da nije moguće smatrati da obavljanje svih ili velikog dijela poslova u kući u kojoj živi nevjenčan par od strane jednog od partnera odgovara ispunjavanju prirodne obaveze, zasnovane na dužnosti pravde”, navodi se u presudi.

U ovom slučaju dokazano je da je žena tijekom gotovo 30 godina zajedničkog života brinula o kući i pripremala obroke za partnera.

U utvrđivanju vrijednosti kućnih poslova, sud je kao kriterij usvojio nacionalnu minimalnu platu, pomnožio je s 12 mjeseci i godinama zajedničkog života, a zatim oduzeo trećinu iznosa na račun ženinih troškova.

Muškarac mora isplatiti bivšoj partnerici finu sumu: za 30 godina obavljanja kućnih poslova dobila više od 60.000 eura

Vrhovni sud u Portugalu naredio je muškarcu da bivšoj partnerici isplati više od 60.000 eura za kućne poslove koje je obavljala tijekom gotovo 30 godina zajedničkog života, piše nova.rs.

Prema presudi Vrhovnog suda pravde, nedavanje nadoknade za kućne poslove koje isključivo ili u najvećoj mjeri obavlja jedan član izvanbračne zajednice dovodi do njegovog ” stvarnog osiromašenja”, a pošto to također oslobađa drugog člana zajednice od obavljanja tih zadataka, to dovodi do njegovog bogaćenja jer ne plaća troškove, ni doprinose.

Žena koja je dobila presudu tražila je nadokandu od 240.000 eura, ali je niži sud odbio njen zahtjev.

Nakon njene žalbe, Žalbeni sud podržao je njen zahtjev i odredio da joj se isplati 60.782 eura. Njen bivši partner žalio se Vrhovnom sudu, koji je potvrdio presudu Žalbeni suda.

“Zahtjev za jednakošću odavno je svojstven ideji pravde, tako da nije moguće smatrati da obavljanje svih ili velikog dijela poslova u kući u kojoj živi nevjenčan par od strane jednog od partnera odgovara ispunjavanju prirodne obaveze, zasnovane na dužnosti pravde”, navodi se u presudi.

U ovom slučaju dokazano je da je žena tijekom gotovo 30 godina zajedničkog života brinula o kući i pripremala obroke za partnera.

U utvrđivanju vrijednosti kućnih poslova, sud je kao kriterij usvojio nacionalnu minimalnu platu, pomnožio je s 12 mjeseci i godinama zajedničkog života, a zatim oduzeo trećinu iznosa na račun ženinih troškova.
