Gradonačelnik Sinja Miro Bulj ne zarezuje COVID potvrde ni pod razno. Bez obzira što su postale obvezne za zaposlenike državnih i inih institucija, Bulju, naglasio je, nisu važne. Ista je situacija u Primoštenu. Načelnik Stipe Petrina na istim je pozicijama, piše Slobodna Dalmacija.

Dio građana im daje za pravo jer COVID potvrde smatraju nekom vrstom segregacije, diskriminacije onih koji se ne žele ili ne mogu cijepiti, odnosno koji se ne žele ni testirati bez obzira što se koronavirus nezaustavljivo širi, a funkcioniranje zdravstvenog sustava zbog velikog je broja oboljelih ozbiljno ugroženo.

Jesu li COVID potvrde u skladu s ustavnim pravom jednakosti građana? 

– Jesu! – kategorički tvrdi Mato Palić, profesor ustavnog prava s Pravnog fakulteta u Osijeku. – I to je Ustavni sud Republike Hrvatske već jasno potvrdio kroz nekoliko svojih odluka propitujući rad Stožera, te zaključivši da je njegov rad zakonit sto posto – kaže naš uvaženi ustavni stručnjak.

Nije istina, veli, da rad i djelokrug Stožera civilne zaštite RH za sprečavanje širenja zaraze koronavirusom nije, a kako se to nerijetko može čuti u javnosti, zakonski uređeno pa je zato i dvojbeno. 

– Dapače, to je provedeno izmjenama i dopunama Zakona o civilnoj zaštiti odmah na početku pandemije, tako da su sve odluke koje Stožer donosi legitimne i legalne. Ukratko, Stožer je vlast, a nepoštovanjem njihovih odluka riskirate sankcije – kaže prof. dr. Palić.

Prije tri dana, u Narodnim novinama objavljena je Odluka o uvođenju posebne sigurnosne mjere obveznog testiranja dužnosnika, državnih službenika i namještenika, službenika i namještenika u javnim službama, službenika i namještenika u lokalnoj i područnoj (regionalnoj) samoupravi, te zaposlenika trgovačkih društava i ustanova. 

Pravnici koji rade u pisarnici Trgovačkog suda u Splitu ovu Odluku smatraju neustavnom.

– Ustavni sud će i u ovom slučaju stati na stranu Stožera jer je Odluka bez ikakve dileme u skladu s Ustavom. Svi oni koji uvjeravaju ljude u suprotno poput, recimo, vukovarskoga gradonačelnika Ivana Penave, krše zakon, ponašaju se neodgovorno i obmanjuju ljude. Bit ću malo grub, ali to što Penava i neki drugi rade je podrivanje poretka kada je u pitanju borba protiv širenja zarazne bolesti – kaže profesor Palić i upozorava da oni koji ne poštuju propisane mjere mogu dobiti izvanredni otkaz. 

I profesorica Sanja Barić s Katedre za ustavno pravo na Pravnom fakultetu u Rijeci, stajališta je da su sve mjere čiji je cilj suzbijanje pandemije koronavirusa u skladu s Ustavom.

– Jedino na što se možda mogu požaliti građani koji se bune protiv COVID potvrda jest da su one mogle biti prije najavljene, odnosno da se moglo ostaviti nešto dulje razdoblje za prilagodbu na nove uvjete.

Osim toga, tu se ne radi ni o kakvoj segregaciji jer i dalje postoji pravo na izbor: cijepljenje ili testiranje. Sve ovo što se sada provodi u skladu je s Ustavom; uostalom, i Ustavni sud je dao svoje mišljenje o tome i potvrdio da je sve u redu. Možda se na početku pandemije Saboru trebalo dati na važnosti, i sama sam bila za to, u smislu rasprave i donošenja odluka o suzbijanju pandemije, no svejedno bi na koncu sve sadržajno bilo isto kao i sada – kaže profesorica Barić.

Gradonačelnik Sinja Miro Bulj ne zarezuje COVID potvrde ni pod razno. Bez obzira što su postale obvezne za zaposlenike državnih i inih institucija, Bulju, naglasio je, nisu važne. Ista je situacija u Primoštenu. Načelnik Stipe Petrina na istim je pozicijama, piše Slobodna Dalmacija.

Dio građana im daje za pravo jer COVID potvrde smatraju nekom vrstom segregacije, diskriminacije onih koji se ne žele ili ne mogu cijepiti, odnosno koji se ne žele ni testirati bez obzira što se koronavirus nezaustavljivo širi, a funkcioniranje zdravstvenog sustava zbog velikog je broja oboljelih ozbiljno ugroženo.

Jesu li COVID potvrde u skladu s ustavnim pravom jednakosti građana? 

– Jesu! – kategorički tvrdi Mato Palić, profesor ustavnog prava s Pravnog fakulteta u Osijeku. – I to je Ustavni sud Republike Hrvatske već jasno potvrdio kroz nekoliko svojih odluka propitujući rad Stožera, te zaključivši da je njegov rad zakonit sto posto – kaže naš uvaženi ustavni stručnjak.

Nije istina, veli, da rad i djelokrug Stožera civilne zaštite RH za sprečavanje širenja zaraze koronavirusom nije, a kako se to nerijetko može čuti u javnosti, zakonski uređeno pa je zato i dvojbeno. 

– Dapače, to je provedeno izmjenama i dopunama Zakona o civilnoj zaštiti odmah na početku pandemije, tako da su sve odluke koje Stožer donosi legitimne i legalne. Ukratko, Stožer je vlast, a nepoštovanjem njihovih odluka riskirate sankcije – kaže prof. dr. Palić.

Prije tri dana, u Narodnim novinama objavljena je Odluka o uvođenju posebne sigurnosne mjere obveznog testiranja dužnosnika, državnih službenika i namještenika, službenika i namještenika u javnim službama, službenika i namještenika u lokalnoj i područnoj (regionalnoj) samoupravi, te zaposlenika trgovačkih društava i ustanova. 

Pravnici koji rade u pisarnici Trgovačkog suda u Splitu ovu Odluku smatraju neustavnom.

– Ustavni sud će i u ovom slučaju stati na stranu Stožera jer je Odluka bez ikakve dileme u skladu s Ustavom. Svi oni koji uvjeravaju ljude u suprotno poput, recimo, vukovarskoga gradonačelnika Ivana Penave, krše zakon, ponašaju se neodgovorno i obmanjuju ljude. Bit ću malo grub, ali to što Penava i neki drugi rade je podrivanje poretka kada je u pitanju borba protiv širenja zarazne bolesti – kaže profesor Palić i upozorava da oni koji ne poštuju propisane mjere mogu dobiti izvanredni otkaz. 

I profesorica Sanja Barić s Katedre za ustavno pravo na Pravnom fakultetu u Rijeci, stajališta je da su sve mjere čiji je cilj suzbijanje pandemije koronavirusa u skladu s Ustavom.

– Jedino na što se možda mogu požaliti građani koji se bune protiv COVID potvrda jest da su one mogle biti prije najavljene, odnosno da se moglo ostaviti nešto dulje razdoblje za prilagodbu na nove uvjete.

Osim toga, tu se ne radi ni o kakvoj segregaciji jer i dalje postoji pravo na izbor: cijepljenje ili testiranje. Sve ovo što se sada provodi u skladu je s Ustavom; uostalom, i Ustavni sud je dao svoje mišljenje o tome i potvrdio da je sve u redu. Možda se na početku pandemije Saboru trebalo dati na važnosti, i sama sam bila za to, u smislu rasprave i donošenja odluka o suzbijanju pandemije, no svejedno bi na koncu sve sadržajno bilo isto kao i sada – kaže profesorica Barić.

Gradonačelnik Sinja Miro Bulj ne zarezuje COVID potvrde ni pod razno. Bez obzira što su postale obvezne za zaposlenike državnih i inih institucija, Bulju, naglasio je, nisu važne. Ista je situacija u Primoštenu. Načelnik Stipe Petrina na istim je pozicijama, piše Slobodna Dalmacija.

Dio građana im daje za pravo jer COVID potvrde smatraju nekom vrstom segregacije, diskriminacije onih koji se ne žele ili ne mogu cijepiti, odnosno koji se ne žele ni testirati bez obzira što se koronavirus nezaustavljivo širi, a funkcioniranje zdravstvenog sustava zbog velikog je broja oboljelih ozbiljno ugroženo.

Jesu li COVID potvrde u skladu s ustavnim pravom jednakosti građana? 

– Jesu! – kategorički tvrdi Mato Palić, profesor ustavnog prava s Pravnog fakulteta u Osijeku. – I to je Ustavni sud Republike Hrvatske već jasno potvrdio kroz nekoliko svojih odluka propitujući rad Stožera, te zaključivši da je njegov rad zakonit sto posto – kaže naš uvaženi ustavni stručnjak.

Nije istina, veli, da rad i djelokrug Stožera civilne zaštite RH za sprečavanje širenja zaraze koronavirusom nije, a kako se to nerijetko može čuti u javnosti, zakonski uređeno pa je zato i dvojbeno.
