Kakofonija mišljenja, različitih tumačenja hrvatskih zakona, zagušila je posljednja dva dana budući da nema jedinstvenog mišljenja o situaciji u kojoj smo se našli odlukama bez presedana prvog čovjeka države!

Treba li Zoran Milanović dati ostavku ako ide u izbornu utrku za premijera države, kako će to on tražiti sam od sebe (od aktualnog predsjednika države) mandat za sastavljanje Vlade RH ako pobijedi u utrci za premijera?

Kada treba dati ostavku u kampanji, ako svaki građanin može sudjelovati na izborima i kao nestranački kandidat, je li vrijeme prisege u Saboru jedina točka kada Milanović mora odstupiti sa predsjedničkog trona budući da su te dvije funkcije nespojive - predsjednika države i saborskog zastupnika?

Mnogo pitanja, mnogo nedoumica, mnogo prijepora oko toga što je pravno, ustavno točno, te smo upitali stručnjaka za ustavno pravo, prof. dr. sc. Petra Bačića, predstojnik Katedre za Ustavno pravo na Pravnom fakultetu Sveučilišta u Splitu, pojašnjenje Milanovićeve odluke.

- Uvodno ću podsjetiti da nakon ustavnih promjena 2000. godine predsjednik Republike u Hrvatskoj pripada onom tipu državnih poglavara kojemu ustavnopravni položaj uglavnom povjerava simboličku funkciju šefa države i čiji se sadržaj uglavnom iscrpljuje u predstavničkoj i političkoj ulozi, ali bez značajnijih izvršnih ovlasti.

No, predsjednik Republike i dalje ima i može koristiti određene mogućnosti formuliranja političkih odluka. To upućuje na određene njegove izvanredne i diskrecijske ovlasti kao ustavnog arbitra ili jamca stabilnosti poretka. Pozitivno se takva uloga iscrpljuje kada predsjednik Republike djeluje kao faktor nacionalnog jedinstva i kada je moderator političkih sukoba, jamac kontinuiteta i stabilnosti.

Druga je priča međutim ako takav akter izađe iz okvira ustavne uloge i političke tolerancije. Najava predsjednika Republike da će se kandidirati na parlamentarnim izborima svakako je potez bez presedana. Činjenica da važeći ustavnopravni okvir, dakle ni Ustav RH ni relevantni zakoni, ne sadrži izričito rješenje u ovom slučaju, ipak ne znači da ispravno rješenje ne postoji. Do njega dolazimo njihovim tumačenjem, a onda je sasvim očekivano da dolazi i do razilaženja u mišljenjima.

Međutim, ovdje se apsolutno moramo prikloniti onom tumačenju koje je najbliže duhu i tekstu našeg Ustava, odnosno ustavnoj poziciji predsjednika Republike kao državnog poglavara koji je nestranačka osoba i mora djelovati kao jamac stabilnosti državne vlasti. Dakle, preduvjet za uključivanje Zorana Milanovića u izbornu utrku jest njegova ostavka na poziciju predsjednika Republike.

To je ispravan potez i očekujem da će i Ustavni sud kao čuvar Ustava i ustavnosti zauzeti upravo takvo stajalište. Nimalo ne sumnjam da će odluku Ustavnog suda, ma kakva ona bila, poštovati svi - rezimira prof. dr. sc. Petar Bačić.

Kakofonija mišljenja, različitih tumačenja hrvatskih zakona, zagušila je posljednja dva dana budući da nema jedinstvenog mišljenja o situaciji u kojoj smo se našli odlukama bez presedana prvog čovjeka države!

Treba li Zoran Milanović dati ostavku ako ide u izbornu utrku za premijera države, kako će to on tražiti sam od sebe (od aktualnog predsjednika države) mandat za sastavljanje Vlade RH ako pobijedi u utrci za premijera?

Kada treba dati ostavku u kampanji, ako svaki građanin može sudjelovati na izborima i kao nestranački kandidat, je li vrijeme prisege u Saboru jedina točka kada Milanović mora odstupiti sa predsjedničkog trona budući da su te dvije funkcije nespojive - predsjednika države i saborskog zastupnika?

Mnogo pitanja, mnogo nedoumica, mnogo prijepora oko toga što je pravno, ustavno točno, te smo upitali stručnjaka za ustavno pravo, prof. dr. sc. Petra Bačića, predstojnik Katedre za Ustavno pravo na Pravnom fakultetu Sveučilišta u Splitu, pojašnjenje Milanovićeve odluke.

- Uvodno ću podsjetiti da nakon ustavnih promjena 2000. godine predsjednik Republike u Hrvatskoj pripada onom tipu državnih poglavara kojemu ustavnopravni položaj uglavnom povjerava simboličku funkciju šefa države i čiji se sadržaj uglavnom iscrpljuje u predstavničkoj i političkoj ulozi, ali bez značajnijih izvršnih ovlasti.

No, predsjednik Republike i dalje ima i može koristiti određene mogućnosti formuliranja političkih odluka. To upućuje na određene njegove izvanredne i diskrecijske ovlasti kao ustavnog arbitra ili jamca stabilnosti poretka. Pozitivno se takva uloga iscrpljuje kada predsjednik Republike djeluje kao faktor nacionalnog jedinstva i kada je moderator političkih sukoba, jamac kontinuiteta i stabilnosti.

Druga je priča međutim ako takav akter izađe iz okvira ustavne uloge i političke tolerancije. Najava predsjednika Republike da će se kandidirati na parlamentarnim izborima svakako je potez bez presedana. Činjenica da važeći ustavnopravni okvir, dakle ni Ustav RH ni relevantni zakoni, ne sadrži izričito rješenje u ovom slučaju, ipak ne znači da ispravno rješenje ne postoji. Do njega dolazimo njihovim tumačenjem, a onda je sasvim očekivano da dolazi i do razilaženja u mišljenjima.

Međutim, ovdje se apsolutno moramo prikloniti onom tumačenju koje je najbliže duhu i tekstu našeg Ustava, odnosno ustavnoj poziciji predsjednika Republike kao državnog poglavara koji je nestranačka osoba i mora djelovati kao jamac stabilnosti državne vlasti. Dakle, preduvjet za uključivanje Zorana Milanovića u izbornu utrku jest njegova ostavka na poziciju predsjednika Republike.

To je ispravan potez i očekujem da će i Ustavni sud kao čuvar Ustava i ustavnosti zauzeti upravo takvo stajalište. Nimalo ne sumnjam da će odluku Ustavnog suda, ma kakva ona bila, poštovati svi - rezimira prof. dr. sc. Petar Bačić.
