Arbitražni sud HNS-a odbio je tužbu Hajduku, Savez je tako slobodan prijaviti Dinamo UEFA-i za sudjelovanje u juniorskoj Ligi prvaka, pišu Sportske novosti
Ivica Veselić, sudac Županijskog suda u Zagrebu, kao predsjednik Arbitražnog suda sam je donio tu odluku. Na temelju članka koji govori da u slučaju kad činjenice koje se navode u tužbi nisu sporne, a nisu ih osporili ni HNS, niti Dinamo, pravorijek smije dati sudac pojedinac. Nakon što je pisanim putem obavijestio HNS te oba kluba, Veselić nam je kazao:
- Hajduk je tražio da se odluka Izvršnog odbora HNS-a od 23. srpnja koja je objavljena u Glasniku HNS-a 24. srpnja, a kojom se utvrđuje da je Dinamo ostvario pravo natjecanja u UEFA-inoj Ligi mladih, mijenja odlukom koja je trebala glasiti da se odigra utakmica između juniorskih momčad Hajduka i Dinama najkasnije do 22. kolovoza 2020. Na neutralnom terenu po pravilima koja se primijenjuju u finalu Hrvatskog kupa. Dakle, Hajduk je glavnim tužbenim zahtjevom predložio da se igra majstorica. Potom, ako Sud ne usvoji taj zahtjev, predložili su da se utvrdi kako je Hajduk ostvario pravo na natjecanje u UEFA-inoj Ligi mladih u sezoni 2020/21., a ne prihvati li Sud ni to predložili su da se poništi odluka Izvršnog odbora i vrati mu se na ponovno odlučivanje.
Veselić je na to donio rješenje:
- Svi su zahtjevi odbijeni.
Ponudio je obrazloženje:
- Sud smatra da je legitimno pravo Izvršnog odbora HNS-a, kao najvišeg tijela Saveza, odlučiti da primijeni metodu koeficijenta. HNS je smatrao da je ta metoda najsportskija, kako stoji i u cirkularnom pismu FIFA-e i time se vodio. Sud smatra da je taj odabir kriterija objektivan i nije diskriminirajući za bilo koga. Potvrda toga je i da je odigrano samo 64 posto utakmica Prve juniorske lige.
Veselić još dodaje:
- Odluka je, dakle, u okviru ovlasti Izvršnog odbora. Naravno da je problematično što takvo stanje nije predviđeno u nijednom aktu HNS-a, ni FIFA-e, niti UEFA-e. Pritom je Izvršni odbor to donio na prijedlog Natjecateljske komisije HNS-a. Na temelju korespondencije s UEFA-om koja je navela nekoliko liga u kojima se jednako tako postupilo.
Posjećamo, Izvršni odbor HNS-a dao je prednost Dinamu i zaključio da ga imenuje hrvatskim predstavnikom u juniorskoj Ligi prvaka nakon što je hrvatsko prvenstvo u tom uzrastu prekinuto u trenutku kad je Hajduk imao 42 boda, a Dinamo 40, ali su Modri odigrali susret manje. Primijenio je pravilo koeficijenta (broj bodova podijeljen s brojem nastupa) po kojem je Dinamov 2,50, a Hajdukov 2,47.
U Hajdukovoj tužbi HNS je bio tuženik 1, a Dinamo tuženik 2. Zašto je tužen i Dinamo? Zato što je odgodio utakmicu s Dugopoljem? Veselić je tužbu protiv HNS-a odbio iz razloga koje je naveo, a protiv Dinama zbog "promašene pasivne legitimacije“. Budući da Dinamo nije sudjelovao u odluci Izvršnog odbora HNS-a.
Na kraju Hajduk mora rivalu iz Zagreba platiti 1250 kuna na ime troškova, zbog toga što su angažirali odvjetnika. Zanimljivo je i tko je zastupao Dinamo. Radi se o Davoru Radiću, poznatom splitskom stručnjaku za sportsko pravo koji je u mnogim sporovima bio protiv Dinama. Primjerice po pitanju mladog igrača Ajdina Hasića. Tako to Dinamo radi, najbolje privlači k sebi…

Arbitražni sud HNS-a odbio je tužbu Hajduku, Savez je tako slobodan prijaviti Dinamo UEFA-i za sudjelovanje u juniorskoj Ligi prvaka, pišu Sportske novosti
Ivica Veselić, sudac Županijskog suda u Zagrebu, kao predsjednik Arbitražnog suda sam je donio tu odluku. Na temelju članka koji govori da u slučaju kad činjenice koje se navode u tužbi nisu sporne, a nisu ih osporili ni HNS, niti Dinamo, pravorijek smije dati sudac pojedinac. Nakon što je pisanim putem obavijestio HNS te oba kluba, Veselić nam je kazao:
- Hajduk je tražio da se odluka Izvršnog odbora HNS-a od 23. srpnja koja je objavljena u Glasniku HNS-a 24. srpnja, a kojom se utvrđuje da je Dinamo ostvario pravo natjecanja u UEFA-inoj Ligi mladih, mijenja odlukom koja je trebala glasiti da se odigra utakmica između juniorskih momčad Hajduka i Dinama najkasnije do 22. kolovoza 2020. Na neutralnom terenu po pravilima koja se primijenjuju u finalu Hrvatskog kupa. Dakle, Hajduk je glavnim tužbenim zahtjevom predložio da se igra majstorica. Potom, ako Sud ne usvoji taj zahtjev, predložili su da se utvrdi kako je Hajduk ostvario pravo na natjecanje u UEFA-inoj Ligi mladih u sezoni 2020/21., a ne prihvati li Sud ni to predložili su da se poništi odluka Izvršnog odbora i vrati mu se na ponovno odlučivanje.
Veselić je na to donio rješenje:
- Svi su zahtjevi odbijeni.
Ponudio je obrazloženje:
- Sud smatra da je legitimno pravo Izvršnog odbora HNS-a, kao najvišeg tijela Saveza, odlučiti da primijeni metodu koeficijenta. HNS je smatrao da je ta metoda najsportskija, kako stoji i u cirkularnom pismu FIFA-e i time se vodio. Sud smatra da je taj odabir kriterija objektivan i nije diskriminirajući za bilo koga. Potvrda toga je i da je odigrano samo 64 posto utakmica Prve juniorske lige.
Veselić još dodaje:
- Odluka je, dakle, u okviru ovlasti Izvršnog odbora. Naravno da je problematično što takvo stanje nije predviđeno u nijednom aktu HNS-a, ni FIFA-e, niti UEFA-e. Pritom je Izvršni odbor to donio na prijedlog Natjecateljske komisije HNS-a. Na temelju korespondencije s UEFA-om koja je navela nekoliko liga u kojima se jednako tako postupilo.
Posjećamo, Izvršni odbor HNS-a dao je prednost Dinamu i zaključio da ga imenuje hrvatskim predstavnikom u juniorskoj Ligi prvaka nakon što je hrvatsko prvenstvo u tom uzrastu prekinuto u trenutku kad je Hajduk imao 42 boda, a Dinamo 40, ali su Modri odigrali susret manje. Primijenio je pravilo koeficijenta (broj bodova podijeljen s brojem nastupa) po kojem je Dinamov 2,50, a Hajdukov 2,47.
U Hajdukovoj tužbi HNS je bio tuženik 1, a Dinamo tuženik 2. Zašto je tužen i Dinamo? Zato što je odgodio utakmicu s Dugopoljem? Veselić je tužbu protiv HNS-a odbio iz razloga koje je naveo, a protiv Dinama zbog "promašene pasivne legitimacije“. Budući da Dinamo nije sudjelovao u odluci Izvršnog odbora HNS-a.
Na kraju Hajduk mora rivalu iz Zagreba platiti 1250 kuna na ime troškova, zbog toga što su angažirali odvjetnika. Zanimljivo je i tko je zastupao Dinamo. Radi se o Davoru Radiću, poznatom splitskom stručnjaku za sportsko pravo koji je u mnogim sporovima bio protiv Dinama. Primjerice po pitanju mladog igrača Ajdina Hasića.
