Na Upravnom sudu u Splitu provedeno je ročište po tužbi Ljiljane Zmijanović protiv Državnog inspektorata u kojoj traži ostvarivanje prava prednosti kao braniteljica na natječaju za ravnateljicu "NP Krka". Zmijanović smatra kako je imenovanjem Nelle Slavice za ravnateljicu Javne ustanove povrijeđeno njezino pravo prednosti pri zapošljavanju kao nezaposlene hrvatske braniteljice.

Inače, na istom sudu vodi se i drugi postupak u kojem Zmijanović tuži Ministarstvo zaštite okoliša i energetike te je taj stavljen na čekanje dok se ne donese odluka u ovom novijem. Sporan je natječaj za ravnatelja iz prosinca 2018. godine, na koji se javilo sedam kandidata.

Među njima i Ljiljana Zmijanović, koja smatra da uz reference doktorice znanosti ima prednost i kao braniteljica. Izabrana je Nella Slavica, koja je u to vrijeme bila na dužnosti direktorice šibenskog Studentskog centra.

Jedan od razloga zašto je izabrana upravo Slavica bio je i intervjuu koji je obavljen sa svim kandidatima, a na kojemu je, prema rješenju ministarstva, ona ostavila najbolji dojam. Nakon toga Ljiljana Zmijanović podnijela je prvu tužbu Upravnom sudu 2019. godine te je navela kako su izborom druge kandidatkinje grubo prekršena njezina prava koja proizlaze iz statusa nezaposlene hrvatske braniteljice.

Više kvalificirana

Osim prednosti statusa hrvatskog branitelja, istaknula je kako je kao doktorica znanosti više kvalificirana za taj posao od izabrane Nelle Slavice, diplomirane ekonomistice. U srpnju 2019. godine donesena je presuda kojom je rješenje o imenovanju vraćeno ministarstvu na ponovno odlučivanje.

U odluci je navedeno kako nije sporno da su i Ljiljana Zmijanović i Nella Slavica ispunjavale uvjete propisane natječajem. Nije sporno ni da Zmijanović ima status hrvatskog branitelja dragovoljca te da se u prijavi na natječaj pozvala na pravo prednosti prilikom zapošljavanja, stajalo je u presudi.

Trebalo je utvrditi je li "NP Krka" zakonito proveo postupak jer u tekstu oglasa javnog natječaja, pored propisanih uvjeta natječaja, nije javno objavio da će kandidati pristupiti razgovoru, intervjuu, radi utvrđivanja njihovih stručnih znanja, sposobnosti i vještina te programa rada. Konačni izbor kandidata obavljen je nakon provedenog razgovora, stoji u presudi.

Kako je to bio uvjet odlučujući za izbor, po ocjeni Upravnog suda počinjena je bitna povreda postupka jer je razgovor morao biti sadržan u javno objavljenom tekstu natječaja, a što u konkretnoj upravnoj stvari nije bio slučaj. Zato je presudom rješenje o imenovanju vraćeno ministarstvu na ponovno odlučivanje.

Oni su prilikom drugog odlučivanja ponovno izabrali Nellu Slavicu pa je Ljiljana Zmijanović podnijela novu upravnu tužbu. Nakon toga je Ministarstvo zaštite okoliša i energetike zatražilo izuzeće sutkinje koja je vodila predmet i koja je donijela prvu presudu. Za ministarstvo je bilo sporno što je sutkinja odlučivala po prvoj upravnoj tužbi Ljiljane Zmijanović i presudila u njezinu korist.

Kako je Nella Slavica u ponovljenom postupku drugi put imenovana, a Zmijanović ponovno podnijela upravnu tužbu, smatrali su da treba odlučivati drugi sudac. Zahtjev je odbio Silvio Čović, predsjednik Upravnog suda u Splitu, uz obrazloženje da nema ni jedan zakonom propisani razlog za dodjelu predmeta drugom sucu.

Druga tužba

U međuvremenu je Ljiljana Zmijanović podnijela novu tužbu, ovaj put protiv Državnog inspektorata, koji je svojim drugostupanjskim rješenjem odbio njezin zahtjev za ostvarivanje prava prednosti prilikom zapošljavanja. Naime, u prosincu 2019. godine, Državni inspektorat, Područni ured Split usvojio je njezin zahtjev te je utvrđeno da je "NP Krka" povrijedio pravo prednosti pri zapošljavanju hrvatskoj braniteljici Ljiljani Zmijanović.

Na odluku se žalila Javna ustanova te je Državni inspektorat, Sektor za drugostupanjski postupak u svibnju prošle godine donio novo rješenje kojim je odbio zahtjev Ljiljane Zmijanović. Stoga ona u lipnju iste godine podnosi tužbu Upravnom sudu protiv Državnog inspektorata i traži poništenje njihova drugostupanjskog rješenja.

Po toj tužbi je održana rasprava, a prvi postupak u kojem tuži ministarstvo je prekinut dok se ovaj pravomoćno ne odluči. Naime, tek nakon odluke u slučaju spora s inspektoratom, odlučivat će se o slučaju u kojem se spori s ministarstvom. Pojednostavljeno, odluka u tom slučaju naslonit će se na presudu iz ovoga jer, iako se u postupku protiv ministarstva tuži po široj osnovi, ovaj iz spora s inspektoratom je temeljan.

Na Upravnom sudu u Splitu provedeno je ročište po tužbi Ljiljane Zmijanović protiv Državnog inspektorata u kojoj traži ostvarivanje prava prednosti kao braniteljica na natječaju za ravnateljicu "NP Krka". Zmijanović smatra kako je imenovanjem Nelle Slavice za ravnateljicu Javne ustanove povrijeđeno njezino pravo prednosti pri zapošljavanju kao nezaposlene hrvatske braniteljice.

Inače, na istom sudu vodi se i drugi postupak u kojem Zmijanović tuži Ministarstvo zaštite okoliša i energetike te je taj stavljen na čekanje dok se ne donese odluka u ovom novijem. Sporan je natječaj za ravnatelja iz prosinca 2018. godine, na koji se javilo sedam kandidata.

Među njima i Ljiljana Zmijanović, koja smatra da uz reference doktorice znanosti ima prednost i kao braniteljica. Izabrana je Nella Slavica, koja je u to vrijeme bila na dužnosti direktorice šibenskog Studentskog centra.

Jedan od razloga zašto je izabrana upravo Slavica bio je i intervjuu koji je obavljen sa svim kandidatima, a na kojemu je, prema rješenju ministarstva, ona ostavila najbolji dojam. Nakon toga Ljiljana Zmijanović podnijela je prvu tužbu Upravnom sudu 2019. godine te je navela kako su izborom druge kandidatkinje grubo prekršena njezina prava koja proizlaze iz statusa nezaposlene hrvatske braniteljice.

Više kvalificirana

Osim prednosti statusa hrvatskog branitelja, istaknula je kako je kao doktorica znanosti više kvalificirana za taj posao od izabrane Nelle Slavice, diplomirane ekonomistice. U srpnju 2019. godine donesena je presuda kojom je rješenje o imenovanju vraćeno ministarstvu na ponovno odlučivanje.

U odluci je navedeno kako nije sporno da su i Ljiljana Zmijanović i Nella Slavica ispunjavale uvjete propisane natječajem. Nije sporno ni da Zmijanović ima status hrvatskog branitelja dragovoljca te da se u prijavi na natječaj pozvala na pravo prednosti prilikom zapošljavanja, stajalo je u presudi.

Trebalo je utvrditi je li "NP Krka" zakonito proveo postupak jer u tekstu oglasa javnog natječaja, pored propisanih uvjeta natječaja, nije javno objavio da će kandidati pristupiti razgovoru, intervjuu, radi utvrđivanja njihovih stručnih znanja, sposobnosti i vještina te programa rada. Konačni izbor kandidata obavljen je nakon provedenog razgovora, stoji u presudi.

Kako je to bio uvjet odlučujući za izbor, po ocjeni Upravnog suda počinjena je bitna povreda postupka jer je razgovor morao biti sadržan u javno objavljenom tekstu natječaja, a što u konkretnoj upravnoj stvari nije bio slučaj. Zato je presudom rješenje o imenovanju vraćeno ministarstvu na ponovno odlučivanje.

Oni su prilikom drugog odlučivanja ponovno izabrali Nellu Slavicu pa je Ljiljana Zmijanović podnijela novu upravnu tužbu. Nakon toga je Ministarstvo zaštite okoliša i energetike zatražilo izuzeće sutkinje koja je vodila predmet i koja je donijela prvu presudu. Za ministarstvo je bilo sporno što je sutkinja odlučivala po prvoj upravnoj tužbi Ljiljane Zmijanović i presudila u njezinu korist.

Kako je Nella Slavica u ponovljenom postupku drugi put imenovana, a Zmijanović ponovno podnijela upravnu tužbu, smatrali su da treba odlučivati drugi sudac. Zahtjev je odbio Silvio Čović, predsjednik Upravnog suda u Splitu, uz obrazloženje da nema ni jedan zakonom propisani razlog za dodjelu predmeta drugom sucu.

Druga tužba

U međuvremenu je Ljiljana Zmijanović podnijela novu tužbu, ovaj put protiv Državnog inspektorata, koji je svojim drugostupanjskim rješenjem odbio njezin zahtjev za ostvarivanje prava prednosti prilikom zapošljavanja. Naime, u prosincu 2019. godine, Državni inspektorat, Područni ured Split usvojio je njezin zahtjev te je utvrđeno da je "NP Krka" povrijedio pravo prednosti pri zapošljavanju hrvatskoj braniteljici Ljiljani Zmijanović.

Na odluku se žalila Javna ustanova te je Državni inspektorat, Sektor za drugostupanjski postupak u svibnju prošle godine donio novo rješenje kojim je odbio zahtjev Ljiljane Zmijanović. Stoga ona u lipnju iste godine podnosi tužbu Upravnom sudu protiv Državnog inspektorata i traži poništenje njihova drugostupanjskog rješenja.

Po toj tužbi je održana rasprava, a prvi postupak u kojem tuži ministarstvo je prekinut dok se ovaj pravomoćno ne odluči. Naime, tek nakon odluke u slučaju spora s inspektoratom, odlučivat će se o slučaju u kojem se spori s ministarstvom. Pojednostavljeno, odluka u tom slučaju naslonit će se na presudu iz ovoga jer, iako se u postupku protiv ministarstva tuži po široj osnovi, ovaj iz spora s inspektoratom je temeljan.
