Slovenska vlada, kako donosi ljubljansko Delo, ne kani blokirati ulazak Hrvatske u Schengen u prosincu, kad će o tome odlučivati ministri unutarnjih poslova jer je to, kako ističu, i slovenski interes.
Ali, prenosi dnevni list s pouzdanim informacijama, vlada kani prihvatiti jednostranu izjavu da Hrvatska, ulaskom u Schengenski prostor, prihvaća arbitražnu presudu. Onu kompromitiranu nedopuštenim dosluhom slovenske agentice i slovenskog suca.
Dobra vijest iz članka Dela je da Slovenija vjeruje da će Hrvatska biti primljena u Schengen. O tome je jučer pozitivnu ocjenu dao i nadležni odbor Europskog parlamenta.
Teza nije nova, Vojko Volk, vanjskopolitički savjetnik slovenskog premijera Roberta Goloba - i bivši slovenski ambasador u Hrvatskoj - već je ranije bio rekao da Hrvatska ulaskom u Schengen, pravno gledano, priznaje granice države koje su članice tog prostora. Iz toga je izvukao zaključak, koji pravno i ne stoji, da time Hrvatska posredno priznaje i arbitražnu odluku.
Dr. Matej Avbelj, stručnjak za pravo EU s fakulteta za Državne i europske studije, upozorava u Delu da će Hrvatska vjerojatno nakon slovenske izjave donijeti i vlastitu, ali da su one, po pravu EU, bespredmetne. Njihov učinak na arbitražnu presudu je također ništavan, pri čemu dr. Avbelj smatra da je arbitražna presuda valjana. Iako je donesena, primjerice, bez hrvatskog suca. Dr. Avbelj razborito zaključuje da bi scenarij "izjava na izjavu" bio namijenjen isključivo unutarnjoj politici i "ponovnom zaoštravanju susjedskih odnosa", piše Jutarnji list.
S čime se slaže i dr. Janja Hojnik, stručnjakinja za europsko pravo s mariborskog Pravnog fakulteta, koja ističe da jednostrana izjava ne može imati prirodu međunarodnog sporazuma niti bi i na koji način obvezivala Hrvatsku i ne može biti dio pravnog sustava EU. Ne protivi se donošenju izjave, ali podsjeća na presudu Suda EU koji je odbaci nadležnost u tom slučaju. Dodaje i da bi blokada Hrvatske škodila međunarodnom ugledu Slovenije. Nancy Pelosi, predsjednica američkog Kongresa, u Zagrebu je prije dva dana rekla da SAD podržava ulazak Hrvatske u Schengen, a Slovenija se dobro sjeća kakve je negativne posljedice imao pokušaj blokade ulaska Hrvatske u NATO.
Delo tekst zaključuje navodeći mogućnost da Slovenija prihvati ulazak Hrvatske u Schengen, ali da odmah nakon toga uvede kontrole na granici zbog migracija po modelu koji na slovenskoj granici koristi Austrija.

Slovenska vlada, kako donosi ljubljansko Delo, ne kani blokirati ulazak Hrvatske u Schengen u prosincu, kad će o tome odlučivati ministri unutarnjih poslova jer je to, kako ističu, i slovenski interes.
Ali, prenosi dnevni list s pouzdanim informacijama, vlada kani prihvatiti jednostranu izjavu da Hrvatska, ulaskom u Schengenski prostor, prihvaća arbitražnu presudu. Onu kompromitiranu nedopuštenim dosluhom slovenske agentice i slovenskog suca.
Dobra vijest iz članka Dela je da Slovenija vjeruje da će Hrvatska biti primljena u Schengen. O tome je jučer pozitivnu ocjenu dao i nadležni odbor Europskog parlamenta.
Teza nije nova, Vojko Volk, vanjskopolitički savjetnik slovenskog premijera Roberta Goloba - i bivši slovenski ambasador u Hrvatskoj - već je ranije bio rekao da Hrvatska ulaskom u Schengen, pravno gledano, priznaje granice države koje su članice tog prostora. Iz toga je izvukao zaključak, koji pravno i ne stoji, da time Hrvatska posredno priznaje i arbitražnu odluku.
Dr. Matej Avbelj, stručnjak za pravo EU s fakulteta za Državne i europske studije, upozorava u Delu da će Hrvatska vjerojatno nakon slovenske izjave donijeti i vlastitu, ali da su one, po pravu EU, bespredmetne. Njihov učinak na arbitražnu presudu je također ništavan, pri čemu dr. Avbelj smatra da je arbitražna presuda valjana. Iako je donesena, primjerice, bez hrvatskog suca. Dr. Avbelj razborito zaključuje da bi scenarij "izjava na izjavu" bio namijenjen isključivo unutarnjoj politici i "ponovnom zaoštravanju susjedskih odnosa", piše Jutarnji list.
S čime se slaže i dr. Janja Hojnik, stručnjakinja za europsko pravo s mariborskog Pravnog fakulteta, koja ističe da jednostrana izjava ne može imati prirodu međunarodnog sporazuma niti bi i na koji način obvezivala Hrvatsku i ne može biti dio pravnog sustava EU. Ne protivi se donošenju izjave, ali podsjeća na presudu Suda EU koji je odbaci nadležnost u tom slučaju. Dodaje i da bi blokada Hrvatske škodila međunarodnom ugledu Slovenije. Nancy Pelosi, predsjednica američkog Kongresa, u Zagrebu je prije dva dana rekla da SAD podržava ulazak Hrvatske u Schengen, a Slovenija se dobro sjeća kakve je negativne posljedice imao pokušaj blokade ulaska Hrvatske u NATO.
Delo tekst zaključuje navodeći mogućnost da Slovenija prihvati ulazak Hrvatske u Schengen, ali da odmah nakon toga uvede kontrole na granici zbog migracija po modelu koji na slovenskoj granici koristi Austrija.
