Tomislavu Debeljaku, posrnulom vlasniku posrnulog brodogradilišta, ponestaje opcija: splitski Trgovački sud, rješenjem Katarine Mikulić, odbacio je još jedan – rekli bismo, zadnji mogući manevar – “Brodosplitov” prijedlog za novu predstečajnu nagodbu. Kojom bi taj poduzetnik pokušao zadržati nadzor nad tvrtkom.

To znači da je ostao živ još samo jedan od brojnih škverskih sudskih predmeta, onaj o pokretanju stečajnog postupka po službenoj dužnosti, koji je jesenas potpisao sudac Ivan Čulić. I protiv kojeg se Debeljakov odvjetnički tim žalio Visokom trgovačkom sudu u Zagrebu, čije se rješenje još čeka.

Potvrdi li uskoro Zagreb da je Čulić protekle jeseni ispravno pokrenuo stečajni postupak (što ne treba miješati sa samim bankrotom) u tom sada jedinom aktivnom škverskom predmetu, “Brodosplit” će vrlo izvjesno završiti u klasičnom stečaju, a Debeljak biti razvlašten.

Spasiti bi ga moglo tek 180 milijuna kuna kojima bi deblokirao račune, ali to je više domena lijepih božićnih želja za koje je vrijeme upravo prošlo. A budući da je “Brodosplit” već u blokadi duljoj od 60 dana, zakon mu ne dopušta tražiti još jedan predstečaj.

Vratimo se prvoj rečenici i vijesti da je sutkinja Mikulić 9. siječnja odbila posljednji “Brodosplitov” pokušaj predlaganja nagodbe. Njezinim riječima: “Odbacuje se kao nedopušten prijedlog dužnika ‘Brodograđevna industrija Split’ za otvaranje predstečajnog postupka.”

U svemu se pomalo i teško snaći budući da je Debeljak stalno zasipao sud novim prijedlozima, žalbama, povlačenjima prijedloga, traženjima revizije i slično. Čitava šuma papira. Pa se upućena javnost pita kojim novcem blokirani škver uopće plaća odvjetnike.

Ukratko, rastežu postupak koliko god je moguće, a splitski suci – njih nekoliko – sve su Debeljakove zahtjeve redom odbijali. Što je potvrđivao i viši sud u Zagrebu.

Ne zato što ne vole Debeljaka ili “Brodosplit”, pa simpatije nisu pravosudni kriterij, već ti zahtjevi očito nisu imali zakonsko utemeljenje. A sudovi moraju suditi po zakonu.

O tomu nešto govori i sutkinja Mikulić u rješenju kojim odbija očajnički i po mnogima besmislen škverski prijedlog.

”Uvidom u predmet ovog suda, utvrđeno je da je rješenjem od 1. kolovoza 2022. obustavljen predstečajni postupak nad dužnikom te je odlučeno da će se nakon pravomoćnosti tog rješenja postupak nastaviti kao da je podnesen prijedlog za otvaranje stečajnog postupka. Navedeno rješenje potvrđeno je rješenjem Visokog trgovačkog suda od 28. rujna.

Sukladno Stečajnom zakonu, kada se predstečajni postupak obustavi, sud će po službenoj dužnosti nastaviti postupak kao da je podnesen prijedlog za otvaranje stečajnoga postupka, osim ako utvrdi da je dužnik sposoban za plaćanje i da je ispunio sve obveze prema vjerovnicima.

Slijedom toga, sud je 21. studenoga 2022. pokrenuo prethodni postupak nad ovim dužnikom. A ako je pokrenut stečajni postupak, nije dopušteno pokretanje predstečajnog postupka. Budući da je u drugom predmetu postupak nastavljen kao da je podnesen prijedlog za otvaranje stečajnog postupka, to se prijedlog dužnika za otvaranje predstečajnog postupka od 2. siječnja 2023. godine ocjenjuje nedopuštenim.”

Tomislavu Debeljaku, posrnulom vlasniku posrnulog brodogradilišta, ponestaje opcija: splitski Trgovački sud, rješenjem Katarine Mikulić, odbacio je još jedan – rekli bismo, zadnji mogući manevar – “Brodosplitov” prijedlog za novu predstečajnu nagodbu. To znači da je ostao živ još samo jedan od brojnih škverskih sudskih predmeta, onaj o pokretanju stečajnog postupka po službenoj dužnosti, koji je jesenas potpisao sudac Ivan Čulić. I protiv kojeg se Debeljakov odvjetnički tim žalio Visokom trgovačkom sudu u Zagrebu, čije se rješenje još čeka.

Potvrdi li uskoro Zagreb da je Čulić protekle jeseni ispravno pokrenuo stečajni postupak (što ne treba miješati sa samim bankrotom) u tom sada jedinom aktivnom škverskom predmetu, “Brodosplit” će vrlo izvjesno završiti u klasičnom stečaju, a Debeljak biti razvlašten.

Spasiti bi ga moglo tek 180 milijuna kuna kojima bi deblokirao račune, ali to je više domena lijepih božićnih želja za koje je vrijeme upravo prošlo. A budući da je “Brodosplit” već u blokadi duljoj od 60 dana, zakon mu ne dopušta tražiti još jedan predstečaj.

Vratimo se prvoj rečenici i vijesti da je sutkinja Mikulić 9. siječnja odbila posljednji “Brodosplitov” pokušaj predlaganja nagodbe. Njezinim riječima: “Odbacuje se kao nedopušten prijedlog dužnika ‘Brodograđevna industrija Split’ za otvaranje predstečajnog postupka.”

U svemu se pomalo i teško snaći budući da je Debeljak stalno zasipao sud novim prijedlozima, žalbama, povlačenjima prijedloga, traženjima revizije i slično. Čitava šuma papira. Pa se upućena javnost pita kojim novcem blokirani škver uopće plaća odvjetnike.

Ukratko, rastežu postupak koliko god je moguće, a splitski suci – njih nekoliko – sve su Debeljakove zahtjeve redom odbijali. Što je potvrđivao i viši sud u Zagrebu.

Ne zato što ne vole Debeljaka ili “Brodosplit”, pa simpatije nisu pravosudni kriterij, već ti zahtjevi očito nisu imali zakonsko utemeljenje. A sudovi moraju suditi po zakonu.

O tomu nešto govori i sutkinja Mikulić u rješenju kojim odbija očajnički i po mnogima besmislen škverski prijedlog.

”Uvidom u predmet ovog suda, utvrđeno je da je rješenjem od 1. kolovoza 2022. obustavljen predstečajni postupak nad dužnikom te je odlučeno da će se nakon pravomoćnosti tog rješenja postupak nastaviti kao da je podnesen prijedlog za otvaranje stečajnog postupka. Navedeno rješenje potvrđeno je rješenjem Visokog trgovačkog suda od 28. rujna.

Sukladno Stečajnom zakonu, kada se predstečajni postupak obustavi, sud će po službenoj dužnosti nastaviti postupak kao da je podnesen prijedlog za otvaranje stečajnoga postupka, osim ako utvrdi da je dužnik sposoban za plaćanje i da je ispunio sve obveze prema vjerovnicima.

Slijedom toga, sud je 21. studenoga 2022. pokrenuo prethodni postupak nad ovim dužnikom. A ako je pokrenut stečajni postupak, nije dopušteno pokretanje predstečajnog postupka. Budući da je u drugom predmetu postupak nastavljen kao da je podnesen prijedlog za otvaranje stečajnog postupka, to se prijedlog dužnika za otvaranje predstečajnog postupka od 2. siječnja 2023. godine ocjenjuje nedopuštenim.”

Tomislavu Debeljaku, posrnulom vlasniku posrnulog brodogradilišta, ponestaje opcija: splitski Trgovački sud, rješenjem Katarine Mikulić, odbacio je još jedan – rekli bismo, zadnji mogući manevar – “Brodosplitov” prijedlog za novu predstečajnu nagodbu. Kojom bi taj poduzetnik pokušao zadržati nadzor nad tvrtkom.
