Od 1. siječnja 2023., na snagu stupa novi model obiteljskih mirovina, a Hrvatski zavod za mirovinsko osiguranje je sada izdao tiskarnicu koju je potrebno ispuniti i poslati u najbližu ispostavu ili ured HZMO-a.

Riječ je zahtjevu koji ispunjavaju one udovice i udovci koji žele nastaviti primati svoju mirovinu u punom iznosu uz dodatak od 27 posto obiteljske mirovine, donosi N1.

Novim izmjenama zakona umirovljenici će moći naslijediti 27 posto mirovine preminulog supružnika, uz zadržavanje vlastite starosne ili invalidske mirovine.

Zatečenim korisnicima obiteljske mirovine HZMO će po službenoj dužnosti, počevši od 1. siječnja 2023. odrediti obiteljsku mirovinu s povećanim mirovinskim faktorom bez donošenja rješenja, stoga za navedeno povećanje nije potrebno podnositi zahtjev.

Kako se određuje pripadajući dio obiteljske mirovine?

Iznos dijela obiteljske mirovine određuje se u visini od 27% od obiteljske mirovine za jednog člana obitelji, a propisuje se najniži i najviši iznos.

Najniži iznos određuje se u visini tri aktualne vrijednosti mirovine (AVM), ali ne više od 50% pripadajuće obiteljske mirovine. Najviši iznos dijela obiteljske mirovine, ako je zbroj starosne, prijevremene starosne ili invalidske mirovine i dijela obiteljske mirovine veći od 80 AVM-a, isplaćuje se u visini razlike do 80 AVM-a (AVM se usklađuje dva puta godišnje, 1. siječnja i 1. srpnja).

Za korisnike obiteljske mirovine određene u visini najniže odnosno najviše mirovine dio obiteljske mirovine određuje se od najniže, odnosno najviše mirovine. Pravo na isplatu dijela obiteljske mirovine ostvaruje se na temelju zahtjeva korisnika mirovine.

Tiskanica zahtjeva za isplatu dijela obiteljske mirovine dostupna na stranicama Hrvatskog zavoda za mirovinsko osiguranje, a bit će dostupna i putem e-usluga HZMO-a unutar sustava e-Građani od 2. siječnja 2023.

Što je sve potrebno dostaviti?

U HZMO napominju da uz zahtjev za isplatu dijela obiteljske mirovine nije potrebno dostavljati drugu dokumentaciju. U zahtjevu za isplatu dijela obiteljske mirovine treba navesti osobne podatke podnositelja zahtjeva i umrlog osiguranika (korisnika mirovine) te podatke za kontakt, donosi N1

Zahtjev se može se podnijeti i usmeno u zapisnik, a može se predati besplatno i u svim poštanskim uredima na području RH te u Mirovinskim informativnim centrima u Zagrebu (Gradišćanska 26), Splitu (Matoševa 3), Osijeku (J. J. Strossmayera 3) i Rijeci (Titov trg 8A). Ako zahtjev podnosi skrbnik ili opunomoćenik potrebno je priložiti odluku o imenovanju skrbnika ili punomoć.

Zahtjev se može predati i za šest mjeseci unatrag, ali najranije od dana ispunjenja uvjeta za stjecanje tog prava i ne prije 1. siječnja 2023.

Kako bi lakše saznali tko sve ima pravo na dio obiteljske mirovine, HZMO je pripremio odgovore na česta pitanja, kao i primjere iz prakse. Od 1. siječnja 2023., na snagu stupa novi model obiteljskih mirovina, a Hrvatski zavod za mirovinsko osiguranje je sada izdao tiskarnicu koju je potrebno ispuniti i poslati u najbližu ispostavu ili ured HZMO-a.

Riječ je zahtjevu koji ispunjavaju one udovice i udovci koji žele nastaviti primati svoju mirovinu u punom iznosu uz dodatak od 27 posto obiteljske mirovine, donosi N1.

Novim izmjenama zakona umirovljenici će moći naslijediti 27 posto mirovine preminulog supružnika, uz zadržavanje vlastite starosne ili invalidske mirovine.

Zatečenim korisnicima obiteljske mirovine HZMO će po službenoj dužnosti, počevši od 1. siječnja 2023. odrediti obiteljsku mirovinu s povećanim mirovinskim faktorom bez donošenja rješenja, stoga za navedeno povećanje nije potrebno podnositi zahtjev.

Kako se određuje pripadajući dio obiteljske mirovine?

Iznos dijela obiteljske mirovine određuje se u visini od 27% od obiteljske mirovine za jednog člana obitelji, a propisuje se najniži i najviši iznos.

Najniži iznos određuje se u visini tri aktualne vrijednosti mirovine (AVM), ali ne više od 50% pripadajuće obiteljske mirovine. Najviši iznos dijela obiteljske mirovine, ako je zbroj starosne, prijevremene starosne ili invalidske mirovine i dijela obiteljske mirovine veći od 80 AVM-a, isplaćuje se u visini razlike do 80 AVM-a (AVM se usklađuje dva puta godišnje, 1. siječnja i 1. srpnja).

Za korisnike obiteljske mirovine određene u visini najniže odnosno najviše mirovine dio obiteljske mirovine određuje se od najniže, odnosno najviše mirovine. Pravo na isplatu dijela obiteljske mirovine ostvaruje se na temelju zahtjeva korisnika mirovine.

Tiskanica zahtjeva za isplatu dijela obiteljske mirovine dostupna na stranicama Hrvatskog zavoda za mirovinsko osiguranje, a bit će dostupna i putem e-usluga HZMO-a unutar sustava e-Građani od 2. siječnja 2023.

Što je sve potrebno dostaviti?

U HZMO napominju da uz zahtjev za isplatu dijela obiteljske mirovine nije potrebno dostavljati drugu dokumentaciju. U zahtjevu za isplatu dijela obiteljske mirovine treba navesti osobne podatke podnositelja zahtjeva i umrlog osiguranika (korisnika mirovine) te podatke za kontakt, donosi N1

Zahtjev se može se podnijeti i usmeno u zapisnik, a može se predati besplatno i u svim poštanskim uredima na području RH te u Mirovinskim informativnim centrima u Zagrebu (Gradišćanska 26), Splitu (Matoševa 3), Osijeku (J. J. Strossmayera 3) i Rijeci (Titov trg 8A). Ako zahtjev podnosi skrbnik ili opunomoćenik potrebno je priložiti odluku o imenovanju skrbnika ili punomoć.

Zahtjev se može predati i za šest mjeseci unatrag, ali najranije od dana ispunjenja uvjeta za stjecanje tog prava i ne prije 1. siječnja 2023.

Kako bi lakše saznali tko sve ima pravo na dio obiteljske mirovine, HZMO je pripremio odgovore na česta pitanja, kao i primjere iz prakse. Dodatne informacije mogu se dobiti pozivom na Infocentar, radnim danom od 8 do 16 sati, na brojeve telefona 01/ 45 95 011 i 01/ 45 95 022, putem web-obrasca, ali i na letku.
