Bivši direktor Fonda za zaštitu okoliša i energetsku učinkovitost Vinko Mladineo u srijedu je na zagrebačkom Županijskom sudu nepravomoćno oslobođen optužbe da je dogovarajući poslove s marketinškom agencijom Fimi-Medijom Fond kojem je bio na čelu oštetio za oko 1,2 milijuna kuna.

Tužiteljstvo je Mladinea teretilo da je od travnja 2008. do kraja 2009. sklapao poslove s Fimi-Medijom iznad tržišne cijene i pritom kršio Zakon o javnoj nabavi. Optužnica je u veljači 2018. izmijenjena pa je iz nje izbačena tvrdnja da je nezakonitosti radio znajući da ilegalno izvučen novac završava u HDZ-ovu "crnom fondu".

Obrazlažući oslobađajuću presudu sudac Tomislav Juriša kazao je da tijekom suđenja nije dokazano kriminalno djelovanje pa je Mladinea trebalo osloboditi. Dodao je da eventualne nepravilnosti izlaze iz okvira kazneno-pravne odgovornosti i ulazi u sferu poduzetničke odgovornosti.

Bivši direktor Fonda za zaštitu okoliša i energetsku učinkovitost Vinko Mladineo u srijedu je na zagrebačkom Županijskom sudu nepravomoćno oslobođen optužbe da je dogovarajući poslove s marketinškom agencijom Fimi-Medijom Fond kojem je bio na čelu oštetio za oko 1,2 milijuna kuna.

Tužiteljstvo je Mladinea teretilo da je od travnja 2008. do kraja 2009. sklapao poslove s Fimi-Medijom iznad tržišne cijene i pritom kršio Zakon o javnoj nabavi. Optužnica je u veljači 2018. izmijenjena pa je iz nje izbačena tvrdnja da je nezakonitosti radio znajući da ilegalno izvučen novac završava u HDZ-ovu "crnom fondu".

Obrazlažući oslobađajuću presudu sudac Tomislav Juriša kazao je da tijekom suđenja nije dokazano kriminalno djelovanje pa je Mladinea trebalo osloboditi. Dodao je da eventualne nepravilnosti izlaze iz okvira kazneno-pravne odgovornosti i ulazi u sferu poduzetničke odgovornosti.

Nepravomoćna presuda: Mladineo nije nezakonito surađivao s 'Fimi-Medijom'
