U četvrtak ujutro ponovno "drama" na Kalelargi. Komunalni redari su po treći put pokušali maknuti stolove i stolice kafića ‘Mimoza‘ u vlasništvu Branka Bungura Soma, no u svom naumu nisu uspjeli. Bungur je jutros stolove i stolice zavezao žicom za stupove trijema na Kalelargi. Napominje da stolove i stolice neće micati jer, "ako mogu drugi može i on".
Bungur se jučer komunalnim redarima pravdao kako površina na kojoj drži terasu nije u vlasništvu Grada Zadra nego stanara susjedne zgrade. Zbog toga, kako je rekao, ne treba imati dozvolu Grada, niti ugovor o zakupu javne površine.
- Ova površina je vlasništvo stanara i sustanara zgrade, a ne Grada Zadra. Meni zbog toga ne treba nikakav ugovor o zakupu. Meni 30 godina ne daju rješenje za četiri stola, a drugi imaju i po 40 stolova, kazao je Bungur.
I da je to tako kako Bungur tvrdi, Kalelarga je u svojoj namjeni, odnosno režimu korištenja, javna površina, jer je na Gradskom vijeću proglašena javnim dobrom u općoj uporabi, a javnim površinama gospodari isključivo Grad Zadar.
Osim toga, sporni dio Kalelarge u zemljišnim knjigama je upisan u vlasništvu Grada Zadra. Protiv tog upisa podnijeta je jedna sudska tužba od strane Živka Šokote, ali dok se taj postupak pravomoćno ne okonča, i eventualno promjeni status vlasništva, vlasnik spornog dijela Kalelarge ostaje Grad Zadar.
U spomenutom postupku dosad su donijete dvije sudske presude i obje idu u korist Grad Zadra.
- Nekretnina oznake k.č. 10044 k.o. Zadar, zk uložak broj 12979, u naravi predstavlja stambeno-poslovnu zgradu sa zemljištem, ukupne površine 823 m2. U odnosu na predmetnu zgradu proveden je postupak etažiranja, te su u zemljišnim knjigama upisane sve pripadajuće etažne jedinice (E1 do E39). U zemljišno-knjižnom ulošku opisno je navedeno što pripada svakoj pojedinoj etažnoj jedinici, a u etažnom elaboratu isto je prezirano površinom i bojom – kažu iz gradske uprave uz objašnjenje kako je razvidno da je „u odnosu na javnu površinu (natkriveni trijem i dva prolaza) u zemljišnim knjigama izvršen upis u etažnu jedinicu E-39 kao javno dobro u općoj uporabi – javni prolaz i trijemovi u neotuđivom vlasništvu Grada Zadra”.
Posredno se također navodi kako se u odnosu na zemljišno-knjižni upis etaže E-39 (natkriveni javni trijem i dva prolaza) vode dva sudska postupka pred Općinskim i Trgovačkim sudom u kojima su donesene prvostupanjske presude u korist Grada Zadra, a kojima se potvrđuje da predmetna etaža nesporno predstavlja komunalnu infrastrukturu odnosno javno dobro u općoj uporabi u vlasništvu jedinice lokalne samoupravne odnosno Grada Zadra, navode iz Grada Zadra.
To znači da dok sud ne dokaže suprotno, Grad Zadar gospodari terasom ”Mimoze”, te su za nju nadležni komunalni redari. I svatko tko želi postaviti terasu na tom dijelu mora imati ugovor o zakupu javne površine.

U četvrtak ujutro ponovno "drama" na Kalelargi. Komunalni redari su po treći put pokušali maknuti stolove i stolice kafića ‘Mimoza‘ u vlasništvu Branka Bungura Soma, no u svom naumu nisu uspjeli. Bungur je jutros stolove i stolice zavezao žicom za stupove trijema na Kalelargi. Napominje da stolove i stolice neće micati jer, "ako mogu drugi može i on".
Bungur se jučer komunalnim redarima pravdao kako površina na kojoj drži terasu nije u vlasništvu Grada Zadra nego stanara susjedne zgrade. Zbog toga, kako je rekao, ne treba imati dozvolu Grada, niti ugovor o zakupu javne površine.
- Ova površina je vlasništvo stanara i sustanara zgrade, a ne Grada Zadra. Meni zbog toga ne treba nikakav ugovor o zakupu. Meni 30 godina ne daju rješenje za četiri stola, a drugi imaju i po 40 stolova, kazao je Bungur.
I da je to tako kako Bungur tvrdi, Kalelarga je u svojoj namjeni, odnosno režimu korištenja, javna površina, jer je na Gradskom vijeću proglašena javnim dobrom u općoj uporabi, a javnim površinama gospodari isključivo Grad Zadar.
Osim toga, sporni dio Kalelarge u zemljišnim knjigama je upisan u vlasništvu Grada Zadra. Protiv tog upisa podnijeta je jedna sudska tužba od strane Živka Šokote, ali dok se taj postupak pravomoćno ne okonča, i eventualno promjeni status vlasništva, vlasnik spornog dijela Kalelarge ostaje Grad Zadar.
U spomenutom postupku dosad su donijete dvije sudske presude i obje idu u korist Grad Zadra.
- Nekretnina oznake k.č. 10044 k.o. Zadar, zk uložak broj 12979, u naravi predstavlja stambeno-poslovnu zgradu sa zemljištem, ukupne površine 823 m2. U odnosu na predmetnu zgradu proveden je postupak etažiranja, te su u zemljišnim knjigama upisane sve pripadajuće etažne jedinice (E1 do E39). U zemljišno-knjižnom ulošku opisno je navedeno što pripada svakoj pojedinoj etažnoj jedinici, a u etažnom elaboratu isto je prezirano površinom i bojom – kažu iz gradske uprave uz objašnjenje kako je razvidno da je „u odnosu na javnu površinu (natkriveni trijem i dva prolaza) u zemljišnim knjigama izvršen upis u etažnu jedinicu E-39 kao javno dobro u općoj uporabi – javni prolaz i trijemovi u neotuđivom vlasništvu Grada Zadra”.
Posredno se također navodi kako se u odnosu na zemljišno-knjižni upis etaže E-39 (natkriveni javni trijem i dva prolaza) vode dva sudska postupka pred Općinskim i Trgovačkim sudom u kojima su donesene prvostupanjske presude u korist Grada Zadra, a kojima se potvrđuje da predmetna etaža nesporno predstavlja komunalnu infrastrukturu odnosno javno dobro u općoj uporabi u vlasništvu jedinice lokalne samoupravne odnosno Grada Zadra, navode iz Grada Zadra.
To znači da dok sud ne dokaže suprotno, Grad Zadar gospodari terasom ”Mimoze”, te su za nju nadležni komunalni redari. I svatko tko želi postaviti terasu na tom dijelu mora imati ugovor o zakupu javne površine.
