Pet malih tvrtki čije je poslovanje ugroženo za vrijeme pandemije pokrenulo je postupak protiv države u kojem traže obeštećenje zbog, kako tvrde, diskriminatornih odluka Stožera Civilne zaštite i neadekvatnih ekonomskim mjera Vlade, a u tome ih financira i logistički potpomaže Udruga Glas poduzetnika (UGP).

Iznos koji traže sudskim putem javno ne iznose, a kažu da je izračunat u odnosu na promet i dobit koji je svaka od tvrtki imala predpandemijske 2019. godine. Radi se o ugostiteljskim tvrtkama „Đurina hiža” iz Varaždina i Caffe&Wine Bar iz Rijeke, putničkim agencijama „Svi koncerti” iz Varaždina i „Locuples” iz okolice Splita te trgovačkom obrtu Shark Attack iz Primoštena.

Prvi korak u tužbi protiv države za naknadu štete je zahtjev za pokušajem mirnog rješenja, a on je upućen Županijskom državnom odvjetništvu u Zagrebu, rečeno je jučer na konferenciji za novinare koju je organizirao UGP. Kako su objasnili iz odvjetničkog ureda Matić i partneri koji vodi ove slučajeve, to znači da u zakonskom roku od tri mjeseca „država ima dobru šansu da pronađe modalitete i adekvatno rješenje”. Drugim riječima, smatraju da do podnošenja tužbi nadležnim sudovima i ne mora doći ukoliko se država odluči na nagodbu.

Iako je Ustavni sud svojim mišljenjima do sada praktički potvrdio da su mjere koje su donošene zbog pandemije bile u skladu s Ustavom, odvjetnik Mato Matić smatra kako je Stožer Civilne zaštite povrijedio ustavna prava poduzetnika te navodi da su u pitanju ozbiljne povrede tri članka Ustava (49, 50. i 54.). „Tko je Stožer CZ? Na temelju čega je donio 13 odluka? Na temelju ničega”, kaže Matić, objašnjavajući da je država trebala objaviti uvođenje izvanrednog stanja da bi Stožer mogao donositi odluke, te je podsjetio da je o tome svojedobno govorio i predsjednik Zoran Milanović. Ovako, smatra Matić, za te odluke nema zakonske podloge, a nije provedeno niti bilo kakvo istraživanje.

U međuvremenu su, što u odvjetničkom uredu smatraju bitnim, u nekoliko zemalja Europske unije donijete presude koje idu u prilog njihove argumentacije, pa navode da je Ustavni sud Španjolske proglasio lockdown iz proljeća 2020. godine protupravnim, a belgijski sudovi iz Bruxellesa su protupravnom proglasili zabranu rada ugostitelja. Također, navode i odluku Općeg suda Europske unije koja, kako kažu, tumači da bi sve ono što je odlukama Vlade i Stožera CZ zabranjeno ili ograničeno poduzetnicima trebalo biti na neki način nadoknađeno.

Hrvoje Bujas, predsjednik UGP-a, kaže da tužbe članova nisu nikakav blef te poručuje „gospodi u Vladi” da ih shvate ozbiljno. Naglašava da su u pitanju tvrtke koje su do izbijanja pandemije poslovale dobro, a „postale su ruine” ne svojom krivnjom.

Pet malih tvrtki čije je poslovanje ugroženo za vrijeme pandemije pokrenulo je postupak protiv države u kojem traže obeštećenje zbog, kako tvrde, diskriminatornih odluka Stožera Civilne zaštite i neadekvatnih ekonomskim mjera Vlade, a u tome ih financira i logistički potpomaže Udruga Glas poduzetnika (UGP).

Iznos koji traže sudskim putem javno ne iznose, a kažu da je izračunat u odnosu na promet i dobit koji je svaka od tvrtki imala predpandemijske 2019. godine. Radi se o ugostiteljskim tvrtkama „Đurina hiža” iz Varaždina i Caffe&Wine Bar iz Rijeke, putničkim agencijama „Svi koncerti” iz Varaždina i „Locuples” iz okolice Splita te trgovačkom obrtu Shark Attack iz Primoštena.

Prvi korak u tužbi protiv države za naknadu štete je zahtjev za pokušajem mirnog rješenja, a on je upućen Županijskom državnom odvjetništvu u Zagrebu, rečeno je jučer na konferenciji za novinare koju je organizirao UGP. Kako su objasnili iz odvjetničkog ureda Matić i partneri koji vodi ove slučajeve, to znači da u zakonskom roku od tri mjeseca „država ima dobru šansu da pronađe modalitete i adekvatno rješenje”. Drugim riječima, smatraju da do podnošenja tužbi nadležnim sudovima i ne mora doći ukoliko se država odluči na nagodbu.

Iako je Ustavni sud svojim mišljenjima do sada praktički potvrdio da su mjere koje su donošene zbog pandemije bile u skladu s Ustavom, odvjetnik Mato Matić smatra kako je Stožer Civilne zaštite povrijedio ustavna prava poduzetnika te navodi da su u pitanju ozbiljne povrede tri članka Ustava (49, 50. i 54.). „Tko je Stožer CZ? Na temelju čega je donio 13 odluka? Na temelju ničega”, kaže Matić, objašnjavajući da je država trebala objaviti uvođenje izvanrednog stanja da bi Stožer mogao donositi odluke, te je podsjetio da je o tome svojedobno govorio i predsjednik Zoran Milanović. Ovako, smatra Matić, za te odluke nema zakonske podloge, a nije provedeno niti bilo kakvo istraživanje.

U međuvremenu su, što u odvjetničkom uredu smatraju bitnim, u nekoliko zemalja Europske unije donijete presude koje idu u prilog njihove argumentacije, pa navode da je Ustavni sud Španjolske proglasio lockdown iz proljeća 2020. godine protupravnim, a belgijski sudovi iz Bruxellesa su protupravnom proglasili zabranu rada ugostitelja. Također, navode i odluku Općeg suda Europske unije koja, kako kažu, tumači da bi sve ono što je odlukama Vlade i Stožera CZ zabranjeno ili ograničeno poduzetnicima trebalo biti na neki način nadoknađeno.

Hrvoje Bujas, predsjednik UGP-a, kaže da tužbe članova nisu nikakav blef te poručuje „gospodi u Vladi” da ih shvate ozbiljno. Naglašava da su u pitanju tvrtke koje su do izbijanja pandemije poslovale dobro, a „postale su ruine” ne svojom krivnjom.

Vlasnici pet malih tvrtki traže obeštećenje zbog odluka Stožera: ‘Bili smo profitabilni, danas smo ruine...‘

Pet malih tvrtki čije je poslovanje ugroženo za vrijeme pandemije pokrenulo je postupak protiv države u kojem traže obeštećenje zbog, kako tvrde, diskriminatornih odluka Stožera Civilne zaštite i neadekvatnih ekonomskim mjera Vlade, a u tome ih financira i logistički potpomaže Udruga Glas poduzetnika (UGP).

Iznos koji traže sudskim putem javno ne iznose, a kažu da je izračunat u odnosu na promet i dobit koji je svaka od tvrtki imala predpandemijske 2019. godine. Radi se o ugostiteljskim tvrtkama „Đurina hiža” iz Varaždina i Caffe&Wine Bar iz Rijeke, putničkim agencijama „Svi koncerti” iz Varaždina i „Locuples” iz okolice Splita te trgovačkom obrtu Shark Attack iz Primoštena.

Prvi korak u tužbi protiv države za naknadu štete je zahtjev za pokušajem mirnog rješenja, a on je upućen Županijskom državnom odvjetništvu u Zagrebu, rečeno je jučer na konferenciji za novinare koju je organizirao UGP. Kako su objasnili iz odvjetničkog ureda Matić i partneri koji vodi ove slučajeve, to znači da u zakonskom roku od tri mjeseca „država ima dobru šansu da pronađe modalitete i adekvatno rješenje”. Drugim riječima, smatraju da do podnošenja tužbi nadležnim sudovima i ne mora doći ukoliko se država odluči na nagodbu.

Iako je Ustavni sud svojim mišljenjima do sada praktički potvrdio da su mjere koje su donošene zbog pandemije bile u skladu s Ustavom, odvjetnik Mato Matić smatra kako je Stožer Civilne zaštite povrijedio ustavna prava poduzetnika te navodi da su u pitanju ozbiljne povrede tri članka Ustava (49, 50. i 54.). „Tko je Stožer CZ? Na temelju čega je donio 13 odluka? Na temelju ničega”, kaže Matić, objašnjavajući da je država trebala objaviti uvođenje izvanrednog stanja da bi Stožer mogao donositi odluke, te je podsjetio da je o tome svojedobno govorio i predsjednik Zoran Milanović. Ovako, smatra Matić, za te odluke nema zakonske podloge, a nije provedeno niti bilo kakvo istraživanje.
