Anita, Magdalena i Marina Ivanković-Lijanović, supruge braće Lijanović, Jerka, Mladena i Slave Ivankovića-Lijanovića, biznismena i političara iz Širokog Brijega, vlasnika mesne industrije „Lijanovići“, ostale su, najnovijom presudom Ustavnog suda BiH „praznih ruku“.

Naime, Ustavni sud BiH je kao nedopuštenu ocijenio apelaciju navedenih triju supruga Lijanovića, protiv presude Vrhovnog suda FBiH od 18. veljače 2020. godine, piše Fokus.ba.

Naime, Anita, Magdalena i Marina tužile su tvrtku Lijanovići d.o.o. koje su osnovali njihovi muževi, Jerko, Mladen i Slavo, s navodima da su suvlasnice po osnovu bračne stečevine. No, riješavajući po presudama Općinskog, a zatim i Kantonalnog suda u Širokom Brijegu, Vrhovni sud FBiH je zauzeo stav da tvrtka Lijanovići d.o.o. nije pasivno legitimirano u sporu po zahtjevu za utvrđenje bračne stečevine, jer nije sudionik u materijalnopravnom odnosu povodom kojeg je taj spor nastao.

Nadalje je sud ocijenio neosnovanim revizijski prigovor da je za zasnivanje hipoteke na nekretnini u vlasništvu Hypo Alpe Adria Banke bilo potrebno pribaviti suglasnost apelantica, kao supruga osnivača drugotuženog.

S tim u vezi sud je istaknuo da su predmetne nekretnine u vrijeme zasnivanja hipoteke bile u vlasništvu te banke koja je njima mogla slobodno raspolagati, bez suglasnosti kako osnivača društva, tako i njihovih bračnih partnera, jer društvo s ograničenom odgovornošću ima svojstvo pravne osobe i svoju imovinu koja se ne može poistovjetiti s imovinom osnivača tog društva.

Pored toga, sud je naglasio da predmetnim nekretninama, suprotno navodima apelantica, nisu raspolagali osnivači društva, već samo društvo, kao i da se predmetni izvršni postupak ne vodi protiv osnivača drugotuženog, zbog prodaje njihovih osnivačkih udjela, nego na nekretninama u vlasništvu spomenute banke. Ovakve navode Ustavni sud je uvažio.

Supruge Lijanovića su pak navele da su lišene njihove imovine koju su stekle u braku i da su ih sudovi diskriminirali ne priznajući njihovo učešće u stvaranju bračne stečevine.

Inače, od navedene braće, koji su prije osam godine uhićeni u akciji „Meso“ koju su po nalogu Tužilteljstva BiH proveli pripadnici SIPA-e, trenutno jedino Jerko Ivanković Lijanović izdržava sedmogodišnju kaznu zatvora u KPZ Zenica.

On je presudom Kantonalnog suda u Tuzli 2018. godine prvobitno osuđen na devet godina zatvora za počinjenje kaznenih djela udruživanja zbog činjenja kaznenih djela i zloupotrebe položaja ili ovlasti dok je bio federalni ministar poljoprivrede. Vrhovni sud mu je godinu kasnije smanjio kaznu na sedam godina zatvora.

U drugom sudskom procesu pred Sudom BiH, Jerko Ivanković Lijanović je prvostupanjskom presudom za organizirani kriminal osuđen na 12 godina zatvora, da bi u ponovljenom suđenju bio oslobođen svih optužbi, jednako kao i drugi optuženi.

Prvostupanjskom presudom Jerko Ivanković Lijanović i još osam optuženih bili su osuđeni na ukupno 52 godine i osam mjeseci zatvora zbog organiziranog kriminala, pranja novca, porezne utaje i neplaćanja poreza te krivotvorenja ili uništenja poslovnih knjiga ili isprava.

Jerko Ivanković Lijanović bio je osuđen na 12 godina i novčanu kaznu od 50.000 konvertibilnih maraka (KM), dok je Slavo Ivanković Lijanović dobio deset godina zatvora i novčanu kaznu od 30.000 KM.

Firma “Farmer” prvostupanjskom presudom je novčano kažnjena sa 800.000 maraka, “Farmko” je novčano kažnjen s dva miljuna KM, a “Optimum” sa 200.000 maraka. Od Jerka i Slave Ivankovića Lijanovića se prvostupanjskom presudom oduzimala imovinska korist veća od 800.000 maraka, od Čolaka šest milijuna KM pribavljena djelima.

Jozo Ivanković Lijanović je tom prvostupanjskom presudom oslobođen krivnje za organizirani kriminal i pranje novca, dok je optuženica odbijena u odnosu na pojedine točke koje su teretile Slavu Ivankovića Lijanovića, Bahilja, Galića te firme “Lijanovići” i “Mi-Mo”, piše Fokus.ba.

Anita, Magdalena i Marina Ivanković-Lijanović, supruge braće Lijanović, Jerka, Mladena i Slave Ivankovića-Lijanovića, biznismena i političara iz Širokog Brijega, vlasnika mesne industrije „Lijanovići“, ostale su, najnovijom presudom Ustavnog suda BiH „praznih ruku“.

Naime, Ustavni sud BiH je kao nedopuštenu ocijenio apelaciju navedenih triju supruga Lijanovića, protiv presude Vrhovnog suda FBiH od 18. veljače 2020. godine, piše Fokus.ba.

Naime, Anita, Magdalena i Marina tužile su tvrtku Lijanovići d.o.o. koje su osnovali njihovi muževi, Jerko, Mladen i Slavo, s navodima da su suvlasnice po osnovu bračne stečevine. No, riješavajući po presudama Općinskog, a zatim i Kantonalnog suda u Širokom Brijegu, Vrhovni sud FBiH je zauzeo stav da tvrtka Lijanovići d.o.o. nije pasivno legitimirano u sporu po zahtjevu za utvrđenje bračne stečevine, jer nije sudionik u materijalnopravnom odnosu povodom kojeg je taj spor nastao.

Nadalje je sud ocijenio neosnovanim revizijski prigovor da je za zasnivanje hipoteke na nekretnini u vlasništvu Hypo Alpe Adria Banke bilo potrebno pribaviti suglasnost apelantica, kao supruga osnivača drugotuženog.

S tim u vezi sud je istaknuo da su predmetne nekretnine u vrijeme zasnivanja hipoteke bile u vlasništvu te banke koja je njima mogla slobodno raspolagati, bez suglasnosti kako osnivača društva, tako i njihovih bračnih partnera, jer društvo s ograničenom odgovornošću ima svojstvo pravne osobe i svoju imovinu koja se ne može poistovjetiti s imovinom osnivača tog društva.

Pored toga, sud je naglasio da predmetnim nekretninama, suprotno navodima apelantica, nisu raspolagali osnivači društva, već samo društvo, kao i da se predmetni izvršni postupak ne vodi protiv osnivača drugotuženog, zbog prodaje njihovih osnivačkih udjela, nego na nekretninama u vlasništvu spomenute banke. Ovakve navode Ustavni sud je uvažio.

Supruge Lijanovića su pak navele da su lišene njihove imovine koju su stekle u braku i da su ih sudovi diskriminirali ne priznajući njihovo učešće u stvaranju bračne stečevine.

Inače, od navedene braće, koji su prije osam godine uhićeni u akciji „Meso“ koju su po nalogu Tužilteljstva BiH proveli pripadnici SIPA-e, trenutno jedino Jerko Ivanković Lijanović izdržava sedmogodišnju kaznu zatvora u KPZ Zenica.

On je presudom Kantonalnog suda u Tuzli 2018. godine prvobitno osuđen na devet godina zatvora za počinjenje kaznenih djela udruživanja zbog činjenja kaznenih djela i zloupotrebe položaja ili ovlasti dok je bio federalni ministar poljoprivrede. Vrhovni sud mu je godinu kasnije smanjio kaznu na sedam godina zatvora.

U drugom sudskom procesu pred Sudom BiH, Jerko Ivanković Lijanović je prvostupanjskom presudom za organizirani kriminal osuđen na 12 godina zatvora, da bi u ponovljenom suđenju bio oslobođen svih optužbi, jednako kao i drugi optuženi.

Prvostupanjskom presudom Jerko Ivanković Lijanović i još osam optuženih bili su osuđeni na ukupno 52 godine i osam mjeseci zatvora zbog organiziranog kriminala, pranja novca, porezne utaje i neplaćanja poreza te krivotvorenja ili uništenja poslovnih knjiga ili isprava.

Jerko Ivanković Lijanović bio je osuđen na 12 godina i novčanu kaznu od 50.000 konvertibilnih maraka (KM), dok je Slavo Ivanković Lijanović dobio deset godina zatvora i novčanu kaznu od 30.000 KM.

Firma “Farmer” prvostupanjskom presudom je novčano kažnjena sa 800.000 maraka, “Farmko” je novčano kažnjen s dva miljuna KM, a “Optimum” sa 200.000 maraka. Od Jerka i Slave Ivankovića Lijanovića se prvostupanjskom presudom oduzimala imovinska korist veća od 800.000 maraka, od Čolaka šest milijuna KM pribavljena djelima.

Jozo Ivanković Lijanović je tom prvostupanjskom presudom oslobođen krivnje za organizirani kriminal i pranje novca, dok je optuženica odbijena u odnosu na pojedine točke koje su teretile Slavu Ivankovića Lijanovića, Bahilja, Galića te firme “Lijanovići” i “Mi-Mo”, piše Fokus.ba.
