Ustavni sud RH nije našao ništa sporno u presudama prema kojima zadarska tvrtka 'Tankerkomerc' državi mora platiti čak 52.304.591,98 kuna poreznog duga.

Smatrajući da su im povrijeđena ustavna prav Tankerkomerc d.d. Se žalio Ustavnom sudu RH povodom presude Visokog upravnog suda RH iz 2021. kojom im je odbijena žalba i potvrđena presuda Upravnog suda u Splitu. Presudama im je odbijen zahtjev za poništenjem rješenja Ministarstva financija RH od 23. studenoga 2017. kojim je određena ovrha na novčanim sredstvima radi naplate poreznog duga u ukupnom iznosu od 52.304.591,98 kuna.

Postupak predstečajne nagodbe na temelju izmijenjenog i dopunjenog plana financijskog restrukturiranja Tankerkomercu odobren je rješenjem Trgovačkog suda u Zadru 14. veljače 2014. godine. U postupku predstečajne nagodbe Ministasrtvo financija prijavilo je kao vjerovnik Grupe I porezni dug prema RH, te je predstečajnom nagodbom Tankerkomercu otpisalo 50 posto glavnice poreznog duga, te sve redovne i zatezne kamate na neplaćeni porezni dug, tako da je ukupni porezni dug koji je podnositelj bio dužan podmiriti po predstečajnoj nagodbi nakon navedenih otpisa iznosio 27.838.143,81 kuna.

Ministar financija je dopisom od 4. rujna 2014. utvrdio da Tankerkomerc nije postupio po njegovom dopisu od 1. srpnja 2014. kojim je bio pozvan dostaviti dokaz o tome da je u roku od 30 dana od pravomoćnosti rješenja o potvrđivanju predstečajne nagodbe izvršio prijenos vlasništva nekretnina na svoje trgovačko društvo i brisanje svih tereta, odnosno zaključio odgovarajuće ugovore, zbog čega je obavijestio Tankerkomerc da predstečajnu nagodbu smatra raskinutom

Županijsko državno odvjetništvo u Zadru je potom zahtjevom za mirno rješenje spora 2014. pozvalo Tankerkomerc da dostavi dokaze o prijenosu vlasništva i brisanju tereta s nekretnina obuhvaćenih predstečajnom nagodbom, uz obavijest da će u protivnom podnijeti tužbeni zahtjev radi utvrđenja da se predstečajna nagodba smatra raskinutom.

Budući da je predstečajnu nagodbu smatralo raskinutom, Ministarstvo financija je na temelju obračuna poreznog duga, odnosno prijava poreza i rješenja o utvrđivanju porezne obveze te drugih isprava, ali i na temelju predstečajne nagodbe kao ovršne isprave, donijelo rješenje kojim je određena ovrha na novčanim sredstvima Tankerkomerca radi naplate poreznog duga u ukupnom iznosu od 53.413.133,95 kuna.

Ustavni sud je, međutim, utvrdio da su ugovorene odredbe o raskidnom uvjetu i roku predstečajne nagodbe ne samo imale legitimni cilj u naplati poreznog duga, već su bile prikladne i nužne radi ostvarenja tog cilja, dok se raskid predstečajne nagodbe kojim je dospio ukupni porezni dug naplativ u ovom postupku porezne ovrhe ne može pripisati postupanju tuženog javnopravnog tijela, već ukupnom ponašanju Tankerkomerca.

Tankerkomerc, je, kako navode, ponudio platiti porezni dug prijenosom vlasništva nekretnina koje su ili opterećene ili nisu u njegovom vlasništvu, te je svjesno izrazio pristanak na raskidne uvjete i rokove koji su služili kao korektiv navedenoj situaciji i najprikladniji instrument osiguranja naplate poreznog duga. Te preuzete obveze u konačnici nije ispunio, čime je predstečajna nagodba raskinuta 2014. godine.

Ustavni sud RH nije našao ništa sporno u presudama prema kojima zadarska tvrtka 'Tankerkomerc' državi mora platiti čak 52.304.591,98 kuna poreznog duga.

Smatrajući da su im povrijeđena ustavna prav Tankerkomerc d.d. Se žalio Ustavnom sudu RH povodom presude Visokog upravnog suda RH iz 2021. kojom im je odbijena žalba i potvrđena presuda Upravnog suda u Splitu. Presudama im je odbijen zahtjev za poništenjem rješenja Ministarstva financija RH od 23. studenoga 2017. kojim je određena ovrha na novčanim sredstvima radi naplate poreznog duga u ukupnom iznosu od 52.304.591,98 kuna.

Postupak predstečajne nagodbe na temelju izmijenjenog i dopunjenog plana financijskog restrukturiranja Tankerkomercu odobren je rješenjem Trgovačkog suda u Zadru 14. veljače 2014. godine. U postupku predstečajne nagodbe Ministasrtvo financija prijavilo je kao vjerovnik Grupe I porezni dug prema RH, te je predstečajnom nagodbom Tankerkomercu otpisalo 50 posto glavnice poreznog duga, te sve redovne i zatezne kamate na neplaćeni porezni dug, tako da je ukupni porezni dug koji je podnositelj bio dužan podmiriti po predstečajnoj nagodbi nakon navedenih otpisa iznosio 27.838.143,81 kuna.

Ministar financija je dopisom od 4. rujna 2014. utvrdio da Tankerkomerc nije postupio po njegovom dopisu od 1. srpnja 2014. kojim je bio pozvan dostaviti dokaz o tome da je u roku od 30 dana od pravomoćnosti rješenja o potvrđivanju predstečajne nagodbe izvršio prijenos vlasništva nekretnina na svoje trgovačko društvo i brisanje svih tereta, odnosno zaključio odgovarajuće ugovore, zbog čega je obavijestio Tankerkomerc da predstečajnu nagodbu smatra raskinutom

Županijsko državno odvjetništvo u Zadru je potom zahtjevom za mirno rješenje spora 2014. pozvalo Tankerkomerc da dostavi dokaze o prijenosu vlasništva i brisanju tereta s nekretnina obuhvaćenih predstečajnom nagodbom, uz obavijest da će u protivnom podnijeti tužbeni zahtjev radi utvrđenja da se predstečajna nagodba smatra raskinutom.

Budući da je predstečajnu nagodbu smatralo raskinutom, Ministarstvo financija je na temelju obračuna poreznog duga, odnosno prijava poreza i rješenja o utvrđivanju porezne obveze te drugih isprava, ali i na temelju predstečajne nagodbe kao ovršne isprave, donijelo rješenje kojim je određena ovrha na novčanim sredstvima Tankerkomerca radi naplate poreznog duga u ukupnom iznosu od 53.413.133,95 kuna.

Ustavni sud je, međutim, utvrdio da su ugovorene odredbe o raskidnom uvjetu i roku predstečajne nagodbe ne samo imale legitimni cilj u naplati poreznog duga, već su bile prikladne i nužne radi ostvarenja tog cilja, dok se raskid predstečajne nagodbe kojim je dospio ukupni porezni dug naplativ u ovom postupku porezne ovrhe ne može pripisati postupanju tuženog javnopravnog tijela, već ukupnom ponašanju Tankerkomerca.

Tankerkomerc, je, kako navode, ponudio platiti porezni dug prijenosom vlasništva nekretnina koje su ili opterećene ili nisu u njegovom vlasništvu, te je svjesno izrazio pristanak na raskidne uvjete i rokove koji su služili kao korektiv navedenoj situaciji i najprikladniji instrument osiguranja naplate poreznog duga. Te preuzete obveze u konačnici nije ispunio, čime je predstečajna nagodba raskinuta 2014. godine.

Zadarski Tankerkomerc državi mora platiti više od 50 milijuna kuna poreznog duga, a Ustavni sud tvrdi: predstečajna nagodba je bila legitimna!

Ustavni sud RH nije našao ništa sporno u presudama prema kojima zadarska tvrtka 'Tankerkomerc' državi mora platiti čak 52.304.591,98 kuna poreznog duga.

Smatrajući da su im povrijeđena ustavna prav Tankerkomerc d.d. Se žalio Ustavnom sudu RH povodom presude Visokog upravnog suda RH iz 2021. kojom im je odbijena žalba i potvrđena presuda Upravnog suda u Splitu. Presudama im je odbijen zahtjev za poništenjem rješenja Ministarstva financija RH od 23. studenoga 2017. kojim je određena ovrha na novčanim sredstvima radi naplate poreznog duga u ukupnom iznosu od 52.304.591,98 kuna.

Postupak predstečajne nagodbe na temelju izmijenjenog i dopunjenog plana financijskog restrukturiranja Tankerkomercu odobren je rješenjem Trgovačkog suda u Zadru 14. veljače 2014. godine. U postupku predstečajne nagodbe Ministasrtvo financija prijavilo je kao vjerovnik Grupe I porezni dug prema RH, te je predstečajnom nagodbom Tankerkomercu otpisalo 50 posto glavnice poreznog duga, te sve redovne i zatezne kamate na neplaćeni porezni dug, tako da je ukupni porezni dug koji je podnositelj bio dužan podmiriti po predstečajnoj nagodbi nakon navedenih otpisa iznosio 27.838.143,81 kuna.

Ministar financija je dopisom od 4. rujna 2014. utvrdio da Tankerkomerc nije postupio po njegovom dopisu od 1. srpnja 2014. kojim je bio pozvan dostaviti dokaz o tome da je u roku od 30 dana od pravomoćnosti rješenja o potvrđivanju predstečajne nagodbe izvršio prijenos vlasništva nekretnina na svoje trgovačko društvo i brisanje svih tereta, odnosno zaključio odgovarajuće ugovore, zbog čega je obavijestio Tankerkomerc da predstečajnu nagodbu smatra raskinutom

Županijsko državno odvjetništvo u Zadru je potom zahtjevom za mirno rješenje spora 2014. pozvalo Tankerkomerc da dostavi dokaze o prijenosu vlasništva i brisanju tereta s nekretnina obuhvaćenih predstečajnom nagodbom, uz obavijest da će u protivnom podnijeti tužbeni zahtjev radi utvrđenja da se predstečajna nagodba smatra raskinutom.
